I am now living in an Agriculture Zoning District. This company is to be located North of and adjacent to County Road 4 and West of and adjacent to County Road 45 . I am writing this to protest this industrial-chemical manufacturing company in this Agriculture Zone . I have lived and owned land in Weld County for 39 years. I feel it is important to maintain our water, soil and air quality in our Agricultural Zoning area . I strongly object to an industrial-chemical addition which is adjacent to our property ! One of the concerns I have, is once this plant is approved, there is no guarantees that in the future they will not produce a hazardous material. If this product is considered environmentally friendly, why is it recommended to avoid contract with the skin and eyes. It must be stored in a cold, dry, well-ventilated area . What precautions are there to maintain our air and water quality? Where will the disposal of their by-products be taken ? EXHIBIT D 2 Our well is on the Arapahoe water basin . As I understand, they are planning on drilling an 8" commercial well from our basin . With the water situation in Weld County and Colorado, we totally object to have such a well on a dry-land farm . How is it possible to put a commercial well in an agriculture zone for a business that has no agricultural use ? Once this is approved, what guarantees would we have for like businesses to also be approved for our agricultural land that surrounds us. Will we become an industrial-chemical park? This definitely does not fit into our agriculture zoning or community. It is not COMPATIBLE with our neighborhood ! I feel it is unusal for the Weld County Department and Planning Services to approve an Agriculture Zoning for an industrial-Commercial complex with the tax base for Agriculture. Will this set a precedent for other companies who would like to move into agricultural zoning? I strongly object to allowing this company to be built on this property. Per our phone conversation on March 3, 2016, we have filed a Use by Special Review application with the Weld County Planning Department to build a small manufacturing facility on the property at the intersection of County Road 4 and County Road 45 . The purpose of the facility is to make our NEWDEAL® Blend Solid Airfield Deicer, a product that is used by over 100 aviation users nationwide to keep their runways, taxiways, and ramps safe for aircraft operations during winter weather events. NEWDEAL® is a non-corrosive, non-hazardous, environmentally friendly product that the aviation industry has been using for the past several decades. The manufacturing process is a simple dry pelleting process that turns deicing ingredients in powdered form into a pellet form , The process does not require any water usage and therefore, no industrial process water or waste will be generated by the facility. The only water usage will be from the employees' domestic use and some minor landscaping around the 21,000 square foot building to give the site a pleasant appearance. We are a small business and anticipate employing 8 to 10 people at our facility during the normal business hours of 7am to 5pm, Monday through Friday. The facility will sit on less than 3 acres of land. The remaining 35 acres surrounding the facility will continue to be used for agricultural purposes. New Deal Deicing is proud to bring manufacturing jobs back to the United States and the local community while making a significant difference in the aviation industry. Also they are asking for self regulation regarding their hazardous materials. Meaning no EPA regulations. We do not want, nor do we need, a de-icing plant even close to our neighborhood of Box Elder Creek. It is my understanding that the plant would tap into our limited residential water system, which would likely result in reducing water available to current and future home owners and increase our water costs due to the need to greatly increase the existing water delivery system. There are still many more land parcels for sale that will be developed and will require water from our dedicated residential well placing even more demand on our limited system. In addition, noisy, heavy truck traffic driving on Hayesmount and other access roads will result in additional, and more extensive, roadway maintenance. Even now, there are numerous chuck holes on Hayesmount due to existing heavy truck traffic. These heavy vehicle induced holes require constant maintenance and are a hazard to automobile traffic. Moreover, those of us that moved to the "prairie" did so because we wanted out of the city-like environment with the associated high traffic and noise. Box Elder Creek has a very strong HOA that, by design, maintains the type of neighborhood we moved here to enjoy. Building a de-icing plant would run counter to every reason we moved to the country environment. There are areas better suited to the operation of an industrial de-icing plant. This is an agricultural community. NOT INDUSTRIAL OR COMMERCIAL! Honestly it is a repugnant thought to have such a business in the midst of homes and farm land. Furthermore the manner in which both the county and this company arc trying to slide in under the radar is insulting to the surrounding communities. I absolutely DO NOT want this anywhere near my home or my community. The fact that I live in a different county has little bearing on the validity of my complaint, the proposed site is in too close to my community and several others as well. We will take this to the media as well as an attorney if need be this proposed facility will not slide in under the radar. The health and safety of our families in regards to both the chemicals being produced as well as the transportation of these chemicals near our properties is unacceptable. Not to mention the loss of property value to all of the surrounding communities. No THIS WILL NOT BE TOLERATED. First of all if you look at the company that is proposing this is a trust fund ran by lawyers trying to make money at the risk of our property and our natural resources. For sake of argument let's use the name Berven Industries as the low life company attempting to use agricultural land for the production of hazardous chemicals. At the neighborhood meeting, Berven Industries stated that they were only going to build one building and had no plans to build additional building. However, in the application to the planning commission, section 5d states: "Two potential future expansions of 30,000 square feet have also been shown, one occurring on either side of the initial structure. Also, Weld County has allowed Berven Industries to do the absolute minimum in notifying families. Tell me how it is just and right that they only need to notify families within 500 ft. of the site. If this so call biodegradable product is so environmentally safe why does sodium acetate which is flammable according to the DOT and both sodium acetate and sodium formate are caustic and need to be handled with protective gloves, clothing and a respirator. Please also tell me how the county of Weld can allow Berven industries to drill into our water supply and contaminate our water when there is a chemical spill. This makes no sense as is down right unacceptable. Please also tell me why they insist on being self regulated and not allow the EPA to regulate their business of clean up and disposal? Again, at the neighborhood meeting and on the initial application 5c the company confirmed hours of operation from 7am to 5pm Monday through Friday with possible weekend work. However, on the day of the neighborhood meeting Berven Industries sent an email to the planning commission stating they wanted the following change "the hours of operation of the facility are unlimited" Having these trucks driving all hours of the day and night is dangerous and what happens if there is an accident near the Rocking Horse and Box Elder Estates where there are more livestock and children? If Berven Industires was a honest company trying to do the right thing than why the change of plans at the last meeting. You and I both know this was their intention all along. You don't need 35 acres for a one building plant operation unless you plan on expanding. Weld County is know for being a agricultural county and allowing a dishonest company to come in and ruin our way of life is wrong. I moved out here 3 years ago to be away from noise and now all of that will be for not. I know you will do the right thing in not allowing this to happen . This is a community of people not a community of manufacturing. From the conflicting information I received from the neighborhood meeting and the application filed by this Trust/company, I do not trust this company and do not feel like they will keep any promises made verbally or in writing. This property is too far off the radar for Weld County and this company is expecting to self-regulate and self-monitor. All you have to do is listen to the news to know this method never works. We don't want to be the next Flint, Michigan. The application states that the company will have no responsibility for clean-up should the company go out of business. Really? ! This company will not take responsibility for their mistakes after the disaster has occurred and wants us to trust that it just will not occur. That is unreasonable and ridiculous ! Laura stated that the product was too expensive to have any wasted product. According to the application "Any liquid wastes generated in the warehousing/manufacturing facility will be collected in the floor drain trap." THIS MEANS THAT THERE WILL BE WASTE WATER THAT COULD POTENTIALLY CONTAMINATE OUR GROUND WATER. Otherwise, the company would not need to go to the expense of installing these safety measures. The company stated at both the meeting and in the application that the city of Hudson will respond in case of a fire. At the meeting, they stated that Hudson Fire Department would be able to respond within 10 minutes. I recently received a Mill Levy tax increase request that is on the ballot to increase our property taxes because the equipment Hudson Fire Department currently has is out of date. Additionally, they do not have sufficient funding to respond within an appropriate time and in an appropriate way to the fire danger we currently have. Where will the funds come from to give our already over-extended Fire Department the sufficient training to respond to this kind of chemical fire danger? How much damage will happen to the surrounding community when the agricultural land surrounding the facility catches on fire? We have had multiple grass fires in this area in the past 2 years. This is a serious problem and ongoing threat to our agricultural community. One fire completely destroyed our neighbor's wheat field that was ready to harvest and threatened our house and 3 of our neighbor's houses. Every person living within a mile of this fire had to use their own water, well and, resources to help contain this fire until the fire department was able to respond and contain the fire. Another grass fire occurred in the exact area where this facility is proposed to be built. This is a REAL risk our community does not need to take. At the neighborhood meeting, the company confirmed that the hours of operation would be from 7am until 5pm, Monday through Friday. They stated that occasional weekend work would be required during the busy season. This statement matches the initial application in 5c. On the day before the neighborhood meeting, the company submitted an email to the planning commission stating that they wanted the following change: "the hours of operation of the facility are unlimited." This change was not mentioned by the company and conveniently left out of the neighborhood meeting. The initial application states the company will have 11 employees. At the neighborhood meeting, the company showed a slide stating that they would have 6 employees. On the email sent the day before the neighborhood meeting the company asked to change the application to state "the number of on-site employees shall not exceed 15." This number constantly changing would be less concerning if there wasn't so much other conflicting information. Laura Miao with New Deal Deicing called Nick and left a voice mail. Nick returned the phone call and spoke with Jeremy and Laura of New Deal Deicing. Jeremy and Laura addressed each of his concerns and questions during the phone call . March 18, 2016 New Deal Deicing mailed letters to the five local neighbors within 500 feet of the property (the Nunezes, Jordan Evelyn, Appelhans, Joseph Deniston/Sara Dixon, and the Wiants) to introduce ourselves and provide a brief overview of the project. (See attachment A). March 25, 2016 Chris Gathman informed us of another protest letter received from the Davis-Pavelsek-Davis landowners located at 1/3 mile east of the property. Laura called and left a voice mail in an attempt to have a conversation with them . No return phone call was ever received . Laura called Nick Appelhans to schedule with and invite him to a New Deal Deicing sponsored public meeting at the Hudson Library regarding the project. An additional half-hour was spent addressing Nick's concerns regarding the project, some of which were already discussed during the March 3rd phone conversation . March 29, 2016 Letters were mailed to seven (7) neighbors (the Nunezes, Jordan Evelyn, Appelhans, Joseph Deniston/Sara Dixon, Davis-Pavelsek-Davis, the Grillos, and the Wiants) to inform and invite them to the public meeting forum scheduled to be held at the Hudson Library on April 13. (See attachment B) April 3, 2016 Nick Appelhans left a voice mail on Laura's phone stating he wouldn't be attending the neighborhood meeting but would instead attend the Planning Commission's Hearing. EXHIBIT b is I April 13, 2016 New Deal Deicing hosted a public meeting forum at the Hudson Library from 7-9pm. Seven people from 4 households attended (Juan & Julie Ramirez, Shawn & Susan Wiant, Melecio & Jennifer Chavez, and Joe Deniston). Laura and Jeremy gave a presentation about the company and the project. Afterwards, there was a lengthy Q & A session regarding the project. From the discussion, two primary suggestions were received. 1. A request to screen the entire facility with trees and other types of live vegetation . 2. A request to install a temporary wall or barrier during the construction phase to mitigate noise from construction. We think both of these are good suggestions and we will explore options with our general contractor and architect. In general, our meeting appeared to have addressed a number of concerns and cleared up some misconceptions about the project. The purpose of the facility is to make our NEWDEAL® Blend Solid Airfield Deicer, a product that is used by over 100 aviation users nationwide to keep their runways, taxiways, and ramps safe for aircraft operations during winter weather events. NEWDEAL® is a non-corrosive, non-hazardous, environmentally friendly product that the aviation industry has been using for the past several decades, The manufacturing process is a simple dry pelleting process that turns deicing ingredients in powdered form into a pellet form. The process does not require any water usage and therefore, no industrial process water or waste will be generated by the facility. The only water usage will be from the employees' domestic use and some minor landscaping around the 21,000 square foot building to give the site a pleasant appearance. We are a small business and anticipate employing 8 to 10 people at our facility during the normal business hours of 7am to 5pm, Monday through Friday. It is for the benefit of one individual, and at a cost to MANY. If the applicant or any purchaser of land can, by virtue of their purchase ONLY, change the designation OR USE of land or property, the zoning laws mean nothing, Zoning ordinances are not mere recommendations or guides. Whether it is called Use by Special Review or Spot Zoning, it smacks of favoritism. A deicing plant serves NO special purpose to the immediate surrounding area. NO fair and substantial relationship exists between the neighborhood and the specific application of this special provision. Values of surrounding properties in the neighborhood will be diminished, for the benefit bf the Denver resident applicants. How is this good? They drive home to Denver at the end of the day. We live here. None of us built our homes in an industrial zone. I respectfully submit that a chemical plant not build in an ag zone. There are countless industrial properties available for such industry, with critical infrastructure in place, not the least of which are fire hydrants. There has been no change in conditions affecting the ag zoning in our area. The fact that the use of the property for any purposes authorized in an ag district might be impractical and not suit their needs does not justify a use change. There are designated industrial zones for industry, as part of planned growth. Unless a zoning line is drawn, there can be no zoning at all. We have the right to rely on existing zoning regulations when there has been no material change in the character of the neighborhood. To allow a special Use in this instance would be arbitrary and would make a mockery of zoning ordinances. Zoning carries with it a presumption of validity. The EPA website highlights what they call, "Smart Growth," where good development has improved residents quality of life. If this Use request is granted, the applicants will be permitted indirectly to do what they could not accomplish directly that is by cloaking their request for a zone change as a special use request, they benefit and the surrounding residents lose. The industrial park which is proposed on this site does not serve the neighborhood in ANY way. It would illustrate the antithesis of planned zoning, at the benefit to one requesting the change, and the detriment to many neighboring property owners and the surrounding neighborhood. Indeed, it would benefit the applicant at the expense of surrounding landowners and would be in conflict with existing uses. This would be an abuse of the USR process; a way to get around proper rezoning, unrestrained. The application itself is not clear. First, it was listed as "storage." Now, it is storage and manufacture. Where is this chemical product currently being manufactured? Has anyone viewed the process? No matter, as it belongs in an industrial area. The NewDeal product trade name is categorized as "chemical." We don't even know clearly what they desire to do at this industrial park. No matter; it belongs in an industrial area. This is a residential area . Noise levels for residential limits should be dictated, not Light Industrial, which are substantially higher. Sound attenuation panels should be required around the entire property, not fence. There should be explicit dictates with regard to dust. Large trees should be densely planted. Working hours should be restricted to normal day shift hours, not 24 hours, as should delivery hours, which I notice the number of trucks per day has increased , and number of employees has more than qh-1I f ke doubled since the initial application. One truck per day yet 3 truck bays. Restrictions to dictate st ,c � maximum seismic vibration resonance from construction and ongoing operations should be in place. A substantial remediation bond should be in place in the event of fuel spills, drainage problems, EXHIBIT A Page 1 of 2 p( ink W -o 0OB environmental contamination I point these issues out to show that this is a business that belongs in an industrial area with CRITICAL infrastructure in place. The application shows photos that were strategically placed to indicate this property is situated in an area of vacant fields and unused roads. This is our neighborhood, and this is the area immediate to this proposed chemical facility and industrial park. Within a 10 mile radius in three directions, there are numerous industrial areas for such businesses. Front Range Airport with access to 1-70, Hudson Industrial area, highway 85 and the railroad, all of these areas are ripe, ready and available with the essential infrastructure. With all of these industrial properties available, I have to wonder WHY anyone would attempt to purchase AG property where there is no freeway entrance or exit, no railroad spur nothing to accommodate an industrial business, and intend to move into and disrupt the long existing character of a neighborhood. I'm not sure if this is a lack of respect for the concept of neighborhood or a lack of respect for anyone else's neighborhood except their own. Why not apply for spot zoning in their own Denver neighborhood? Why permit it here, as if Weld County is lesser? Lastly, we have herds of deer, pheasant, foxes, coyotes and eagles in this immediate area. What impact will this facility have on the wildlife? Has an impact study been done? If you don't live here, you don't know the pleasure of watching bald eagles with their eaglets. Weld County is supposed to care. As Weld County residents, we care, we appreciate, and we value the quality of life we have in this neighborhood. Please do not throw us away. Would any person in this room go find a property for sale in their own neighborhood and envision it with a deicing plant on it? Would it align with the character of your neighborhood? Imagine the ramifications it would bring to your neighborhood. Please work hand in hand with the applicant to place them in an industrial area where everyone can thrive, and no one is diminished.
