HomeMy WebLinkAbout20162384.tiffHEARING CERTIFICATION DOCKET NO. 2016-63 RE: CHANGE OF ZONE, COZ16-0002, FROM THE C-1 (NEIGHBORHOOD COMMERCIAL) ZONE DISTRICT TO THE 1-3 (INDUSTRIAL) ZONE DISTRICT - COASTAL CHEMICAL, CO., LLC. A public hearing was conducted on August 10, 2016. at 10:00 a.m.. with the following present: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway. Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board. Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative. Kim Ogle Public Works Department representative, Janet Lundquist Planning Services Engineer representative, Hayley Brown Health Department representative, Lauren Light The following business was transacted: a. I hereby certify that pursuant to a notice dated July 1, 2016. and duly published July 6, 2016. in the Greeley Tribune, a public hearing was conducted to consider the request of Coastal Chemical. CO, LLC, for a Change of Zone, COZ16-0002. from the C-1 (Neighborhood Commercial) Zone District to the 1-3 (Industrial) Zone District. Bob Choate, Assistant County Attorney. made this a matter of record. G Kim Ogle. Department of Planning Services. presented a brief summary of the proposal and provided the location in relation to relevant County roads and City of Greeley streets and stated the site is adjacent to the City of Greeley's corporate limits. He stated the site is located in the three (3) mile referral area of the City of Greeley and he reviewed the advisory comments provided in the referral response dated May 20, 2016. Mr. Ogle clarified the site is located in the Long Range Expected Growth Area of the City of Greeley, which promotes industrial uses in that vicinity He stated the majority of the site is in the Cache la Poudre flood plain and provided the Flood Hazard Development Permit, FHDP#15-0058. The proposed COZ will not preclude or prohibit the extraction of mineral deposits. Mr. Ogle stated ten (10) referrals were sent out with six (6) responses offering comments, which have been taken into consideration. He displayed images of the site and the surrounding properties and entered the favorable recommendation of the Planning Commission into the record as written. Evan Pinkham, Public Works Department representative, provided a brief overview of the transportation plans and requirements. He stated the Access Permit has been approved. LLC (COZ16-0002) PAGE 2 Hayley Brown, Planning Services Engineer representative, presented the drainage and grading requirements to include maintaining historical flow patterns and runoff amounts. Ben Frissell. Department of Public Health and Environment. reviewed the water and sewer provisions and stated, as specified by the Assistant County Attorney, that water and sewer are not required for the proposed use indicated by the property owner; however, if they become required due to development. annexation into Greely may be required as utilities are available with no obvious impediments to connect. He reviewed the typical requirements related to Environmental Health. In response to Commissioner Cozad, Mr. Ogle stated the Site Plan Review has been provided. and if there are changes it will be addressed through a future Site Plan Review. David Skarka, Attorney, represented the applicant and stated the manager of Coastal Chemical. Robert Corbridge is available if needed and he began with a PowerPoint Presentation to introduce the Change of Zone. Mr. Skarka pointed out other industrial sites in the immediate area and the arterial roadways to support industrial uses. He stated the Change of Zone is compatible with surrounding land use areas and there have been no objections to the application and furthermore. the neighbors have signed the consent to use the access. Mr. Skarka stated the Site Plan Review application. SPR16-0006, has been submitted in conjunction with the COZ. t= No public testimony was offered concerning this matter. P In response to Chair Freeman, Mr. Skarka indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. a Commissioner Cozad moved to approve the request of Coastal Chemical CO. LLC, for a Change of Zone. COZ16-0002. from the C-1 (Neighborhood Commercial) Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of Planning staff and the Planning Commission. with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Moreno. Commissioner Cozad stated her decision to approve this application was easy because it meets the criteria of the code and is compatible with the surrounding area. Commissioner Moreno supports the decision and concurred with the comments of Commissioner Cozad.
