HomeMy WebLinkAbout20160311.tiff RESOLUTION RE: GRANT APPEAL OF THE DECISION OF THE DEPARTMENT OF PUBLIC WORKS CONCERNING AN APPLICATION FOR ACCESS PERMIT - SHARI AND DUANE NAIBAUER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has received an appeal from Shari and Duane Naibauer, concerning the decision by the Department of Public Works to deny an Access Permit, for an additional access for the new Lot A in relation to Recorded Exemption, RECX15-0169, and WHEREAS, upon consideration of such appeal, including a review of all information submitted by the appellant and the Department of Public Works, the Board deems it advisable to grant the appeal of Shari and Duane Naibauer, and thereby approve and issue Access Permit, AP16-00009. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the appeal of Shari and Duane Naibauer, be, and hereby is, granted and the decision of Department of Public Works be, and hereby is, amended to approve and issue Access Permit, AP16-00009. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 20th day of January, A.D., 2016. The applicant is requesting an additional access point off of CR 52 east of CR 53 . CR 52 is a local roadway . The denial for the access request is due to the following : 1 . The access would be a net increase of accesses . The parcel was created through the recorded exemption process . There were four accesses for the remaining lot that is now being divided in the new recorded exemption RECX15-0169 . The original accesses were created prior to the Board of County Commissioners adopting the Road Access Policy in 2009 . This request would increase the combined access points to five access points for the original approve recorded exemption . Please see attached letter from the applicant, aerial map and access permit materials . The Weld County Code language is listed below: Sec . 12-5-30. Regulation of access onto County roadways . A . One access per lot. Direct access from a public road shall be limited to not more than one ( 1 ) per legal lot, except as may be expanded or further limited or restricted by the Board of County Commissioners or staff, as a result of zoning requirements , consideration in land use applications , safety considerations , subdivision regulations , or inability to meet minimum requirements as defined in the Weld County Design Criteria . E . Additional access . If a new access is requested to a legal parcel where an existing access already exists , the additional access shall not be approved unless the denial of the new access creates undue hardship on the property owner, as determined by the Department of Public Works . Whenever multiple accesses to a single legal parcel exist , and additional accesses are requested , one ( 1 ) or more existing accesses must be removed , minimizing new accesses and utilizing existing accesses . 2016-0311 Page 1 of 1 O :\JANET\Access Handouts & Letters\Access Permit Denial 011416.docx 7c7 Weld County Public Works Department c/o Permits Group 1111 H Street Greeley, CO 80632 To Janet Lundquist: We would like to request an appeal for the denial of the additional access point for the new lot of Recorded Exemption RECX15-0169. The property is currently owned by Jim and Pauline Fagnant. My wife and I have a vacant land contract with the Fagnant's for the new lot, we are going to build a new home on the lot. I know that the Fagnant's have four existing accesses two paved accesses for their residence and PDC Energy has two access to a tank battery and gas separation unit. The following is a list of my concerns and justification of why we need an additional access for the new lot. • This would be the only access to my property when the RE and land purchase is completed . • CR 52 a low volume road with traffic having to stop at T- Intersection with stop sign controlling traffic onto CR 53 . This makes the speeds in front of the lot slower than in other areas of the roadway. • The sight distance along the new lot are over 1000 ft to the west and 4300 ft to the east, which exceeds the amount required by Public Works. • This access would not affect road side drainage as there are no culverts in any of the accesses on the south side of CR 52 . I would be happy to install a driveway culvert in the future if improvements are made to CR 52 . • The only way to close one of the existing accesses to ensure "no net increase" of accesses would require fencing to be installed along CR 52 . There isn't a borrow ditch or separation from the road to the property. The amount of fencing would be expensive . • Anytime work is being perform at the PDC facility, access will be blocked to my lot. This is due to the layout of the current facility. This could be a safety issue for me and my family. • I am willing install the access anywhere along the lot frontage to make sure we are meeting any spacing requirements and to make sure the access is safe . For the reasons listed above we are requesting that you overturn the decision by Public Works Staff and grant us a new access for our new lot.
