RE: VACATION, ABANDONMENT AND CLOSING OF CERTAIN STREETS
AND ALLEYS IN THE UNINCORPORATED TOWN OF HARDIN, WELD
COUNTY, COLORADO.
WHEREAS, a petition has been presented to the Board of County Com-
missioners, Weld County, Colorado, requesting that certain streets and
alleys in the unincorporated Town of Hardin, Weld County, Colorado, be
abandoned and vacated, said streets and alleys being located adjacent to
property nearly wholly owned by the aforementioned petitioners, and said
streets and alleys being more particularly described as follows, to-wit:
1 . That portion of Castle Avenue between its intersection with
Richtofen Street and Cullen Street; and
2. That portion of Castle Avenue between its intersection with
Cullen Street and that alley or utility easement running along the
South sides of Blocks 4 and 5 and between Lot C; and
3. That portion of Davies Avenue lying between its intersection
with Richtofen Street running southwesterly along the easterly
sides of Block 2 and Block 4 and Cullen Street and, with its inter-
section 30 feet North of the South side of Section 34, Township 5
North, Range 63 West, of the 6th P. M. ; all in the unincorporated
Town of Hardin, Weld County, Colorado; and
4. That portion of alley in Block 2 lying between Castle Avenue
and Davies Avenue; and
5. That portion of alley in Block 3 lying between Castle Avenue
and the westerly boundary of Block 3, being 30 feet East of the
West side of Section 34, Township 5 North, Range 63 West of the
6th P. M. ; and
6. That portion of alley or utility easement running along the
southerly sides of Blocks 4 and 5 and between Lot C, and lying
between its intersection with Davies Avenue and the westerly
boundary of Block 5, being 30 feet East of the West side of Section
34, Township 5 North, Range 63 West of the 6th P. M. , all in the
unincorporated Town of Hardin, Weld County, Colorado; and
WHEREAS, the Board after investigation of all of the facts and cir-
cumstances surrounding the petition, that after personal investigation of the
hereinabove described streets and alleys sought to be vacated, has determined
that the necessity of the public no longer requires those portions of streets and
alleys; and
WHEREAS, the Board of County Commissioners, Weld County, Colorado,
believes it to be in the best interest of the public, and Weld County, to approve
said petition.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the aforementioned streets
and alleys, all in the unincorporated Town of Hardin, Weld County, Colorado,
be and they are hereby declared abandoned, vacated, and closed, in accord-
ance with the submitted petition.
The above and foregoing Resolution was, on motion duly made and

THIS DEED, Made this 3rd day of March, A.D. , 1976, between
ite. WELD COUNTY, a municipal corporation and a political subdivision of
the STATE OF COLORADO, by the BOARD OF COUNTY COMMISSIONERS,
-a for the respective interests of the COUNTY OF WELD, and the STATE OF
COLORADO, of the first part, and THE PRESENT OWNERS, of the second
co co part;
"--1 WITNESSETH, that the said party of the first part, and in consid-
eration of the sum of other valuable considerations and ten dollars, to
said party of the first part in hand and paid by the said parties of the
second part, the receipt whereof is hereby confessed and acknowledged,
o has remised, released, sold, conveyed and QUIT CLAIMED, and by
these presents does remise, release, sell, convey and QUIT CLAIM
unto the said parties of the second part, all the right, title, interest,
claim and demand which the said party of the first part has in and to the
following described real estate situate, lying and being in the County of
1' Weld and State of Colorado, to-wit:
1. That portion of Castle Avenue between its intersection with

appurtenances and privileges thereunto belonging or in anywise thereunto
appertaining, and all the estate, right, title, interest and claim whatsoever,
of the said party of the first part, either in law or equity, to the only proper
use, benefit, and behoof of the said parties of the second part, their heirs
and assigns forever.

As per our conversation yesterday, please find enclosed the necessary
information you requested regarding the vacation of certain streets in
Hardin. I aplogize for the poor copy of the petition but it is the best
I have.
Also note that the petition asks for Castle Street between Richtofen Street
and Cullen Street to be vacated. In my opinion, I ,don't think we should y�`� ' -�
vacate a portion of a street but propose to vacate/Davies Avenue from, .e,
Richtofen Street southwesterly to``''uts intersects of the south section
line of Sec. 34, T5N , R63W,Ea11 of Cullen Street/a at part of
Castle Avenue lying south and west of Richtofen'Street and the alley in
Blocks 2,3, 4, and 5.
Richtofen Street must not be vacated as it is now County Road #380 and is
located on railroad right of way. The list of present owners was taken
from the Assessor's records on January 8, 1975 and I assume there has not
been any changes since then and these are current as listed.
If I can help anymore feel free to call on me and when you pick a date for
said "hearing" , I will check and make sure the hearing room is available. /

I, LaVern A. Korgan am the owner of Lot 1, Lots 28 and 29, Block 3,
and Lots 13 thru 18 inclusive, Block 2, in the Town of Hardin, Weld
County, Colorado. The lots are shown in red in the attached map.
My ownership is on both sides of Castle Avenue between RichtOfen
en
Street and Cullen Street in the Town of Hardin. This portion
Castle Avenue has never to the best of my knowledge been used as
a street and I amy presently using this land as pasture.
I, therefore, wish to petition the Board of Weld County Commissioners,
to close that portion of Castle Avenue (shown in green on the attached
map) in the Town of Hardin, Weld County, Colorado between Richtofen
Street and Cullen Street.
Your help in this petition would be greatly appreciated.
