Chair Commissioner Sean P. Conway . Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer - EXCUSED Commissioner Steve Moreno Also present: Acting Clerk to the Board , Tisa Juanicorena Assistant County Attorney. Bob Choate Planning Services Department representative . Diana Aungst Public Works Department representative, Janet Lundquist Planning Services Engineer representative , Wayne Howard Health Department representative . Lauren Light The following business was transacted : = I hereby certify that pursuant to a notice dated February 26 . 2016 , and duly published March 2 . 2016 , in the Greeley Tribune, a public hearing was conducted to consider the request of Michelle Wilson , for a Site Specific Development Plan and Use by Special Review Permit, USR16-0004 , for one ( 1 ) Single-Family Dwelling Unit per lot other than those permitted under Section 23-3-20 .A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate , Assistant County Attorney. made this a matter of record . Chair Freeman reviewed , for the applicant and the public, the procedures to follow should this case result in a tie vote due to four Commissioner's being present and one Commissioner excused . Diana Aungst, Department of Planning Services . presented a brief summary of the proposal and stated 13 referrals were sent out and ten ( 10) either did not respond or indicated no concerns . She explained the applicant's intent for the second family dwelling to be occupied by family : however. the applicant additionally would like to request the flexibility to rent the dwelling in the future . Ms . Aungst described the surrounding land uses and stated there are seven USRs within one ( 1 ) mile of the site . She reported receiving no correspondence in objection to the application and stated the site is located in the three (3) mile referral area of the Towns of Frederick, Firestone and Mead . Ms . Aungst reviewed the referral responses from these municipalities , displayed some images of the site and adjacent area , and entered the favorable recommendation of the Planning Commission into the record as written . Le; Idt, GO- , PG G- (D — i 2016- 1243 PL2419 HEARING CERTIFICATION - MICHELLE WILSON ( USR16-0004) PAGE 2 Janet Lundquist, Department of Public Works representative . provided a brief overview of the transportation plans and requirements relevant to County roads and due to the low traffic volume , no tracking control or Improvements Agreement will be required . Wayne Howard , Planning Services Engineer representative . stated no concerns or requirements. Lauren ,Li ht Department of Public Health and Environment, reviewed the water and sewer 9 p provisions stating water is provided by the Central Weld County Water District to both homes and the existing home is served by an unpermitted septic system do to the age of the home ; however the applicant has indicated that eventually the home will be hooked up to St. Vrain public water for sewer. Ms . Light clarified that since there is not a definite time frame established for this change of service , there is a Condition of Approval requiring the current septic system be evaluated or the existing home must be connected to St. Vrain sewer. She stated the second home will be hooked up to the St. Vrain sewer when it is built. Ms . Light stated Development Standards ( DS ) #7- 11 address typical Environmental Health items. In response to Commissioner Cozad , Ms . Light stated the information is not available and perhaps the applicant knows . a Michelle Wilson , applicant , stated the septic permit for the existing home is not recorded and she explained the existing home has some history dating back to 1945 ; however, the septic works well and had no problems through the floods . She clarified there are already two (2) sewer taps thru St. Vrain and the existing and future homes have been accepted for public sewer connections but Ms . Wilson stated she is waiting on the outcome from today's hearing before moving forward . In response to Chair Freeman , Ms. Wilson indicated no concerns with the Conditions of Approval or the Development Standards. Chair Freeman recommended deleting Development Standard (DS ) #4 and #5 . The Board agreed . No public testimony was offered concerning this matter. kt_a. In response to Chair Freeman , Ms. Wilson indicated she has reviewed , and agrees to abide by, the Conditions of Approval and Development Standards, as amended . Commissioner Moreno moved to approve the request of Michelle Wilson , for a Site Specific Development Plan and Use by Special Review Permit, USR16-0004 , for one ( 1 ) Single-Family Dwelling Unit per lot other than those permitted under Section 23-3-20 .A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission , with the Conditions of Approval and Development Standards as amended and entered into the record . The motion was seconded by Commissioner Cozad , and it carried unanimously. There being no further discussion . the hearing was completed at 10 : 22 a. m . 2016- 1243 PL2419 WILSON HEARING CERTIFICATION MICHELLE LSO ( USR16-0004) - 004 6 0 ) PAGE 3 This Certification was approved on the 18th day of April , 2016.
