SUBJECT: USR15-0073 Miller HIFI Tank Storage
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Applicant intends to store frac tanks on site.
This project is west of and adjacent to CR 83 and is north of CR 68
Parcel number 079711400005. Access is from CR 83.
Access:
An Access Permit application was submitted with the application materials. Public Works will review the
application and provide an access permit and permit number if approved . Questions concerning access
requirements can be directed to Public Works access permit division.
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users.
Roads:
County Road 83 is a gravel road and is designated on the Weld County Road Classification Plan as a local
road , which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site plan
the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way.
This road is maintained by Weld County.
The County Road CR 81 and CR 70 Section Line is estimated to have 60 feet of unmaintained section line
right-of-way per the Weld County GIS right-of-way map. The applicant shall delineate the existing right-of-
way on the site plan . All setbacks shall be measured from the edge of right-of-way.
Traffic:
No traffic counts are available in the area.
The traffic information submitted with the application materials indicated during relocation of tanks, 1 skid
tank truck could make 8 roundtrips/day or 1 per hour as necessary to move tanks.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
20 to 50 passenger vehicle round trips/day or less than 4 truck round trips/day:
Access onto gravel roads includes 50 ft of road base or recycled asphalt.
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
*** Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
Improvements and Road Maintenance Agreement:
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day
or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded plan
indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the site
onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite
tracking and upgrading and/or maintaining onsite tracking control.
Drainage Requirements:
Detention pond waived and a simple drainage narrative:
A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for
an exception to detention requirements listed below.
The drainage narrative must include at the minimum : Update USR narrative to include
1 . Description which exception is being applied for and include supporting documentation.
2. Where the water originates if it flows onto the property from an offsite source
3. Where it flows to as it leaves the property
4. The direction of flow across the property
5. If there have been previous drainage problems with the property
Exceptions.
1 . Exceptions to stormwater detention shall not jeopardize the public health , safety, and
welfare of public and private property and shall be limited to the following:
a. No stormwater detention will be required for sites that meet any of the following
conditions. Requirements of the Municipal Separate Storm Sewer System (MS4)
areas remain applicable.
8) Development of sites where the change of use does not increase the
imperviousness of the site.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact a Engineering representative from the
Planning Department for more information .
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain :
This area IS NOT in a FEMA regulatory floodplain .
CONDITIONS OF APPROVAL:
A. A complete Drainage Narrative is required and shall include were the water originates if it flows onto
the property from an offsite source, where it flows to as it leaves the property, the direction of flow
across the property, and if there have been previous drainage problems with the property (Department
of Planning Services-Engineer)
B. The plan shall be amended to delineate the following :

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on-site construction .

Prior to Operation:
A. Accepted construction drawings and construction of the offsite roadway improvements are required
prior to operation .
DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1 . Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Chapter 15, Articles I and II , of the Weld County Code. (Department of Planning Services-Engineer)
2. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. The historical flow patterns and runoff amounts will be maintained on the site. (Department of Planning

Subject: USR15-0073 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV15-00072) was noted . This
violation was initiated due to the storage of multiple tanks without first completing the necessary Weld
County Zoning Permits. This case has been forwarded to the County Attorney's Office and we have
initiated legal action ; therefore, an investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
This violation was initiated on May 6, 2015.
If this application if approved by the Board of County Commissioners the existing violation and court case
will be closed . If this application is denied , the tanks shall be removed from the property within 30 (thirty)
days of denial or the violation will proceed in court accordingly.
