RE: CHANGE OF ZONE, COZ16-0001, FROM THE A (AGRICULTURAL) ZONE DISTRICT
TO THE I-1 (INDUSTRIAL) ZONE DISTRICT - ANDREW HOP
A public hearing was conducted on July 13, 2016, at 10:00 a.m.. with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated May 27. 2016. and duly published
June 1. 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of
Andrew Hop. for a Change of Zone. COZ16-0001. from the A (Agricultural) Zone District to the
I-1 (Industrial) Zone District. Bob Choate. Assistant County Attorney. made this a matter of record.
Chris Gathman. Department of Planning Services, presented a brief summary of the
proposal and described the existing dairies on -site and the applicant's intent to operate the
existing dairies until the property is developed for the Industrial use. Based on the intent to operate
the dairies after the COZ to I-1 (Industrial), the operation of these dairies would need to be
approved as a non -conforming use. Mr. Gathman described the Industrial uses in the surrounding
area and pointed out the road infrastructure in the area to support the COZ. He stated there were
15 referrals sent out and 11 responses received and he did review the comments from the Town
of Kersey regarding annexation and the original application request to Change the Zoning to
1-3 (Industrial). Mr. Gathman explained that per the Town of Kersey. the applicant relented to
request the Change of Zone to the I-1 (Industrial). which has no outdoor storage. He displayed
images of the site and surrounding areas and entered the favorable recommendation of the
Planning Commission into the record, as written. In response to Commissioner Cozad, Mr.
Gathman explained that the applicant changed the request midway through the process,
modifying the request from 1-3 (Industrial) to I-1 (Industrial).
Janet Lundquist. Department of Public Works representative. provided a brief overview of
the transportation plans and requirements and stated the applicant has an approved Access
Permit. AP16-00109. She explained the site has numerous accesses and the development to I-1
(Industrial) will assist with closing some of these in the future.

Hayley Brown, Planning Services Engineer representative, presented the drainage and
grading requirements to include the requirement that the applicant submit information regarding
easements or right -of ways and they must maintain historical flow patterns and amounts.
a Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated individual taps from Central Weld County Water District will provide water
and engineered commercial septic systems will be installed when the business entity develops
this site. She reviewed the typical Environmental Health items and stated there are no concerns
with this site.
Tim Naylor, AGPROfessionals, represented the applicant and displayed a PowerPoint
presentation to explain the applicant's intent regarding the Change of Zone to better position the
property for future market conditions. He stated the application meets the requirements and is
adjacent to an I-1(Industrial) property in Kersey. He reviewed the meeting with the Town of Kersey
and explained the request for no outdoor storage which is what triggered the change of request
to the I-1 (Industrial) zone change. Mr. Naylor described the beneficial road infrastructure that is
available and reviewed the compatibility with surrounding properties and the Town of Kersey
which is considering annexation in the future. He stated the Town Manager for Kersey is
supportive. there are adequate utilities available. and the site is not in a Geologic Hazard area or
floodplain.
No public testimony was offered concerning this matter.
In response to Chair Freeman, Mr. Naylor indicated they have reviewed, and agree to abide
by, the Conditions of Approval.
Commissioner Cozad moved to approve the request of Andrew Hop for a Change of Zone.
COZ16-0001. from the A (Agricultural) Zone District to the I-1 (Industrial) Zone District. based on
the recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval as entered into the record. The motion was seconded by Commissioner Moreno, and it
carried unanimously. There being no further discussion, the hearing was completed at 11:20 a.m.
