The Weld County Department of Planning Services -Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.

This project is west of and adjacent to CR and is south of CR 6.

Drainage Requirements:
The applicant has hired Mark Taylor to calculate the cfs values coming off the site to determine if it
meets the exception shown below. According to the narrative the site qualifies for the exception.
Nothing further is required.

URBANIZING VS NON -URBANIZING DRAINAGE AREA:
This area IS within a Non -Urbanizing Drainage Area:
Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of
the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for
NON -URBANIZING areas.
Exceptions.
1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and
welfare of public and private property. Exceptions shall be supported with a drainage
narrative.
a. No stormwater detention will be required for sites that meet any of the following
conditions. Requirements of the Municipal Separate Storm Sewer System (MS4)
areas remain applicable.
10) NON -URBANIZING areas where the total project stormwater runoff of less
than, or equal to, 10 cfs for the 1 -hour, 100 -year, storm event.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact a Engineering representative from the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-
3575.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. The plan shall be amended to delineate the following:
1. The applicant shall show and label the drainage flow arrows. (Department of Planning Services -
Engineer)
2. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Department of Planning Services -Engineer)
Prior to Construction:
A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for any Use permitted as a
Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or
Industrial Zone Districts (metal fabrication shop and blacksmithing shop), provided that
the property is not a lot in an approved or recorded subdivision plat or lots parts of a
map or plan filed prior to adoption of any regulations controlling subdivisions in the A
(Agricultural) Zone District.
A septic permit was issued April 1, 2016 for the shop. The system was designed to
accommodate 10 people and the septic application indicates an individual well will
provide water. Although the USR application states a cistern will provide water that is
not allowed unless no other water source is available.
The USR application indicates that approximately 10 to 12 employees will access the
site. A portable toilet and bottled water can be used for employees who are on site for 2
consecutive hours or less and 2 or less full time employees on site. A septic system will
be required when the number of full time employees exceeds two.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.

3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,
and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations.
5. The facility shall adhere to the maximum permissible noise levels
allowed in the Commercial Zone as delineated in 25-12-103 C.R.S.
6. Adequate drinking, hand washing and toilet facilities shall be provided
for employees, at all times. For employees or contractors on site for
less than 2 consecutive hours a day, and 2 or less full time employees
on site, portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. Any septic system located on the property must comply with all
provisions of the Weld County Code, pertaining to On -site Wastewater
Treatment Systems.
8. A permanent, adequate water supply shall be provided for drinking and
sanitary purposes.
9. Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of
installation, maintenance, and proper disposal shall be retained.
10. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

Dear Mr. Enyart:
The Fire Prevention Bureau has reviewed your submission to Weld County and have the
following comments:
1. If there is going to be an entrance gate, a Knox pad lock or key switch will need to be installed
for emergency access.
2. Fire access roads must be constructed of an approved driving surface capable of supporting the
imposed load of fire a fire apparatus weighing at least 75,000 lbs. The bridge over Brighton
Ditch will need to be designed and installed to support 75,000 lbs. Documentation of such will
need to be provided from an engineer.
3. Fire access roads shown on site plan appear to meet unobstructed width requirement. Please
ensure an unobstructed vertical distance of 13 feet 6 inches is maintained.
4. The turn -around shown on the site plan appears to be adequate for fire apparatus needs.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a Site Specific Development Plan and Use by Special Review Permit for a
metal fabrication shop and blacksmith shop on a 2.61 acres located in the NW 1/a of the NW 1/4
of Section 25, Township 1 N, Range 67W, of the Sixth PM, also known as Lot A of the recorded
exemption no. RECX14-0046. According to the information in the referral material domestic
water to the property will be provided by a 2000 gallons cistern and irrigation will be
provided by an existing well operating under permit no. 294251.
According to our records, permit no. 294251, was late registered in accordance with C.R.S. 37-
92-602(5) on May 8, 2014 for the historical use of this well, being a well producing being 14 GPM
and used for ordinary household purposes inside 2 single family dwelling(s), fire protection, the
watering of livestock, domestic animals and poultry, and the irrigation of not more than 1 acre
of home gardens and lawns.
Although this office does not have an objection to the proposed cistern for the domestic water
use the Applicant must clarify the source of water for the cistern. If the source of water for the
cistern is the existing well no. 294251, we note that, as permitted well permit no. 294251
cannot be used for the proposed commercial business on the property. As listed above the use
of the ground water for this well (domestic and irrigation) is associated with the residential
site. Any expansion beyond the limitation on permit no. 294251 would require that the
Applicant obtains a new commercial well permit. This office cannot guarantee the issuance of

any well permit; any well permit application for the property will be evaluated at the time it is
received in this office.
