SUBJECT: USR15-0068 Platte River Midstream
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Project description
This project is west of CR 45 and is south of CR 66.
Parcel number 080327100081. Access is from CR 66
Access:
An Access Permit application was submitted with the application materials. Public Works will review the
application and provide an access permit and permit number if approved. Questions concerning access
requirements can be directed to Public Works access permit division.
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s)stopped to open a gate be allowed to create a safety issue for roadway users.
When feasible, there shall be no net increase in the number of accesses to a public road. Contact Public
Works to discuss your access.
Roads:
County Road 66 is a paved road and is designated on the Weld County Road Classification Plan as a
local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site
plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-
way. This road is maintained by Weld County.
Traffic:
Latest ADT on CR 66 was taken on 10/9/13 which counted 219 vpd with 22% trucks.
A traffic narrative was submitted by Gene Coppola with the application materials and indicated that there
will be approximately 50 truck daily roundtrips and 20 employee daily roundtrips. The expected traffic
routes are CR 66 to SH 85 with traffic also using CR 66, CR 43, CR 45, and SH 392.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
More than 10 round truck trips/day (tandem or semi-trucks) or more than 50 round passenger vehicles
trips:
Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft
of asphalt.
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
*** Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
A development standard will be included on the recorded site plan. "The site shall be maintained to
mitigate any impacts to the public road including damages and/or offsite tracking."
A variance request for alternatives to the above tracking control can be submitted to the Traffic Division of
Public Works for review and consideration.
Improvements and Road Maintenance Agreement:
An Improvements Agreement between the Applicant and the County will be required for this project. It will
detail the approved haul route(s), outline when offsite improvements will be triggered, and include a
maintenance agreement for the haul routes.

An Improvements Agreement is required for sites with required offsite improvements. Collateral is
required to ensure the improvements are made.
Road Maintenance is typically included as a section of the Improvements Agreement when the
County feels that the site activities may impact the County roadways. Possible mitigations included
in the road maintenance agreement may include but are not limited to: dust control, specified haul
routes, damage repairs, and future improvement triggers.
Drainage Requirements:
Detention Pond summarized in a Drainage Report:
A drainage report and detention pond design has been completed by the applicant's engineer which
included a signed and stamped Certification of Compliance. This is acceptable to Engineering.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit
applications are accepted after the planning process is complete (plan recorded). An Early Release
Request Form may be entertained only after the applicant and Planning Department have reviewed the
referral and surrounding property owner comments. The Early Release Request may or may not be
granted depending on referral comments and surrounding property owner concerns. Contact a
Engineering representative from the Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
If more than 1 acre is to be disturbed for construction of non pipeline items such as structures, parking
lots, laydown yards etc..., a Weld County grading permit will be required prior to the start of construction.
Contact the Planning Department for more information.
CONDITIONS OF APPROVAL:
A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this
location. Road maintenance including dust control, damage repair, specified haul routes and future
traffic triggers for improvements will be included. (Department of Public Works)
B. The plan shall be amended to delineate the following:
1. County Road 66 is a paved road and is designated on the Weld County Road Classification Plan

2. Show and label the approved access(es) (APXX-XXXXX), and the appropriate turning radii on the

3. Show and label the approved tracking control on the site plan.
4. Show and label the accepted drainage features and drainage flow arrows on the site plan. Water
quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater
Detention, No-Build or Storage Area" (Include final calculated volume)(Department of Planning

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on-site construction.

B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-

2. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Special Review permit for mineral resource development
facilities, an oil and gas storage facility with transloading , lay-down yard and a 35 foot in
height communications tower in the A (Agricultural ) zone district.
The application states there will be, at full build-out as many as 20 employees, however,
initially there will be 4-8 employees associated with the site . Water will be provided by
North Weld County Water District for fire hydrant and potable uses. Other water uses
(hydrostatic testing and dust control ) will be negotiated at a later date pending approval
of the USR application . The facility will be serviced by a septic system .
The applicant submitted an Air Pollution Emission Notice (APEN ) to the Air Pollution
Control Division , Colorado Department of Public Health and Environment.
We have no objections to the proposal ; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20- 100 . 5 , C . R.S . , as amended ) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination .
2 . No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100 . 5 , C. R.S . ,
as amended .
3 . Waste materials shall be handled , stored , and disposed of in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions . The applicant shall operate in accordance with
Chapter 14 , Article 1 of the Weld County Code .
4. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
5 . Any contaminated soils on the facility shall be removed , treated or disposed of in
accordance with all applicable rules and regulations. All spills will be reported to
local , state and federal agencies in accordance with all state and federal
regulations.
6 . Fugitive dust and fugitive particulate emissions should attempt to be confined on
the property. Uses on the property should comply with the Colorado Air Quality
Commission's air quality regulations.
7 . Sewage disposal for the facility shall be by septic system . Any septic system
located on the property must comply with all provisions of the Weld County Code ,
pertaining to On-site Wastewater Treatment Systems.
8 . A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
9 . All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants ( HAPs) and volatile organic compounds (VOCs). All
chemicals must be stored securely, on an impervious surface , and in accordance
with manufacturer's recommendations.
10 . A Spill Prevention , Control and Countermeasure Plan , prepared in accordance
with the applicable provisions of 40 CFR, Part 112 , shall be available on site .
11 . This facility shall adhere to the maximum permissible noise levels allowed in the
Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code.
12 . Secondary containment shall be constructed around tanks to provide containment
for the largest single tank and sufficient freeboard to contain precipitation . A
synthetic or engineered liner shall be placed directly beneath each above-ground
tank. Secondary containment shall be sufficiently impervious to contain any spilled
or released material . Secondary containment devices shall be inspected at regular
intervals and maintained in good condition .
13 . The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
14 . The facility shall comply with the Air Pollution Emission Notice (A. P . E . N . ) permit
requirements as stipulated by the Air Pollution Control Division , Colorado
Department of Public Health and Environment, as applicable.

15 . The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E ),
Water Quality Control Division , as applicable .
16 . The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code .

General
E Advisory. The subject property is located within the City of Greeley's Long Range
Expected Growth Area (LREGA). The LREGA is the range in which the community
anticipates development occurring within the coming 20+years. Particular care in site
design is imperative to increase compatibility with the urbanizing nature of this area.
Please see the City-Recommended General Development Standards below for
suggestions.
❑ Advisory. This site is of particular importance due to its location along CR 66. This is
identified as a collector roadway in the City of Greeley's 2035 Transportation Master
Plan. Due to this classification, landscaping should be installed along the frontage to
enhance this major corridor across the community. See the City-Recommended
Landscaping Standards below for suggestions.
City-Recommended General Development Standards
❑ The standard setback for development of this nature in urban areas is 25 feet. All
buildings, parking lots, perpendicular drive aisles, and other structures should adopt a
setback of twenty-five feet from the future required right-of-way to avoid a non-
conforming situation in the future.
E To minimize airborne dust and the tracking of dirt, mud, and gravel onto public
thoroughfares, all drive aisles and parking spaces should be paved in asphalt or concrete.
E Outdoor storage should be completely screened from view of all adjacent roadways and

properties. This can be accomplished through the construction of a solid wall or fence or
the planting of landscaping of sufficient height and variety to provide year-round
screening.
❑ Fences or walls should include variation in appearance at least every 50 feet. This can be
achieved by constructing columns or offsetting the angle.
City-Recommended Landscaping Standards
❑ County Road 66 is identified as a collector roadway through the community.
Landscaping should be installed along this thoroughfare at the following rates:
o Street trees—one shade tree every 35 feet or one shade tree every 25 feet
o Five medium shrubs (4-8 feet tall at maturity)per 100 linear feet
o Ten small shrubs (<4 feet tall at maturity) per 100 linear feet
❑ The proposed use should be buffered from adjacent uses of different intensities to the
south and west. A 15-foot wide landscaped buffer yard should be installed along the
southern and western property lines. This should include one shade tree, one ornamental
tree, and five small shrubs (<4 feet tall at maturity) for every 100 linear feet of frontage
along these property lines.

General Comments
E Advisory. The subject property is located within the City of Greeley Long Range
Expected Growth Area (LREGA). if in the future, water and sanitary sewer service are
requested to the property, then annexation into the City of Greeley will be required prior
to the City of Greeley providing utility service.
E Advisory. The City of Greeley and North Weld County Water District (NWCWD) have
adopted a Water Service Agreement for providing water in this area. Please note that the
City agrees with water service being provided to the property by NWCWD in accordance
with the executed Water Service Agreement; dated February 5th, 2013.
Traffic
E City of Greeley's 2035 Comprehensive Transportation Plan indicates that Weld County
Road 66 will be a 2 lane collector roadway requiring 80' total public right of way (40'
half right of way). Please ensure that the site map calls out the south half of the right of
way for Weld County Road 66. All proposed structures (buildings and paved areas)
should be set back a minimum of 25 feet from the future right of way lines.
