A public hearing was conducted on August 24. 2016, at 10:00 a.m.. with the following present: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board. Tisa Juanicorena Assistant County Attorney. Frank Haug Planning Services Department representative. Michelle Martin Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Brown Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 15. 2016, and duly published July 20. 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of Bruce Sandau, dba Green Earth Environmental, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR15-0057, for a Use permitted as a Use by Right. Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (truck and vehicle storage and staging, including landscaping equipment and materials storage for Green Earth Environmental, Inc., a stormwater management. landscape. reclamation and soil remediation service company) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Frank Haug. Assistant County Attorney, made this a matter of record. Michelle Martin, Department of Planning Services, presented a brief summary of the proposal and stated 14 referrals were sent out and 11 recipients either did not respond or indicated no concerns. She reviewed the site location in relation to relevant County Roads and described the intent of the applicant to include indoor and outdoor storage and an office. (USR15-0057) PAGE 2 stated two (2) businesses will be on this property and both are owned by Mr. Sandau: however, a portion of the property may be leased in the future explaining the amendment to accommodate future leases. Ms. Martin described the daily operations, hours of operation, fencing. adjacent lands and nearest residences and USRs. She stated no correspondence in relation to this application has been received. Ms. Martin stated the site is located within the three (3) mile referral area of the City of Greeley and she reviewed the response submitted through the referral process. She stated the site is not located in any Intergovernmental Agreement Area of any municipality.. displayed images of the site and surrounding properties and entered the favorable recommendation of the Planning Commission into the record as written. NI Evan Pinkham, Department of Public Works. provided a brief overview of the transportation plans and requirements to include the average daily traffic count and the traffic narrative to include daily round trips. Mr. Pinkham stated an Access Permit has been approved. AP15-00474. and he reviewed the approved access and those to be closed. Furthermore, he stated tracking control and an Improvements Agreement will be required. Hayley Brown, Planning Services Engineer representative. presented the drainage and grading requirements. P Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating water is provided by the North Weld County Water District. She clarified the use of portable toilets is acceptable: however, there is an existing commercial grade septic for the large building which will accommodate up to 35 people. Ms. Light stated there is a house on the site that has an unpermitted septic which will be required to be permitted with the remodeling of the house. She stated Development Standards (DS) #13-23 address typical Environmental Health items. Bruce Sandau. applicant, stated he would prefer a rail fence instead of a privacy fence and explained early in the application process he was asked to screen that area with a privacy fence. No public testimony was offered concerning this matter. E1 Commissioner Kirkmeyer suggested amending the hours of operation to 6:00 a.m. to 9:00 p.m. a In response to Chair Freeman, Mr. Sandau stated no concerns with any of the Conditions of Approval or Development Standards. Commissioner Kirkmeyer recommended deleting Condition of Approval (COA) #1.A. DS #7, COA #1.B.12, and COA #5.A. The Board agreed. Commissioner Kirkmeyer recommended changing DS #9 to read, "The site shall be maintained to mitigate any impacts to the public road." She reminded the Board to amend DS #3 regarding the hours of operation as mentioned above. She further suggested changing DS #t'l to read. "The maximum number of employees shall be 35." Commissioner Kirkmeyer inquired regarding DS #16. In response to Commissioner Conway. Mr. Sandau stated they are hosing off the trucks. (USR15-0057) PAGE 3 Commissioner Kirkmeyer suggested deleting the second sentence in DS #18. The Board agreed to all the recommended changes. In response to Chair Freeman, Mr. Sandau indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Kirkmeyer moved to approve the request of Bruce Sandau, dba Green Earth Environmental, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR15-0057, for a Use permitted as a Use by Right. Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (truck and vehicle storage and staging, including landscaping equipment and materials storage for Green Earth Environmental, Inc., a stormwater management, landscape, reclamation and soil remediation service company) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
