The existing zoning of the northern parcel is agricultural (AG) and is bounded on the northern side by the Bull Canal (AG) and on the southern side by Lot 1 of the Althen-Boyer CUD (C-3). The small parcel of ground located on the eastern side of Lot 1 is Zoned C-3. The existing uses consist of Commercial and Industrial uses, sales and manufacturing of steel products. The requested zoning for this property would be a dual zoning, C-3/I-3. This style of zoning would cover the sales aspect of the business, manufacturing of steel products and the outdoor storage of steel products used in the manufacturing. The existing C-3 zoning allows outside storage, however, may not cover the steel stock used to manufacture the steel products. Most finished products are stored in the building; however some outside storage for finished products is preformed outside of the existing building and is covered under the C-3 Zoning. 2. Section 22-8-80 This section of the Weld County Code is in regards to access to the transportation system for Industrial uses. This site is located on the 1-25 Frontage road, (1-25 corridor) and has adequate access to the 1-25. 3. Section 22-8-100 This section of the Weld County Code is in regards to access to the transportation system for Commercial uses. This site is located on the 1-25 Frontage road, (I-25 corridor) and has adequate access to the 1-25. 4. Section 23-3-330 This section of the Weld County Code is in regards to I-3 (Industrial) Zone District. A. Intent. Industrial Uses that may create adverse visual impacts on adjacent properties. The existing storage of steel stock used in the fabrication of the steel products is not currently covered under the C-3 zoning. The C-3 zoning does cover the finished steel products stored outside; however, screening of the outside storage for the finished products is required. At the present time, screening trees are present on a portion of the northern property line and consists of 19 evergreen trees. More screening trees may be required to meet the intent of the Weld County Code for screening from adjacent properties. The proposed dual zoning of C-3/1-3would cover all aspects of the business operations currently taking place on the property. B. Uses Allow by Right. Section 23-3-330-B-3, Industrial uses. The industrial use for this property would be covered under Section 23-3-330-B-3; Manufacturing, Fabricating, assembling and storage of materials used in the fore said business operations. Section 23-3-330-B-5, Equipment storage. Equipment storage does occur on site. The equipment is used in the loading and unloading of materials and finished products on site. Section 23-3-330-B-13, Outdoor storage. Materials used in fabricating of steel products are stored outside of the existing building. At the present time, the storage area is presently partially screened from adjacent properties to the north by the use of 19 evergreen trees. Additional screening trees may be required on the eastern side of the property. The outside storage of materials used in the fabricating process is adequately screened from the public ROW by the existing building on site. C. Accessory Uses. Section 23-3-330-C-1, Office Space used by operators of the business on site. The office space in the building is used by the business on site. No office space is used or available to other business not located on site. Section 23-3-330-C-2, Loading Areas. The loading area for the business operations occurs on the eastern side of the existing building. The loading area is paved with concrete and is adequately screened from public view (ROW) by the existing building. Section 23-3-330-C-3, Parking. The parking area for employees and customers is located on the western side of the existing building. This parking area is presently screen by four (4) mature cottonwood trees and an unstated six (6)foot chain-linkfence. Additional screening may be required on the northwestern and northern portions of this parking lot. Section 23-3-330-C-6, Retail Sales used by operators of the business on site. Retail sales occur on this site. Section 23-3-330-C-7, Cargo Containers used by operators of the business on site. Up to five (5) cargo containers may be present on site at any given time. The cargo containers may be used for storage of materials and finished products or may be placed on site until loaded with finished products then shipped to the customer. D. Use by Special Review (USR). It is assumed that no USR is required for this site. E. Site Plan Review (SPR).An SPR drawing/Grading &Drainage drawing is being created and will be provided during the Final Plat process. The Final plat is being submitted concurrently with the Change of Zone application. Section 23-3-340 Performance standards As outlined in sections 23-5-350 and 23-5-360. Section 23-3-350 Design standards. A. Stormwater Management. From information obtained from the Weld County Department of Public Works, Stormwater retention/detention is not required for this site unless additional structures are proposed for the site. No new structures are proposed for the site. Water Quality Capture Volume (WQCV) is required for the site. WQCV is being provided along the northern and western property lines and adjacent to the Bull Canal. See the Drainage Cover letter and computations as provided. B. Parking. The existing parking for the site is located on the western side of the existing building and adjacent to the Public ROW The existing screening that is now in place consists offour (4) mature Cottonwood Trees located on the western side of the parking lot. Additional landscaping may be required to meet the intent of the Weld County Code for screening of parking lots. An existing unslated six (6)foot chain-link fence is present on the site and is located on the western side of the parking area. The parking area is surfaced with recycled asphalt (gravel). C. Loading Areas. The existing loading area is located on the eastern side of the building. This loading area is screened from the public ROW. The existing loading area does not encroach onto neighboring properties. The site is fenced on all sides by a six (6)foot chain-link fence. The loading area is paved in concrete. D. Street Access. The site has safe access to the I-25Frontage Road. The access has been reconstructed by the Colorado Department of Transportation (CDOT) approximately 4 years ago. It is assumed that the access was reconstructed meeting CDOT requirements and exceeding access requirements for Weld County. E. Acceleration/deceleration lanes. It is assumed that the access does not require acceleration/deceleration lanes as the access was constructed by CDOT. No increase in the trip count is anticipated at this time. At the time an increase in trip generation of 20% is obtained, a access application for CDOT will be required. F. Required Yards. 1. Setback.No uses exist in the 25 foot setback except for the existing parking area. Additional screening may be required to comply with the Weld County Code. The existing screening consist of 4 mature Cottonwood Trees and a six (6)foot chain-link fence (Unstated). 2. Offset. The height of the building on site is 24 feet. The offset for the site is 12 feet based on the building height. Any outside storage that now exists in the offset will be relocated outside of the offset. 3. Structure offset from gas and oil facilities. There is an existing tank battery located to the east-northeast of the structure on site. The distance to the said tank battery is ±450 feet. The structure, as built, meets the offset requirements. G. Required Landscape Areas. 1. Lot coverage. The maximum lot coverage is 85%. Excluding the area occupied by Bull Canal (4,270 SF), the total required landscaped area is 23,470 SF. The actual L.S. that now exists on site is 23,745 S.F or 15.2%. The landscaping consists of colored landscape rock and plantings. Additional landscaping areas may he required for storage and parking area screening purposes. These additional screening trees will be added to the landscape plans per comments obtained from the planning department. 2. ROW Screening. Additional landscape screening may be required, by the Weld County Planning Staff, along the western side of the existing parking area. This item will be addressed through the comments process. H. Trash Collection Areas Trash collection—Atlas Metals—recycles all our metal scrap in roll off dumpster bins. McDonalds Farms furnished a large roll off totally enclosed bins with small trap doors located along top. When full they pick up dumpster, empty and return empty for re-use. This works very well for us as all trash is 100% contained. I. Water Supply. Water is provided by Central Weld Water. J. Sewage Disposal. The site was served by Septic Permit# G-840150. This system was sized for 6 people. The site currently has 12 employees. A Septic Repair Permit has been obtained and is in process of construction and acceptance by the Weld County Department of Public Health and Environment. The new septic system was sized for 19 people. K. External Lighting.All external lighting is downward facing and does not shine onto the public ROW. The existing site lighting does not create a hazard to the traveling public. Section 23-3-360 Operation Standards. a. Noise—no objectionable noise is emitting from property. b. Air quality—our facility falls below the maximum threshold limit required by the State of Colorado for particulate. In addition we have a dust collection system on our exhaust system located in the manufacturing area. c. Water quality—no floor drains—restrooms are on septic. d. Radiation—NA e. Heat— Welding operations due occur at the site. All welding operations are preformed performed inside building in shielded containment areas. There is no significant temperature outside of the existing structure. No temperature changes occur at the property line. f. Glare—Front and rear of building lighted with fluorescent floods. No hazards to traffic. No residential areas, all welding performed inside building in shielded containment areas. g. Property Maintenance—weed control is performed by Paratex Colorado, Inc. The CDOT access Permit has been submitted to the CDOT Access Department. The Hazardous Materials Handling Plan and Dust Abatement plans are attached to this Change of Zone/Rezoning Questionnaire. Farmer's Reservoir and Irrigation Company. The proposed COZ will not change any of the existing site conditions. The Historic Stormwater flows will be maintained, no new structures or paving is proposed on the site. WQCV is being provided on site and will reduce peak Stormwater runoff for minor storms. UNIT#6 LICENSED PROFESSIONAL ENGINEERS EVANS,80634 T D LICENSED PROFESSIONAL LAND SURVEYORS et July 26, 2013 Subject: Historic Storm Water Flows Narrative PKE Investments Limited Partnership Lot"1"Althen-Boyer CUD Pt Section 23, Township 1 North, Range 68 West Erie, Colorado 80516 To Whom it Concerns Alles Taylor 8s Duke, LLC has been contracted to produce a portion of the required documentation for the required PUDK12-0002/COZ. An AS-Built topographic site survey has been preformed and a copy of said survey has been attached to this drainage narrative. The Althen-Boyer CUD was created in the mid 1970's and Stormwater detention facilities were proposed, the Stormwater detention facilities were never built, therefore all Stormwater facilities are required for each lot at the time of additional buildings or imperviousness values are changed and in the event of a change of use is proposed for any given lot located in the Althen-Boyer CUD. From comments obtained from the Weld County of Public Works, Stormwater detention is not required at this site unless additional roof areas and additional paving is proposed. The imperviousness value of the site is being adjusted downward as additional landscaping is being proposed at the site. As requested a brief narrative of the existing storm water drainage patterns follows: 1. Off-Site Flows: Minor Stormwater flows enter the site from Lot 2 of Althen- Boyer CUD. This off-site flow will be directed to the east and west along Lot l's southern property line. The proposed change in the flow pattern existing on the southern property line will not adversely affect Lot 2 of Althen-Boyer. 2. The existing storm water drainage patterns that exist on the site are as follows: Three (3) distinct Drainage basins exist on this site. Drainage Basin D.1 is located on the eastern portion of site and the area of this Basin is ±2.15 AC. Drainage basin D.1 has historically flowed into the Bull Canal. The Water Quality Capture Volume (WQCV) calculated for this basin is 1,474 CF. Drainage basin D.2 consist of half of the existing roof and the areas south of the one structure located on site, the size of this Drainage basin is ±0.35 AC and the WQCV calculated for this basin is 303 CF. This Drainage basin flows to the southern property line, then west to the drainage facilities constructed by the Colorado Department of Transportation (CDOT) along the western side of the site. A portion of the Stoiiuwater flows from Lot 2 also flow into the CDOT drainage works. The WQCV calculated for this Drainage basin is 303 CF. Drainage basin D.3 is located on the northern and western sides of the existing building and the area of this drainage basin is ±0.99 AC and consist of the northern portion of the roof area, a rock landscaped area on the northern side 2011-092 _j J ALLES TAYLOR & DUKE, LLC 3670 35TH AVE. Stormwater flows from this area have historically flowed into the Bull Canal. The WQCV calculated for this area is 658 CF. The proposed drainage pattern for the site is as follows: The proposed drainage will maintain the historic flow patterns due to the existing lot grading configuration. The required WQCV is 2,435 CF for basins D.l and D.3, please see appendix A for calculations. WQCV is not being proposed or provided for Drainage basin D.2 due to the size of this drainage area and amount of WQCV calculated for this Drainage basin, 303 CF, please see appendix A for calculations. The proposed WQCV pond has been placed on the western, northern and eastern property lines and consists of a drainage swale that captures the Stormwater before it enters the Bull Canal. The WQCV is then released from this drainage swale by the use of four (4) Water Quality Release structures located at low points in the drainage swale. Three (3) of the drainage structures have invert elevations of 5155.0 and one (1) of the release structures has an invert elevation of 5155.20, the orifice size for each release structure is 0.802 inches. Stormwater from these release structure drain directly into the Bull Canal and is considered as a historic flow pattern. The WQCV has a 40 hour period of release. The depth of ponding is 1.1 feet and a freeboard of 0.65 feet has been provided. The design volume of the WQCV pond is 2,435 CF and accounts for basin D.1 and D.3, no WQCV has been provided for basin D.2, please see appendix A for all WCQV calculations. Due to the existing site conditions only one emergency outflow point is required. The time of concentration, tc, for the site is assumed at 5 min./in. and is based on the site size and configuration. The emergency overflow weir has been sized for the 100 year storm for this site and is located on the north eastern portion of the site adjacent to the Bull Canal and is considered as a historic flow condition, please see attached computations in Appendix A for the 100 year flow calculations. The flow depth at the overflow point is assumed at 0.5 ft for the 100 year storm. The over-flow opening width is 16 feet and this produces a cross-sectional flow area of 8 SF. The resultant flow velocity is 2.19 ft/sec., please see the attached calculations. Buried Type "L" rip-rap with underlayrnent has been shown for the over-flow point, however, the site owner is proposing constructing a steel product to convey the overflows into the Bull Canal by the use of a fabricated steel product. The Permittee shall refer to all additional standard requirements included with this permit and any enclosed additional terms, conditions, exhibits, and noted attachments. 3. Incorporated as part of this permit are the following: Application for Access Permit(CDOT Form No. 137) Permit(CDOT Form No. 101) and its two page attachment Exhibits: "A"-Access Plans "B"- Vicinity Map 4. This permit is issued in accordance with the State Highway Access Code (2 CCR 601-1), and is based upon the information submitted by the Permittee. This permit is only for the use and purpose stated in the Application and Permit. Any changes in traffic volumes or type, drainage, or other operation aspects may render this permit void, requiring a new permit to the be applied for based upon existing and anticipated future conditions. 5. Access construction methods and materials shall conform to the Colorado Department of Transportation Standard Specifications for Road and Bridge Construction(current edition). 6. If necessary, minor changes, corrections and/or additions to this permit may be ordered by the Department inspector, other Department representative or local authority to meet unanticipated site conditions. Changes may not be in violation of the State Highway Access Code. All major changes to the plans must be approved in writing by the Department prior to commencement of any work on or within the State Highway right-of-way. MI workers within the State Highway right-of-way shall comply with their employer's safety and health policies/procedures, and all applicable U.S. Occupational Safety and Health Administration (OSHA) regulations - including, but not limited to the applicable sections of 29 CFR Part 1910 - Occupation Safety and Health Standards and 29 CFR Part 1926 - Safety and Health Regulations for Construction. At a minimum, all workers in the State Highway right-of-way, except when in their vehicles, shall wear the following protective equipment: * Head protection that complies with the ANSI Z89-1-1997 standard; * At all construction sites or whenever there is a danger of injury to feet, protective footwear that complies with the ANSI Z41-1999 standard will be worn; * High visibility apparel as specified in the Traffic Control provisions of this permit (at a minimum, ANSUISEA 107-1999, Class 2). Where any of the above-reference ANSI standards have been revised, the most recent version of the standard shall apply. 7. This permit is subject to revocation due to: 1) Noncompliance with the provisions of this permit; 2) Abandonment; 3) Supersedure by new permit covering the same installation; or 4) Conflict with necessary planned highway construction and/or improvements. The Permittee shall promptly terminate occupancy State Highway Access Permit 2 Attachment to Permit No.4]3068 -Additional Terms and Conditions upon notice of cancellation of the permit from the Department, unless a new permit is applied for and granted. 8. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the required design and/or material specifications. If any construction element fails within two years due to improper construction or material specifications, the Permittee is responsible for all such repairs. 9. The Department retains the right to perform any necessary maintenance work in this area. 10. Backing maneuvers within and into the State Highway right-of-way are strictly prohibited. All vehicles shall enter and exit the highway right-of-way in forward movement. Backing into the right-of-way shall be considered a violation of the terms and conditions of this access permit and may result in revocation of the permit by the Department and/or the issuing authority. 11. All costs associated with the maintenance of this access are the responsibility of the Permittee. This includes design, construction, signing and striping,utility relocation,testing of materials, and inspections. 12. Landscaping and site construction shall not obstruct sight distance at any State Highway access point. Landscaping within the State Highway right-of-way requires the Permittee to obtain a CDOT Landscaping Permit from the Traffic/Access Section. The access permit does not authorize that activity. Irrigation of features within the right-of-way may require the Permittee to install a subsurface drain in accordance with CDOT Standard M-605-1 or other approved system. The Permittee shall contact Tim Bilobran at the Greeley Traffic Office, (970) 350-2163 to obtain the Landscaping Permit. 13. Routine, periodic maintenance and'emergency repairs may be performed within the State Highway right-of-way, under the general terms and conditions of the permit. Any significant repairs such as culvert replacement, resurfacing, or changes in design or specifications, will require written authorization from the Department. The Department shall be given proper advance notice whenever maintenance work will affect the movement or safety of traffic on the State Highway. In an emergency, the Department Region Office and the State Patrol shall immediately be notified of possible hazards. 14. If highway right-of-way fence exists or is proposed, the Permittee must contact Tim Bilobran at the Greeley Traffic Office, (970) 350-2163, prior to removal or installation. 15. The access shall be maintained as presently constructed. 16. Surfacing of the access shall be maintained as per Exhibit "A". 17. The access shall be maintained in a manner that will not cause water to enter onto the roadway, and will not interfere with the existing drainage system within the State Highway right-of-way. Drainage to the State Highway right-of-way shall not exceed historical rate of flow. 18. The maintenance of the access and/or further development of this property shall not negatively impact adjacent nearby properties. Correction of the problem and cost resulting from damages shall be borne by the Permittee. State Highway Access Permit 3 Attachment to Permit No. 413068 -Additional Terms and Conditions 19. The Department inspector may suspend any work due to: 1)Noncompliance with the provisions of this permit; 2) Adverse weather or traffic conditions; 3) Concurrent highway construction or maintenance in conflict with permit work; 4) Any condition deemed unsafe for workers or the general public. The work may be resumed upon notice from the Department inspector. 20. Personal protective equipment (e.g. head protection, footwear, high visibility apparel, safety glasses, hearing protection, respirators, gloves, etc.) shall be worn as appropriate for the work being performed, and as specified in regulation. At a minimum, all workers in the State Highway right of way, except when in their vehicles, shall wear the following personal protective equipment: High visibility apparel as specified in the Traffic Control provisions of the documentation accompanying the Notice to Proceed related to this permit (at a minimum, ANSI/ISEA 107-1999, class 2); head protection that complies with the ANSI Z89.1-1997 standard; and at all construction sites or whenever there is danger of injury to feet, workers shall comply with OSHA's PPE requirements for foot protection per 29 CFR 1910.136, 1926.95, and 1926.96. If required, such footwear shall meet the requirements of ANSI Z41-1999. Where any of the above-referenced ANSI standards have been revised, the most recent version of the standard shall apply. 3- The Permittee is responsible for complying with the Revised Guidelines that have been adopted by the Access Board under the American Disabilities Act (ADA). These guidelines define traversable slope requirements and prescribe the use of a defined pattern of truncated domes as detectable warnings at street crossings.
