WHEREAS, the Board of County Commissioners of Weld County,

Colorado, pursuant to Colorado statute and the Weld County Home
N- Rule Charter, is vested with the authority of administering the

WHEREAS, the Board of County Commissioners of Weld County,

0 Colorado has reviewed the request of McDonald C. Brand, et al. ,

o for an exemption from the definitions of "subdivision" and "sub-
F divided land" in Section 30-29-101 (10) , CRS 1973 , as amended, and
U\ Section 2-1 of the Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that McDonald
C. Brand, et al. , are owners of certain parcels of land located in
part of Section 15, Township 1 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as follows:
PARCEL 1
The Southwest One-Quarter of Section Fifteen, Town-
ship One North, Range Sixty-Seven West of the Sixth
Principal Meridian, and
The South One-Half of the South One-Half of Section
Sixteen, Township One North, Range Sixty-Seven West
of the Sixth Principal Meridian, County of Weld,
State of Colorado,
TOGETHER with (a) twenty (20) shares of the capital
stock of the FARMERS RESERVOIR AND IRRIGATION COM-
PANY; five (5) shares of the capital stock of BIG
DRY DREEK DITCH AND RESERVOIR COMPANY; and, all
water rights appurtenant to the afore-described real
property not included in the aforesaid shares, (b)
all easements and rights of way appurtenant to the
afore-described real property or water rights, (c)
all improvements and fixtures presently located and
situated on the afre-described real property, and
(d) all oil, gas and other minerals concerning the
afore-described real property to the extent that the
sane are or ever have been owned by Mike Roskop,
trustee.
PARCEL 2
An undivided one-half interest in that portion of the
Northeast Quarter, Section Twenty-one, Township One
North, Range Sixty-seven West of the Sixth Principal
Meridian, Weld County, Colorado, described as follows:
Commencing at the Southeast corner of Section Sixteen,
Township One North, Range Sixty-seven West of the
Sixth Principal Meridian, running thence southwesterly
along the northerly line of the now existing county road
to a point past the Dry Creek Ditch, thence northwesterly

along the easterly line of the county road as now existing
to the South line of said Section Sixteen; thence East to
the Point of Beginning.
Mr. Brand and Mr. Enter have sold a 40 acres parcel to North Star
Farms, which owns the contiguous 160 acres parcel, the Southwest
Quarter of Section 15 . The subdivision exemption will tie the
two parcels of agricultural land together into one 200 acre parcel.
No new lots will be created by this exemption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcels of land be, and hereby are, declared to be exempt from the
definitions of "subdivision" and "subdivided land" as set forth in
Section 30-29-101 (10) , CRS 1973, as amended, and Section 2-1 of the
Weld County Subdivision Regulations, and
BE IT FURTHER RESOLVED by the Board that the resulting parcels
of land be, and hereby are, considered to be single lots.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 4th day of
April, A.D. , 1979 .

lations adopted August 30, 1972 , which defines the term subdivi-

some kind. North Star Pheasant Farms is located to the west. The
40 acre parcel, (NZNZSW4) appears to be mainly pasture.
