Johnson Tape PC 631 (#2232 - 2360) CASE NUMBER: SUP 306 SUBJECT: Open Cut Gravel Mine APPEARANCE: Mr. Johnson LOCATION: N1/2 Sec. 21 T5N R65W DISCUSSION: Mr. Johnson explained that he started this application last September. The farm is located in the southeast corner of Greeley. He has approval of the State Highway Department and Soil Conservation Service. The water augmentation plan is in Denver.' It has been sibmitted, but the person that needs to sign it has been out of town. Mr. Johnson has 12 shares of water; he only needs 3 shares. Weld County Planning staff recommends that the request be tabled for the following reason: 1 ) The State Engineer, Division of Water Resources, has recommended this application not be approved at this time since material submitted for his review on the water augmentation plan has not been acceptable. Tom Honn explained that the State Geological Survey has reviewed the request and does not see any serious problems. City of Greeley has indicated that the City has no objections to the application. The request complies with the Weld County Extraction Plan. The Engineering Department and Health Department have no objections to the request. Mr. McWilliams explained that Mr. Johnson submitted the additional materials requested by the State Engineer regarding the water augmentation plan last Thursday. The usual procedure of the State Engineer is to take 8 - 10 days to get necessary signatures on materials. However, the State Engineer has indicated that the plan is acceptable. Mr. Johnson explained that has purchased plenty of water strictly for this purpose, and he is willing to comply with any requests the State may have. Mr. Johnson Is working on a tight schedule because the highway contractor is to start on August 1 . Mr. Johnson had deeded two shares of his water from him and his wife to him and his wife. Kay McEver explained that Page 1299 he has been asked to have the water adjudicated through the water courts because that is the only "enforceable" agreement. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request, subject to Mr. Johnson obtaining approval of the water augmentation plan prior to advertisement for the County Commissioner' s hearing, and subject to staff and legal recommendations. Motion by Bill Elliott. Seconded by Percy Hiatt. A vote of "aye" by Yost, Kountz, Elliott, Heitman, and Hiatt. MOTION CARRIED. APPLICANT: John Hochmiller PC 631 (#2360 - 2431 ) CASE NUMBER: SUP 311 SUBJECT: Junk Yard APPEARANCE: Mr. Hochmiller LOCATION: Pt. NE4 Sec. 32 T3N R65W DISCUSSION: Mr. Hochmiller explained that he plans to open a salvage yard. He plans to put a mobile home on it and live in it for the time being. Later he will build a residence and office structure. The property is zoned heavy industrial at this time. Is an existing wrecking yard on the property next door. The property contains 80 acres but Mr. Hochmiller plans to store cars on only 40 acres. Mr. Hochmiller will run this business himself. Mr. Hochmiller will use a 5-foot berm for a buffer. He has recommendations from the Soil Conservation Service regarding what type of trees to plant. The Weld County Planning staff recommends approval for the following reasons: 1 ) The request is in compliance with the permanent industrial zoning which was granted on November 12, 1969, by the Board of County Commissioners; and 2) The Weld County Health Department recommended approval of the request. COMMENT: No response was received from the Weld County School District RE-1 . RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners, approval of this request, subject to the development standards. Seconded by Marge. Yost. SW4 Sec. 2 T5N R67W DISCUSSION: Mr. Hertzke explained that this is a relocation of their present dairy to five miles west of town. One reason is because the City keeps "hassling them" and they also wish to increase the number of milking cows from 125 to 250. Mr. Herzke's father has 1 ,000 acres of irrigated property which makes it a natural place for feeding, purchasing, etc. He proposes two residences with the possibility of a third one in a few years. No storage of junk cars or trucks shall take place within the 500 foot setback from the edge of the right-of- way of County Road 28 as shown hereon. 2. The following structures shall be allowed to locate within the 500 foot setback: a. one 40' x 100' repair shop building, and b. one 20' x 44' mobile home until said mobile home can be replaced by a uniform building code home and office structure. 3. Security shall be provided by: a. managers living on-site to provide 24 hour security, b. a 6 foot chain link fence shall be constructed around the entire perimeter of the junk storage area as shown hereon, and c. guard dogs. 4. Landscaping shall be as follows: a. a 4'- 5' high berm shall be located immediately north of the junk storage area within the 500' buffer setback as shown hereon, b. a wind break shall be placed at the berm in accordance with the recommendations of the Soil Conservation Service, c. the berm and the balance of the 500 foot buffer setback shall be seeded in compliance with the Soil Conservation Service recommend- ations, and d. the Special Use Permit area shall be maintained in such a manner as to prevent fugitive dust, soil erosion, and the growth of noxious weeds. 5. The one access onto County Road 28 shall not require a culvert, but shall be built with a 50' radius. Said access road shall be graveled with 3/4" (washed) gravel 4" deep. . r 6. Construction shall begin within one year of approval by the Board of County Commissioners, or the Board of County Commissioners may take action to revoke this Special Use Permit. 7. The sewage disposal system shall conform to applicable County and State Health Regulations. 8. A cistern with a holding capacity of 2,000 gallons of water shall be installed in the area adjacent to the mobile home and shop building. Said cistern shall have an 18" manhole cover. 9. The SUP shall be limited to the plans submitted and governed by the development standards stated above. Any changes to the plans and/or the development standards shall require approval of another SUP before such changes shall be allowed. Hochmiller Development Standards 6. Air Pollution `-f None to very llitle. Acetyline cutting torches for the dismantling of wrecked cars produces very little air pollution. Water Pollution None to our knowledge. Auto scrapping operations do not use water r other than for restroom facilities. Of course, there will be domestic water use And a septic system, etc. Fire Hazard Our operation will have appropriate type of fire extinguishers for the metal and parts worked on. Noise Pollution None to very little. The removing of salvage parts from a car involves mainly the use of wrenches which are not noisy. Odor Pollution As far as we know, there is no organic material in a metal op- eration to rot or decay and produce odor. Glare Pollution The only glare might be from the windshields of the parked cars which will be mostly concealed from roadway. Traffic We estimate it will take approximately five years to completely develop this property as an "in use' wrecking yard. In the be- ginning, we will possibly have one or two employees in addition to the party living on the premises . Starting traffic would probably be ten to fifteen cars daily including our hauling in vehicles and up to possibly fifty or sixty cars daily at the end of the five year period or when fully developed. The soils are classified as Vona Sandy Loam. These soils have a poor water holding capacity and are highly susceptible to wind and water erosion. Side Oats Grams and Yellow Sweetciover would be the best probable species for your situation. I would seed the Side Oats Grams at 20-25 pounds per acre and the Sweetclover at 3 pounds per acre. The slopes of the berm should be mulched with straw at the rate of 4,000 pounds per acre. I would recommend one row of Russian Olive and one row of Rocky Mountain Juniper or Eastern Red Cedar for the tree planting. These trees should be spaced 8-10 feet apart in the rows and 16-20 feet apart between the rows. I hope I have been of assistance to you.
