RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR16-0021, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING
AN OIL AND GAS STORAGE FACILITY (CRUDE OIL TANK FARM AND TRUCK
UNLOADING FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - TALLGRASS
TERMINALS, LLC
A public hearing was conducted on September 7, 2016. at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 22. 2016, and duly published
July 27, 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of
Tallgrass Terminals, LLC. for a Site Specific Development Plan and Use by Special Review
Permit. USR16-0021, for a Mineral Resource Development Facility. including an Oil and Gas
Storage Facility (crude oil tank farm and truck unloading facility) in the A (Agricultural) Zone
District. Bob Choate, Assistant County Attorney, made this a matter of record.
2 Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal to include hours of operation and daily round trips based on each phase of completion.
He reviewed the location in relation to relevant County roads, nearest residence and surrounding
property uses and stated the site is not located in the three (3) mile referral area of any
municipality. Mr. Gathman stated 13 referrals were sent out and seven (7) responses were
received. He displayed images of the site and entered the favorable recommendation of the
Planning Commission into the record as written.
Evan Pinkham, Department of Public Works representative, provided a brief overview of the
transportation plans and requirements. He stated access to the site is off of County Road (CR) 89
Mr. Pinkham provided the average daily traffic counts for CR 89. truck traffic percentages, and
reviewed the traffic narrative and proposed number of daily round trips. He stated tracking control
and an Improvements Agreement are required.

Hayley Brown, Planning Services Engineer representative. presented the drainage and
grading requirements within the Conditions of Approval and Development Standards.
al Ben Frissell. Department of Public Health and Environment. reviewed the water and sewer
provisions and stated at full buildout the applicant is proposing six (6) on -site employees. He
clarified that water will be provided by a commercial well and the applicant is proposing to install
a commercial septic system. Mr. Frissell stated Development Standards (DS) #7-21 address
Environmental Health items.
Cody Wagoner, applicant, reminded the Board that an identical facility was constructed and
placed in service approximately a month ago which is a delivery point to the existing Pony Express
Pipeline. He clarified that this pipeline gathers crude from Weld County and delivers it to Market
in Cushing, Oklahoma Mr. Wagoner stated the project before the Board today provides another
delivery point for truck traffic and another production area and will eventually require an extension
of pipeline under a separate application.

a. In response to Chair Freeman. Mr. Wagoner indicated no concerns with the Conditions of
Approval and Development Standards, as amended.
In response to Chair Freeman, Mr. Wagoner indicated he has reviewed, and agrees to abide
by, the Conditions of Approval and Development Standards.
Commissioner Kirkmeyer moved to approve the request of Tallgrass Terminals. LLC, for a
Site Specific Development Plan and Use by Special Review Permit. USR16-0021. for a Mineral
Resource Development Facility. including an Oil and Gas Storage Facility (crude oil tank farm
and truck unloading facility) in the A (Agricultural) Zone District, based on the recommendations
of Planning staff and the Planning Commission. with the Conditions of Approval and Development
Standards as entered into the record. The motion was seconded by Commissioner Conway, and
it carried unanimously. There being no further discussion. the hearing was completed at
10:14 a.m.
