The Colorado Department of Public Health and Environment has no comment on the special review
permit for a kennel referral USR16-0038. We do suggest that the applicant comply with all state
and federal environmental rules and regulations. This may require the applicant or its contractor to
obtain a permit for certain regulated activities before emitting or discharging a pollutant into the
air or water, dispose of hazardous waste or engaging in certain regulated activities.

Dear Ms. Aungst:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The applicant is requesting a site specific development plan and use by special review permit
for a kennel (32 dogs and cats boarding kennel including the applicant's animals). The water
supply for the proposed kennel will be through a water tap from the Aristocrat Ranchettes
Water Project ("Aristocrat"). No information was provided on the specific amount of water
that will be required to serve the kennel. In addition, a letter of commitment from Aristocrat
was not provided with the referral material therefore it is not known if the Aristocrat is
willing to supply this facility or has the water available for this facility.
Based on the information available in the State Engineer's Office Aristocrat has three wells
operating under permit nos. 20551-F, 20552-F, and 33736-F that provide water to the central
supply system for the Aristocrat Ranchettes subdivision. These wells were decreed by the
Division 1 Water Court in Case No. 93CW139. Well permit no. 20551-F is limited to a maximum
pumping rate of 70 GPM (per decree) and an annual withdrawal of 111.4 acre-feet/year in
combination with well no. 20552-F and 33736-F. Well permit no. 20552-F is limited to a
maximum pumping rate of 61 GPM (per decree) and an annual withdrawal 111.4 acre-
feet/year in combination with well no. 20551-F and 33736-F. Well permit no. 33736-F is
limited to a maximum pumping rate of 200 GPM (per decree) and an annual withdrawal 111.4
acre-feet/year in combination with well no. 20551-F and 20552-F. All three wells produce
water from the Laramie -Fox Hills aquifer underlying Section 27, Township 2 North, Range 66
West, 6th P.M., in accordance with Section 37-90-137(4) C.R.S. Well permit nos. 20551-F,
