Chair Commissioner Sean P. Conway. Pro -Tern Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative. Diana Aungst Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Brown Health Department representative, Lauren Light The following business was transacted: VA I hereby certify that pursuant to a notice dated May 27. 2016, and duly published June 1. 2016. in the Greeley Tribune, a public hearing was conducted to consider the request of Gander Valley Farms, LTD. for a Change of Zone, PUDZ16-0001, to Rezone Lot 5 of Gander Valley PUD from Planned Unit Development with A (Agricultural) Zone District Uses to Planned Unit Development with E (Estate) Zone District Uses. along with 6.09 acres of open space. Bob Choate, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and stated 16 referrals were sent out and 13 either did not respond or indicated no concerns. She reviewed the site location and stated the proposed lots will vary in size but are consistent with the existing lots in adjacent PUDs. Ms. Aungst reviewed the current zoning and clarified with the Change of Zone, the internal road system will be paved and she described the proposed signage to be constructed at the entrance of the PUD based on the handout provided by the applicant. She stated staff has received one letter of support regarding this application and she reviewed the referral responses from the municipalities located within the three (3) mile referral area of the site to include Larimer County. and the Towns of Severance and Windsor. Ms. Aungst displayed images of the site and surrounding area and entered the favorable recommendation of the Planning Commission into the record as written. Evan Pinkham, Public Works Department representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit has been approved, AP15-00590. and he provided the average daily traffic counts on County Road (CR) 72. (PUDZ16-0001) PAGE 2 the traffic narrative included approximately 95 daily trips and both tracking control and an Improvements Agreement are required. Hayley Brown, Planning Services Engineer representative, presented the drainage and grading requirements stating the applicant has submitted a drainage report to include a detention pond and the 6.09 acres of open space. She clarified the applicant will need to submit a final drainage report prior to recording the final plat. and if the applicant disturbs over one (1) acre, a Weld County Grading Permit is required. Ms. Brown stated the applicant must show and label drainage features and flow arrows and the detention pond must be labeled as required. She further stated historical flow patterns and runoff amounts must be maintained and Weld County is not responsible for the maintenance on -site drainage related features. Li Lauren Light, Department of Public Health and Environment. reviewed the water and sewer provisions stating that North Weld County Water District will provide water and individual septic systems will provide sewer service. Ms Light clarified Conditions of Approval #1.C.8 through #1.C.12 address typical Environmental Health items. Jeff Couch represented the applicant and stated the project was platted almost 20 years ago and the intent is to finish the vacant parcels and build higher quality homes. No public testimony was offered concerning this matter. In response to Chair Freeman, Mr. Couch indicated no concerns with the Conditions of Approval. In response to Commissioner Kirkmeyer, Ms. Aungst stated according to the Code, a Homeowners' Association is required. In further response, Mr. Couch stated they are desiring to instate a Homeowners' Association. Commissioners Kirkmeyer and Cozad each had a grammatical correction. The Board agreed to all changes. In response to Chair Freeman. Mr. Couch indicated he has reviewed, and agrees to abide by, the Conditions of Approval, as amended. GCommissioner Cozad moved to approve the request of Gander Valley Farms LTD, for a Change of Zone, PUDZ16-0001. to Rezone Lot 5 of Gander Valley PUD from Planned Unit Development with A (Agricultural) Zone District Uses to Planned Unit Development with E (Estate) Zone District Uses, along with 6.09 acres of open space. based on the recommendations of Planning staff and the Planning Commission. with the Conditions of Approval as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
