WHEREAS, a public hearing was held on March 16 , 1977 in the Chambers of the Board of County Commissioners of Weld County, Colorado for the purpose of hearing the petition of the Town of Keenesburg, c/o Hugh Denton, Mayor, Town Hall, Keenesburg, Colorado 80643 , requesting a Special Use Permit and Certificate of Designation fora sanitary landfill in a part of the Northeast Quarter of Section 14, Township 2 North, Range 64 West of the 6th P.M. , Weld County, Colorado, more particularly described as follows: Beginning at the Northeast corner said Section 14; thence S00°00 ' 00" W on an assumed bearing along the East line said Section 14 a distance of 350. 20 feet; thence N89°34 ' 50" W parallel with the North line said Section 14 a distance of 490. 47 feet; thence N00°00 ' 00" E a distance of 350. 20 feet to a point on the North line said Section 14 ; thence S89°40 ' 50" E along said North line a dis- tance of 490. 47 feet to a point of beginning. WHEREAS, petitioner was present, and WHEREAS, Section 30-20-101, et seq. , CRS 1973, as amended, requires that a Certificate of Designation for Solid Waste Disposal Site be signed by the Chairman of the Board of County Commissioners of Weld County, Colorado, the original of which is attached hereto and incorporated herein by reference, and WHEREAS , the Board of County Commissioners has considered all the testimony and statements of those present, and has studied the request of the petitioner and has studied the recommendations of the Weld County Planning Commission, and having been fully in- formed and satisfied that the requested use complies with the Weld County Comprehensive Plan, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the Town of Keenesburg for a sanitary landfill near Keenesburg, Colorado, be and hereby is granted subject to the Development Standards contained in the Special Use Permit. NE* of Sec. 14, T2N, R64W REQUEST: Sanitary Landfill _ Certificate of Designation NAME: Town of Keenesburg THE WELD COUNTY PLANNING COMMISSION STAFF RECOMMENDS THAT THIS REQUEST BE Approved FOR THE FOLLOWING REASONS: 1 . The location of the sanitary landfill complies with the Weld County Comprehensive Plan. Said plan states : "In order to promote the agricultural economy and to enhance and maintain the quality of life and environment in Weld County, developments that utilize non-pro- ductive rural land and water surpluses will be encouraged, particularly where productive irrigated farmland can be preserved as agricultural greenbelts and open space. " The proposed location complies with the Comprehensive Plan since the site is on non-productive agricultural land (Class VI non-irrigated soils) and water service is not needed at the landfill site. 2. It is the opinion of the Planning Commission staff that this proposed facility is in compliance with the provisions of Section 3. 3(E) (2) of the Weld County Zoning Resolution which states, "The Planning Commission and the Board of County Commissioners shall consider the following in making their determination in approving or denying a special use permit : Compatibility with the surrounding area, harmony with the character of the neighborhood and existing agricultural uses, need for the proposed use, its effect upon the immediate area, its effect on future development of the area and the health, safety and welfare of the inhabitants of the area and the County. " This determination is based on the following: A. The sanitary landfill will be compatible with the surrounding land uses which are non-irrigated farmland and a junk yard. B. The Colo. Dept . of Health has indicated, "This site can be operated in accordance with minimum standards and department regulations, and is eligible for designation by the Weld County Board of County Commissioners. The Weld County Health Department has recommended approval of this SUP and this application for certification of designation indicating the pro- posal complies with all applicable Weld County and State Health Standards and Regulations. D. The Weld County Engineering Department has indicated they could not identify any engineering problems with the proposal. E. The Colorado Geological Survey has indicated they could not identify any serious problems involved with the ground-water regime, geologic hazards, or mineral resources. Comments : * It should be pointed out that Daryl Arnold, a surrounding property owner who resides adjacent to County Road 59 which is the access road to the landfill site, has indicated that dust as a result of the increased traffic associated with the sanitary landfill is a problem. Mr. Arnold would like to have some form of dust abatement measure implemented on County Road 59 especially in the vicinity of the existing residences. * The response from Dr. Jeris Dainelson, Duputy State Engineer with the Division of Water Resources indicated, "it appears that the potential exists for contamination of shallow ground water in the area. This is due to the shallow water table and the fact that surface run- off apparently will enter the pit . While this may not pose any problems, it should be investigated further before approval is granted. The County Attorney has given this office an opinion regarding the application , as submitted. The opinion stated that Weld County has an exclusive contract with Weld County Landfills, Inc. to operate any and all landfills in the County except those operated by and exclusively for an incorporated municipality. The opinion also indicated that the Special Use Permit would require application by the Town of Keenesburg and be for the exclusive use of the Town of Keenesburg and its residents. The Planning Commission will withdraw the application from the agenda at this time. This office will retain the file pending communication with you and the Town of Keenesburg. Gray Keenesburg, CO 80643 Dear Mr. Gray: Your request for a Special Use Permit to operate a sanitary land fill in part of the NEq of Section 14, Township 2 North, Range 64 West of the 6th P.M. will be on the December 16, 1975, Planning Commission agenda if the following information is received by this office within ten (10) days. A more complete plot plan is necessary before your request can be evaluated. Exact locations of proposed and existing county road access points need to be identified. Also, those portions of the property that are to be filled and those that will provide the cover material need to be included on the plan. An eight foot fence is shown on three sides of the use area. How- ever, the east side should also be fenced to insure that the pre- vailing winds do not blow any debris off the property. Additionally, the type of fence to be built should be specified. You need to indicate the approximate hours of operation for the land fill . Who will use the land fill ? the residents of Keenesburg or anyone in that part of the county? Lastly, the type and approximate numbers of vehicles that would be using the county road and the land fill should be supplied. Upon review of the above stated case by myself and discussion with Tom - Honn, Zoning Administrator, on this case, our office needs to be furnished • with the following: • (1 ) The application for the Special Use Permit for the sanitary landfill • must he signed by the Town of Keenesburg or our office needs a letter from the Town of Keenesburq specifically authorizing you, Carlos. . k ,Q gray, to act as authorized agent to make the application for' the c�` Special Use Permit; authorizing you, Carlos Gray, to represent the X166 Town of Keenesburg; and to authorize you, Carlos Gray, to operate the sanitary landfill for the Town of Keenesburg; . (2) Our office needs definite proof that the Town of Keenesburq is involved . with the sanitary landfill . Specifically, we need a copy of the i!it,c'd agreement between the Town of Keenesburq and yourself, Carlos • Gray, or a letter from the Town of Keenesburg stating there is such lit% an agreement. Essentially, we need to know how the Town of Keenes- . burg will be associated with the sanitary landfill . Is there a rental agreement, a lease, or what? ;(3) Our office needs a detailed management program for the sanitary land- fill due to a response we received from Bill Colgate, District Con servationist, Soil Conservation Service, Box 487, Brighton. The • referral stated, "The main problem of this area will be the danger . of blowing soil if the land is disturbed or left hare. This soil will be very difficult to keep from blowing, and if it once starts . blowing it will be very difficult to stop. " Specifically, we need to know the material which will be used for cover, the method of accomplishing this, and the type of reseeding or revegetation of the covered area. I would recommend consulting with Bill Colgate of the • Soil Conservation Service in Brighton for assistance with the development of the management program. • '(4) ) Our office needs to be supplied with the information required in 6. 1 (8) of the Weld County Zoning Resolution. Said section states: • Carlos Gray January 15, 1976 Page 2 "Sanitary Land Fill (Solid Waste Disposal Sites) - Appli- cants for Certificates of Designation for solid waste disposal sites shall supply copies of the information supplied to the State Health Department as required by "Solid Waste Disposal Sites and Facilities" Chapter 35, Article 23 - C.R.S. 1963 (Volume II) amended 1971 by Senate Bill 132, effective date July 1 , 1971 . (Rev. 12/26/73)" (5) The letter from yourself, Carlos Gray, dated November 25, 1975, needs g 8A to be changed to the extent that the item concerning who will use the landfill is restricted to the residents of the Town of Keenes- ���p0�� burg. Additionally, our staff' s recommendation to the Weld County Planning Commission will include development standards for the sanitary landfill . These standards are developed from the materials submitted in the application by yourself and from recommendations from referral agencies. A preliminary draft of these development standards is as follows: (1 ) An eight-foot fence of poultry netting or woven wire shall be erected on all sides of the sanitary landfill ; (2) The hours of operation of the sanitary landfill shall be limited to the days of Wednesday and Saturday between the hours of 8:00 A. M. to 6:00 P. M. ; (3) The use of the sanitary landfill shall be restricted to the residents of the Town of Keenesburq; (4) The management program developed for the sanitary landfill shall be adhered to and is subject to inspections by the Soil Conservation Service. In the event the management program is not adhered to, the operation shall be shut down at the recommendation of the Soil Conservation Service until such time as the situation is corrected; (5) There shall be an attendant on duty during operational hours; (6) The sanitary landfill operation shall be in compliance with all aplicable Health Standards and Regulations affecting such an enter- prise. The field investigation was done by James Faulhaber on June 2 , 1976. The attached report was prepared under my direction in an effort to answer questions pertaining to Section 4 , Engineering Report Design Criteria of the Colorado Department of Health ' s Solid Wastes Disposal Sites and Facilities Regulations. The report outline follows the lettered paragraphs as found in Section 4. As you know the site has already been constructed and is in use. This report relates to existing conditions and does not outline design criteria. Where no information is available it has been indicated by that paragraph letter. Drew Scheltinga .\ Civil Engineer mfm Engineering Report on Design Criteria Section 4 of the Solid Wastes Disposal Sites and Facilities Regulations A. The solid waste disposal facility presently has ponded water in it . However , since the facility is sloped to the east the water is ponded away from the actual solid waste disposal area. As indicated by terrain and features , it is my opinion that surface water can and does flow into the facility. The surrounding area is not designed to deflect the runoff of rain or melting snow. According to Virgil Orr , the Keenesburg Director of Public Works , ground water lies between 1 ' to 2 ' beneath the present floor of the facility. B. As indicated by Mr. Orr , there is only one well within a 1000 ' radius of the waste disposal site. It is located approximately 700 ' south of the facility. No data is available on the actual soil characteristics . From my observations , the cover soil is a sandy clay which should have enough adhesive characteristics to permit a workable earth cover. C. The solid waste disposal facility is located approximately 3 miles from the Generation Center and I feel can be termed convenient . D. The access road from the Generation Center to the site varies from a 22' asphalt pavement to a 14' dirt road , the major portion of which is a 24 ' gravel road. The traffic flow inside the site itself could be termed adequate due to the probable low amount of traffic. E. To prevent the emergence or attraction of insects or rodents the refuse which has been deposited during operating hours is promptly covered thereafter. F. No information available on this item. G. There is an 8 ' high chain link type fence located on the east side of the site which helps in containing wind blown debris . Mr. Orr has indicated to me that debris of this sort is not a problem. H. There is no recycling operation. I . There is no on site equipment specifically designed for fire prevention . As used in this part 1, unless the context otherwise requires: (1) "Approved site or facility" means a site or facility for which a certificate of designation has been obtained, as provided in this part 1. (2) "Department" means the department of health. (3) "Person" means an individual, partnership, private or municipal corporation, firm or other association of persons. (4) "Recyclable materials" means a type of material that is subject to reuse or recycling. (5) "Recycling operation" means that part of a solid wastes disposal facility or a part of a general disposal facility at which recyclable materials may be separated from other materials for further processing. (6) "Solid Wastes" means garbage, refuse, sludge of sewage disposal plants, and other discarded solid materials, including solid waste materials resulting from industrial, commercial, and community activities but does not include agricultural wastes. (7) "Solid Wastes disposal" means the collection, storage, treatment, utilization, processing, or final disposal of solid wastes. (8) "Solid wastes disposal site and facility" means the location and facility at which the deposit and final treatment of solid wastes occur. (9) "Transfer station" means a facility at which refuse, awaiting transportation to a disposal site, is transferred from one type of collection vehicle and placed into another. (1) o11u wastes liisposat blues ana raCilltleS Title - 30 Article D Part - 1 30-20-102. UNLAWFUL TO OPERATE SITE AND FACILITY WITHOUT CERTIFICATE OF DESIGNATION. (1) Except as provided in subsection (2) of this section, it is unlawful for any person to operate a solid wastes disposal site and facility in the unincorporated portion of any county without first having obtained therefor a certificate of designation from the board of county commissioners of the county in which such site and facility is located. (2) Any site and facility for the disposal of mill tailings, metallurgical slag, mining wastes, junk automobiles or parts thereof, or suspended solids collected, treated, or disposed of within a sanitary sewer system in operation immediately prior to July 1, 1971, shall have until July 1, 1972, to comply with the provisions of this part 1 and the rules and regulations adopted by the department. (3) The final use for beneficial purposes, including fertilizer, soil conditioner, fuel, and livestock feed, of sludge which has been processed and certified or designated as meeting all applicable regulations of the department and the department of agriculture shall not require a certificate of designation for such final use. 30-20-103. APPLICATION FOR CERTIFICATE. Any person desiring to operate a solid wastes disposal site and facility within the unincorporated portion of any county shall make application to the board of county commissioners of the county in which such site and facility is or is proposed to be located for a certificate of designation. Such application shall be accompanied by a fee of twenty-five dollars which shall not be refundable, and it shall set forth the location of the site and facility; the type of site and facility; the type of processing to be used, such as sanitary landfill, composting, or incineration; the hours of operation; the method of supervision; the rates to be charged, if any; and such other information as may be required by the board of county commissioners. The application shall also contain such engineer- ing, geological, hydrological, and operational data as may be required by the department by regulation. The application shall be referred to the department for review and for recommendation as to approval or disapproval, which shall be based upon criteria established by the state board of health, the water quality control commission, and the air pollution control commission. 30-20-104. FACTORS TO BE CONSIDERED. (1) In considering an application for a certificate of designation, the board of county commissioners shall take into account: (a) The effect that the solid wastes disposal site and facility will have on the surrounding property, taking into consideration the types of processing to be used, surrounding property uses and values, and wind and climatic conditions; (b) The convenience and accessibility of the solid wastes disposal site and facility to potential users; (c) The ability of the applicant to comply with the health standards and operating procedures provided for in this part 1 and such rules and regu- lations as may be prescribed by the department; (2) Solid Wastes Dsiposa Ltes and Facilities Title - 30 Article 20 - Part - 1 (d) Recommendations by local health departments. (2) Except as provided in this part 1, designation of approved solid wastes disposal sites and facilities shall be discretionary with the board of county commissioners, subject to judicial review by the district court of appropriate jurisdiction. (3) Prior to the issuance of a certificate of designation, the board of county commissioners shall require that the report which shall be submitted by the applicant under section 30-20-103 be reviewed and a recommendation as to approval or disapproval made by the department and shall be satisfied that the proposed solid wastes disposal site and facility conforms to the compre- hensive county land use plan, if any. The application, report of the department, comprehensive land use plan, and other pertinent information shall be presented to the board of county commissioners at a public hearing to be held after notice. Such notice shall contain the time and place of the hearing and shall state that the matter to be considered is the applicant's proposal for a solid waste disposal site and facility. The notice shall be published in a newspaper having general circulation in the county in which the proposed solid wastes disposal site and facility is located at least ten but nor more than thirty days prior to the date of the hearing. 30-20-105. CERTIFICATE. If the board of county commissioners deems that a certificate of designation should be granted to the applicant, it shall issue the certificate, and such certificate shall be displayed in a prominent place at the site and facility. The board of county commissioners shall not issue a certificate of designation if the department has recommended disapproval pursuant to section 30-20-103. 30-20-106. PRIVATE DISPOSAL PROHIBITED - WHEN. No private dumping of solid wastes shall be made on any property within the unincorporated portion of any county except on or at an approved site and facility; but private dumping of one's own solid wastes on one's own property shall not be subject to the provisions of this part 1 as long as it does not constitute a public nuisance endangering the health, safety, and welfare of others and as long as such dumping is in accordance with the rules and regulations of the department. 30-20-107. DESIGNATION OF EXCLUSIVE SITES AND FACILITIES. The governing body of any city, city and county, or incorporated town may by ordinance designate and approve one or more solid wastes disposal sites and facilities, either within or without its corporate limits, if designated and approved by the board of county commissioners, as its exclusive solid wastes disposal site and facility or sites and facilities, and thereafter each such site and facility shall be used by such city, city and county, or town for the disposal of its solid wastes; but, prior to any such designation and approval, such governing body shall hold a public hearing to review the disposal method to be used and the fees to be charged, if any. -3- Solid Wasted Disposal Sites and Facilities Title - 30 Article Part 1 30-20-108. CONTRACTS WITH GOVERNMENTAL UNITS AUTHORIZED. (1) An approved solid wastes disposal site and facility may be operated by any person pursuant to contract with any governmental unit. (2) Any city, city and county, county, or incorporated town acting by itself or in association with any other such governmental unit may establish and operate an approved site and facility under such terms and conditions as may be approved by the governing bodies of the governmental units involved. In the event such site and facility is not operated by the governmental unit involved, any contract to operate such a site and facility shall be awarded on a competitive bid basis if there is more than one applicant for a contract to operate such site and facility. (3) Any city, city and county, county, or incorporated town acting by itself or in association with any other such governmental unit may acquire by condemnation such site as are needed for trash disposal purposes. 30-20-109. DEPARTMENT TO PROMULGATE RULES AND REGULATIONS. (1) The department shall promulgate rules and regulations for the engineering design and operation of solid wastes disposal sites and facilities, which may include: (a) The establishment of engineering design criteria applicable, but not limited, to protection of surface and subsurface waters, suitable soil characteristics, distance from solid wastes generation centers, access routes, distances from water wells, disposal facility on-site traffic control patterns, insect and rodent control, methods of solid wastes compaction in the disposal fill, confinement of windblown debris, recycling operations, fire prevention, and final closure of the compacted fill; (b) The establishment of criteria for solid wastes disposal sites and facilities which will place into operation the engineering design for such disposal sites and facilities. 30-20-110. MINIMUM STANDARDS. (1) The rules and regulations promul- gated by the department shall, subject to the provisions of section 30-20-106, contain the following minimum standards: (a) Such sites and facilities shall be located, operated, and maintained in a manner so as to control obnoxious odors and prevent rodent and insect breeding and infestation, and they shall be kept adequately covered during their use. (b) Such sites and facilities shall comply with the health laws, standards, rules, and regulations of the department, the water quality control commission, and all applicable zoning laws and ordinances. (c) No radioactive materials or materials contaminated by radioactive substances shall be disposed of in sites or facilities not specifically designated for that purpose. (d) A site and facility operated as a sanitary landfill shall provide means of finally disposing of solid wastes on land in a manner to minimize nuisance conditions such' as odors, windblown debris, insects, rodent, and smoke; and shall provide compacted fill material; shall provide adequate (4) s � Solid Wastes DispoE Sites and Facilities Title - 30 Article _0 Part 1 cover with suitable material and surface drainage designed to prevent ponding and water and wind erosion and prevent water and air pollution; and, upon being filled, shall be left in a condition of orderliness and good esthetic appearance and capable of blending with the surrounding area. In the operation of such a site and facility, the solid wastes shall be distributed in the smallest area consistent with handling traffic to be unloaded; shall be placed in the most dense volume practicable using moisture and compaction or other method approved by the department; shall be fire, insect,and rodent resistant through the application of an adequate layer of inert material at regular intervals; and shall have a minimum of windblown debris which shall be collected regularly and placed into the fill. (e) Sites and facilities shall be adequately fenced so as to prevent waste material and debris from escaping therefrom, and material and debris shall not be allowed to accumulate along the fence line. (f) Solid wastes deposited at any site or facility shall not be burned, except that, in extreme emergencies resulting in the generation of large quantities of combustible materials, authorization for burning under controlled conditions may be given by the department. 30-20-111. DEPARTMENTS TO RENDER ASSISTANCE. The department and local health departments shall render technical advice and services to owners and operators of solid wastes disposal sites and facilities and to municipalities and counties in order to assure that appropriate measures are being taken to protect the public health, safety, and welfare. In addition, the department has the duty to coordinate the solid wastes program under this part 1 with all other programs within the department and with the other agencies of state and local government which are concerned with solid wastes disposal. 30-20-112. REVOCATION OF CERTIFICATE. The board of county commissioners, after reasonable notice and public hearing, shall temporarily suspend or revoke a certificate of designation that has been granted by it for failure of a site and facility to comply with all applicable laws, resolutions, and ordinances or to comply with the provisions of this part 1 or any rule or regulation adopted pursuant thereto. 30-20-113. FACILITIES DEEMED PUBLIC NUISANCE - WHEN. Any solid wastes disposal site and facility found to be abandoned or that is operated or main- tained in a manner so as to violate any of the provisions of this part 1 or any rule or regulation adopted pursuant thereto shall be deemed a public nuisance, and such violation may be enjoined by a district court of competent jurisdiction in an action brought by the department, the board of county commissioners of the county wherein the violation occurred, or the governing body of the municipality wherein the violation occurred. 30-20-114. VIOLATION - PENALTY. Any person who violates any provision of this part 1 is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of one hundred dollars, or by imprisonment in the county jail for not more than thirty days, or by both such fine and imprison- ment. Nothing in this part 1 shall preclude or preempt a city, a city and county, or an incorporated town from enforcement of its local ordinances. Each day of violation shall be deemed a separate offense under this section. (5) Solid Wastes Disposal Sites and Facilities . , Title - 30 Article • p Part 1 30-20-115. COUNTY SOLID WASTES DISPOSAL SITE AND FACILITY FUND - TAX. Any county is authorized to establish a county solid wastes disposal site and facility fund. The board of county commissioners of such county may levy a solid wastes disposal site and facility tax, in addition to any other tax authorized by law, on any of the taxable property within said county, the proceeds of which shall be deposited to the credit of said fund and appropriated to pay the cost of land, labor, equipment, and services needed in the operation of solid wastes disposal sites and facilities. Any county is also authorized, after a public hearing,to fix, modify, and collect service charges from users of solid wastes disposal sites and facilities for the purpose of financing the operations at those sites and facilities. (6) COLORADO DEPARTMENT OF HEALTH 4210 E. 11th Avenue Denver, CO 80220 REGULATIONS: SOLID WASTES DISPOSAL SITES AND FACILITIES AUTHORITY: Chapter 36, Article 23, CRS 1963 (1967 Perm. Cum. Supp.) as amended by Chapter 103, Colorado Session Laws 1971. The following regulations were adopted by The Colorado State Board of Health pursuant to Colorado Revised Statutes 1963, Section 3-16-2 as amended, and Chapter 36, Article 23, CRS 1963 (1967 Perm. Cum. Supp. as amended by Chapter 103, Colorado Session Laws 1971, for the designation, operation, maintenance, and design of Solid Waste Disposal Sites and Facilities. Adopted February 16, 1972 Effective Date April 1, 1972 Section 1. SCOPE These regulations shall be applicable to all solid waste disposal sites and facilities, whether designated by ordinance within the corporate limits of any city, city and county, or incorporated town or by the Board of County Commissioners in unincorporated areas. Section 2. DEFINITIONS (1) The following definitions extracted from Section 36-23-1, CRS 1963, as amended, shall apply when appearing in these regulations: a. "Solid waste" means garbage, refuse, sludge of sewage disposal plants, and other discarded solid materials, including solid waste materials resulting from industrial, commercial and from community activities, but shall not include agricultural waste. b. "Department" means the Department of Health, c. "Approved site or facility" means a site or facility for which a "Certificate of Designation" has been obtained, as provided -1- -2- in this act . d. "Person" means an individual, partnership, private or municipal corporation, firm, or other association of persons. e. "Solid waste disposal" means the collection, storage, treatment, utilization, processing, or final disposal of solid wastes. f. "Solid waste disposal site and facility" means the location and facility at which the deposit and final treatment of solid wastes occur. g. "Transfer station" means a facility at which refuse, awaiting transportation to a disposal site, as transferred from one type of collection vehicle and placed into another. h. "Recyclable materials" means a type of material that is subject to reuse or recycling. i. "Recycling operation" means that part of a solid waste disposal facility or a part of a general disposal facility at which recyclable materials may be separated from other materials for future processing. Definitions. (2) Jther terms used in the statute or regulations are defined as follows: • a. "Certificate of Designation" means a document issued under authority of the Board of County Commissioners to a person operating a solid waste disposal site and facility of a certain type and at a certain location. b. "Mill-tailings"are that refuse material resulting from the processing of ore in a mill. c. "Metallurgical slag" is the cinder or dross waste product resulting in the refining of metal bearing ores. • -3- • d. "Mining wastes" are either mill-tailings or metallurgical slag or both. e. A "junk automobile" is defined to be the hulk or body of' a motor vehicle essentially suitable only for one use as scrap metal. Junk automobile parts constitute the normally recyclable materials obtainable from a motor vehicle. f. . "Suspended solids" are finely divided mineral and organic sub- stances contained in the sewage existing in a sewage system. g. "Engineering data" shall mean information describing the area of disposal sites in acres, a description of the access roads and roads within the site, a description of fencing enclosing the disposal site, and overall plan listing the method or methods by which the disposal site will be filled with refuse and the use to which it will be placed once the site is filled and closed. h. "Geological data" shall mean classes of soil to a reasonable depth from the ground surface, the location and thickness of the significant soil classifications throughout the area of the site and to extend some distance beyond the boundaries of the site, to include information on ground water elevations , seepage quantities and water wells 1,000 feet beyond the boundary of the disposal site. i. "Hydrological data" shall include average, maximum, and minimum amounts of precipitation for each month of the year, surface drainage facilities, streams and lakes adjacent to the disposal site, irrigation water ditches adjacent to the site, wells, streams and lakes . j . "Operational data" shall include a plan for overall supervision of the disposal site to include supervisory personnel and Labor 4- personnel, equipment and machinery consisting of all items needed for satisfactory landfill operation, traffic control, fire control, cover material, working face, moisture content, compaction control, and rodent and insect control . k. "Sanitary landfill" is the final disposal of solid waste on the land by a method employing compaction of the refuse and covering with earth or other inert material. 1. A "composting plant" is a solid waste disposal facility utilizing biochemical degradation to change decomposable portions of solid waste to a humus-like material. m. "Incineration" is the controlled combustion of solid, liquid or gaseous waste changing them to gases and to a residue containing little combustible material. n. "Hazardous material and toxic substances" are liquid or solids which can be dangerous to man, animal and plantlife unless properly neutralized. o. "Minimum Standards" (See Section 3) shall mean the requirements which shall be applied to all solid waste disposal sites and facilities . • p. "Engineering Report Design Criteria" (See Section 4) shall mean the minimum requirements which shall be applied to new facilities proposed for designation as a solid waste disposal site and facility. Section 3. MINIMUM STANDARDS (1) (a) the following minimum standards are hereby adopted and incorporated herein as directed by Section 36-23-10 CRS 1963, as amended: (b) Such site and facilities shall be located, operated, and main- -5- tained in a manner so as to control obnoxious odors, prevent rodent and insect breeding and infestation, and shall be kept adequately covered during their use. (c) Such sites and facilities shall comply with the health laws, standards, rules and regulations of the Department, the Air Pollution Control Commission, the Water Pollution Control Commission, and all applicable zoning laws and ordinances . (d) No radioactive materials or materials contaminated by radio- active substances shall be disposed of in sites or facilities not speci- fically designated for that purpose. (e) A site and facility operated as a sanitary landfill shall provide means of finally disposing of solid wastes on land in a manner to minimize nusiance conditions such as odors, windblown debris, insects, rodents, smoke, and shall provide compacted fill material, adequate cover with suit- able material and surface drainage designed to prevent ponding and water and wind erosion; prevent water and air pollution and, upon being filled, shall be left in a condition of orderliness, good esthetic appearance and capable of blending with the surrounding area. Section 4 . ENGINEERING REPORT DESIGN CRITERIA a. The design of a solid waste disposal facility hereinafter designated shall be such as to protect surface and subsurface waters from contamination. Surface water from outside the immediate working area of the disposal site shall not be allowed to flow into or through the active disposal area. The design shall provide for the deflection of rain or melting snow away from the active area where wastes are being deposited. As filling continues to completion, the surface shall be sloped so that water is diverted away from the area where refuse has been or is being deposited. The design shall include methods of keeping ground water out of the area where refuse is deposited. b . The site shall be designed to protect the quality of water available in nearby wells. The necessary distance from the wells is dependent in part on the direction of flow of ground under the site and the means used in the design to prevent precipitation falling on the site from reaching the aquifier in question. Soil characteristics . The soil used for covering of landfill type operations shall have enough adhesive character- istics to permit a workable earth cover. c. The location of the solid waste site and facility should provide for convenient access from solid waste generation centers . 1 -7- d. The access routes shall be designed so as to permit the orderly and efficient flow of traffic to and from the site as well as on the site. Traffic control routes on the site shall permit orderly, efficient and safe ingress, unloading and egress . e. The design of the facility shall provide for effective compaction and cover of refuse materials in such a program as will prevent 7 the emergence or attraction of insects and rodents . f. Solid wastes deposited at disposal sites and facilities shall be compacted to prior to covering. Use of moisture or change of particle size to aid in compaction is recommended. g. The design shall contemplate the location and construction of the disposal site and facility in such a manner as will eliminate the scattering of windblown debris. All solid wastes discharged at the site shall be confined to the site and any material escaping from the active discharge area shall be promptly retrieved and placed in the active discharge area. h. Recycling operations may be designed to operate at solid waste disposal sites and facilities, provided such recycling operations do not interfere with the disposal of other wastes and provided that such recycle operations are carried out without creation of a nusiance and rodent and insect breeding. i. The design shall include such equipment and operational methods to prevent the burning of solid wastes at the site and to extinguish any fires . 1 -S- j . Final Closure. Prior to closing a solid waste disposal site except for cause as set forth in Section 36-23-13 CRS as amended, the final cover of the deposited solid wastes shall be graded to the elevations which shall be shown in the initial design. The cover shall be of such thickness and material as will prevent the entrance or emergence of insects, rodents, or odors. Such closure elevations shall be such as will provide for the diversion of rainfall and runoff away from the fill area. k. A plan and method for protecting solid wastes disposal sites and facilities against damage from floods shall be a part of the engineering design. Section 5. THE REPORT OF THE DEPARTMENT to County Commissioners or municipal officials, recommending approval or disapproval of the application, shall consist of a written and signed document made in accordance with criteria established by the Board of Health, Water Pollution Control Commission and Air Pollution Control Commission. -)/ Section 6. OPERATION OF A SOLID WASTE DISPOSAL FACILITY An operational plan for placing into operation the engineering design for the disposal site and facility is required. Such a plan shall include the followinr information: a. The name or titles of the person or persons who will be in charge IJI�' 1% ,� I_ of the disposal site and facility . Such name(s) shall be of person(s) having the responsibility for the operation as well as the authority to take all corrective action necessary to comply with the requirements of this Department. b. The fire fighting equipment or department available for extinguishing fires . e . The frequency of cover of the deposited wastes . _ •1 f. The frequency of retrieval of wind blown debris . g. A contingency plan for eradication of rodents and insects . h . Procedures for implementing other aspects of the design. Section 7. -RESTRICTIONS OF OPERATIONS, CLOSING SITES a. In the event a person applying for a Certificate of Designation does not wish to receive at his site all items defined in the statute as solid wastes, his application to the county commissioners for approval of designation shall set forth the limitations as to materials to be accepted at the site. If such site is thereafter designated, the owner shall erect at the entrance to such a site an appropriate design setting forth the items not receivable at such site . b. If a person having a site officially designated wishes to close the site for any reason, he shall inform the county commissioners at least 60 days in advance of such elosing and shall post a sign, readable from the seat of an entering motor vehicle, informing the public of his intent to close such site. Such site shall be considered officially closed upon receipt of an official notice from the county commissioners, provided such closing date shall be at least 60 days after the notice to the county commissioners and the posting as above set forth. Upon closing of the site, the owner shall post a notice that the site is closed -and shall take reasonable precautions to prevent the further use of such site. -10- • Add Section 8. Notification of Violations of an Approved Engineering Design Report (a) Whenever the Department determines that a solid waste disposal site is not being operated substantially in accordance with the criteria provided in the Engineering Design Report or these regulations, the operator shall be informed of the nature of of the alleged violation by certified mail and Within ten days from and after receipt of the letter of citation, he may request a variance from the Engineering Design Report by making written application to the Department stating the grounds for such request . (b) The Department shall either approve such request or schedule the matter for an administrative hearing. If the operator fails to request a variance, or the Department refuses to grant a variance after the hearing, the operator shall be deemed to be in violation of the law and these regulations and the "Certificate of Designation" shall be subject to suspension, revocation or injunction as provided in Sections 36-23-13 and 14, CRS 1963, as amended by Chapter 103, Colorado Session Laws 1971. The Department shall promptly report the action taken to the Board of County Commissioners. (c) Any person aggrieved by the decision of the Department may request a hearing before the State Board of Health and shall be afforded his right to judicial review as provided in Section 66-1-13, Colorado Revised Statutes 1963. This should cut the force of the prevailing winds down considerable. When areas have been filled with trash they should be backfilled with 2 foot of soil with at least 6" of top soil if possible. If a large area has been backfilled, the soil should be stabilized from blowing with straw that has been disced in, or manure, or some other type of mulch to protect the surface. After the landfill has been completely utilized, a grass seeding program should be carried out over all of the disturbed area, or depending on the future use of the land, perhaps a tree windbreak or wildlife planting. ;. The Lessor hereby leases to the Town all those certain tracts or parcels of land in the NE4 Sec. 14, T. 2 N. , R. 64 W. , Weld County, Colorado, in order that the Town may construct and operate a sanitary landfill on the premises. To hold the same to the Town for as long as may be needed from the 3rd day of March, 1976, paying therefor the yearly rent of $600. 00, payable in equal installments on the 1st day of each month, the first of such pay- ments to be made on the 1st day of April next. 2. The Town hereby agrees : (a) To pay the rent on the days and in the manner_ afore- said. (b) Not to use the said land except as a landfill, and not, at any time, to erect thereon any buildings except that it may, at its own cost, erect such buildings as may be necessary to operate the landfill and, if deemed appropriate by the Trustees, to house vehicles and equipment. (c) The Town will not, without the permission in writing of the Lessor, take off of the said land any sand, gravel, soil or minerals of any kind. At or before the end of the term the Town will cover any exposed fill needed to be covered. (d) Salvage rights are the property of the Lessee . Lessee, its agents, employees, assigns or beneficiaries, may lease, sell, or otherwise dispose of or utilize such rights without interference from, or obligation, to, the Lessor . (e) At the end or sooner termination of the said term Town will peaceably deliver up the land to the Lessor. 4( r 3. Lessor' s Covenants. The Lessor agrees : (a) That the Town, paying the rent and performing the covenants herein contained, shall peaceably and quietly enjoy the said land, and shall not be disturbed by any act of the Lessor or any person claiming under him. (b) Lessor will permit the Town, for the proper laying out, maintaining and operating of the landfill, to dig and move dirt, ' to soil cover or dig any bushes upon the said land, and to commit any acts of waste thereon not expressly excluded by the covenants contained herein. (c) That at all times before the expiration of the term Lessor will permit the Town to remove any sheds, buildings , and any posts, fences , gates and other fixtures placed by the Town on the said land. 4. If the Town shall commit or allow to be committed any breach of any of the covenants, or if the rent thereof shall remain unpaid for 60 days after the same shall become due, it shall be law- ful in any such case for the Lessor to re-enter upon the said land, and thereupon the term shall be terminated. 5. The Lessor shall be free from all liabilities and claims for damages and/or suits for or by reason of any injury or injuries to any person or persons or property of any kind whatsoever, whether to the person or property of Lessee, its agents or employees, or third persons, from any cause or causes whatsoever while in or upon said premises or any part thereof during the term of this agreement or occasioned by any occupancy or use of said premises or any activity carried on by Lessee in connection therewith, and Lessee hereby cove- nants and agrees to indemnify and save harmless the Lessor from all liabilities, charges, expenses (including counsel fees) and costs of account of or by reason of any such injuries, liabilities , claims, suits or losses however occurring or damages growing out of same. -2- I 6. In case the whole of said premises shall be taken by right of eminent domain or other authority of law during the continuance of this lease and any extension thereof, this lease shall terminate. 7 . It is agreed that the Lessor is not a partner of the Lessee and that the parties are not engaged in a partnership or joint ven- ture and each party is hereby excluded from any liability for debts or liabilities of the other. 8. The Lessee shall have the right any time to sublet the leased premises or any part thereof or to assign this lease, but no such subletting or assignment shall relieve the Lessee of any of its obligations hereunder, and any assignee of this lease shall expressly assume, and by reason of such assignment shall be considered as hav- ing assumed and become bound by all of the Lessee ' s obligations hereunder. Any assignees shall take the lease and the assignment subject to all prior breaches of the Lessee 's covenants herein and shall be liable therefor in the same manner as the Lessee or prior ' assignee responsible therefor. 9. If, during the term of this lease, or any renewal thereof, the use of the said premises for a landfill be prevented, suspended or limited by any zoning statute, or ordinance, or municipal or county or governmental action or law, or regulation; then Lessee may cancel this lease by giving thirty (30) days ' written notice to Lessor. 10. Services. The Contractor agrees to perform for the town - in a good and workmanlike manner the following specific services: Supervise and operate a sanitary landfill, collect and haul trash from the Town to the landfill. 2. Compensation. The Town will pay to the Contractor, who will accept in full payment for all service, the following: X50. 00 per month. 3. Term. The term of this agreement shall be for a period commencing March 3, 1976, and shall continue thereafter until termi- nated by either party giving the other party sixty days prior written notice of such termination. 4. Equipment. The Contractor shall furnish all necessary equipment and materials required in performing the said services, except such equipment and materials as may be provided by the Town as set forth in Exhibit A, which is incorporated into this contract by reference. 5 . Hours . The Contractor shall perform the said services during the hours designated by the Town. 6. Contractor' s Duties . The Contractor shall maintain a regu- lar, systematic supervision of the land to the end that the landfill shall be operated so as to comply with Town, State and County statutes, ordinances and regulations in a good and workmanlike manner at all times . The Contractor shall direct such other personnel as tlae Town employs to perform said services; shall secure any and all permits. that may be required in order to perform the services herein contem= plated; shall make all reports and account for and remit any payments to the Town for use of the landfill. j 7 . Release and Indemnity. The Town agrees to assume all risk of loss and to indemnify and hold the Contractor harmless from and against any and all liabilities, demands, claims, suits, losses, damages, causes of action, fines or judgments, including costs, attorney' s and witnesses ' fees, and expenses incident thereto, for injuries to persons (including death) and for loss of, damage to, or destruction of property (including property of the Contractor) arising out of, or in connection with, this agreement unless caused by the gross negligence or willful misconduct of the Contractor, its officers, agents or employees . In the event that any demand or claim is made or suit is commenced against the Contractor, the Con- tractor shall give prompt written notice thereof to Town who shall have the right to compromise or defend the same to the extent of its own interest. 8. Insurance. The Town shall, for the period of this agreement, carry and maintain in full force and effect, liability insurance, property damage, and such other insurance, in such company or companies as are acceptable to the Town, insuring Contractor, while it is per- forming hereunder. The Town shall carry workmen' s compensation and unemployment insurance on the Contractor. 9. Assignment. This agreement shall not be assigned by the Contractor without the prior written consent of the Town. 10. Payment for Services. The Town shall remit to the Contractor within ten days after receipt and approval of the Contractor's invoice for services rendered. 11. This determination is based on the following: A. The sanitary landfill will be compatible with the surrounding land, uses which are non--Irrigated farmland and a junk yard. B. The Colorado Department of Health has indicated, "This rite can be operated in accordancw with minimum standards and department regulation G, trtd is eligible for designation by the Weld County Board of County Ccmiai«sioners." C. The Weld County Health Department has recommended ipproval of this SUP and this application for certification of designation indicating the proposal complies with all applicable Weld County and State Health Standards and Regulations. D. The Weld County Engineering Department has indicated they could not identify any engineering problems with the proposal. E. The Colorado Geological Survey has indicated they could not identify any serious problems *nvolved with the ;round-wager regime, geologic hazards, or mineral resources. Comments: * It should be pointed out that Daryl Arnold, a surrounding pro- perty owner who resides adjacent to County Road 59 which is the access road to the landfill site, has indicated that dust as a result of the increased traffic associated with the sanitary land- fill is a problem. Mr. Arnold would like to have some form of dust abatement measure implemented on County Road 59 especially in the vicinity of the existing residences. * The response from Dr. Jeris Danielson, Deputy State Engineer, with the Division of Water Resources indicated, "it appears that the potential exists for contamination of shallow ground water in the area. This is due to the shallow water table and the fact that surface runoff apparently will enter the pit. While this may not pose any problems, it should be investigated further before approval is granted." The permitted use on the hereon described parcel of land is a sanitary landfill, as defined by the Colorado Department of Health Regulations. Solid wastes re- ceived are restricted to household type refuse, con- struction and demolition debris. 2. The use of the sanitary landfill is restricted to the residents of the Town of Keenesburg. 3. The landfill shall be operated only between the hours of 8: 00 A.M. to 6 : 00 P.M. on Wednesdays and Saturdays. 4. There shall be an attendant on duty during operational hours. 5. An eight foot poultry netting or woven wire fence shall be placed around the perimeter of the saniary landfill. 6. The sanitary landfill and operation thereof, shall con- form with the minimum standards contained in Section 30-20-110 CRS 1973. 7. A snow fence shall be installed on the north and west sides of the landfill to reduce wind erosion. 8. The recommendations of the Soil Conservation Service for a management program for the sanitary landfill shall be followed. e The Weld County Planning Commission held a scheduled meeting on February 1, 1977, in the Weld County Commissioners ' Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. Carlos Gray keeps the landfill up. He explained that the landfill is open two days a week, Wednesday and Saturdays. This is a new site for the Landfill . Tom Honn read the comments recommending approval . He also read the develop- ment standards. Mr . Glenn Paul recommended approval of this site. He stated there is a problem with dust though. Carlos Gray stated the only reason that water did appear during the test was because of the wet weather they had been having at the time and that there was no water there now, and it has been that way for over a year. Mr. Honn read the letter from Mr. Arnold who opposes this due to the dust problem as he was not present at the meeting. He stated County should pave this road if it was to stay at this site. MOTION: Be it therefore resolved to recommend approval with development standards. Motion by Mr. Carlson. Seconded by Mr. Nix. A vote of "aye" by Mr. Ashley, Ms. Kountz, Mr. Elliott, Mr. Nix, Mr. Heitman, Mr . Carlson, Ms. Yost , Mr. Hiatt , and Ms. White. An approval of the Certificate of Designation was also included in this motion.
