HomeMy WebLinkAbout20163155.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION AGAINST ROGER UNREIN FOR VIOLATION OF THE WELD COUNTY CODE - ZCV16-00075 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Roger Unrein, 21846 County Road 17, Johnstown, Colorado 80534, is allegedly in violation of the Weld County Code, specifically ZCV16-00075, for the operation of an RV -Camper -Trailer campground, as well as the presence of more than one (1) principal dwelling unit that is not permitted, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of September, 2016, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time the matter was continued to October 10, 2016, to allow the property owner to meet with the Planning Department and bring the property into compliance, WHEREAS, Roger Unrein, property owner, was present at said hearing and presented testimony, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action for 90 days upon such referral until November 28, 2016, to allow adequate time for the property owner(s) to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff.
