Environmental Health Services has reviewed this proposal for an Amendment to a Site
Specific Development Plan and Use by Special Use Permit No. USR-1459 (for any use
permitted as a Use by Right, and Accessory Use, or a Use by Special Review in the
Commercial Zone Districts (vehicle sales, service, and detailing provided that the
property is not a lot in an approved or recorded subdivision plat or lots part of a map or
plan field prior to the adoption of any regulations controlling subdivisions) to include an
additional building and expand the current business for automotive service in the A
(Agricultural) Zone District.
There will be up to 6 full-time employees that utilize the site along with 5-7 visitors daily.
Water is provided by a commercial well (Permit # 254153). The property has an existing
septic system that services the site (SP -0400379). The septic system is sized for 4
employees. If the use of the septic system exceeds the sizing limitations, the system
must be reviewed by a register engineer for the additional hydraulic load.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste in
the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as
amended.
3. Waste materials shall be handled, stored, and disposed of in a manner that

controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust and fugitive particulate emissions should attempt to be confined on
the property. Uses on the property should comply with the Colorado Air Quality
Commission's air quality regulations.
5. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
6. Any contaminated soils on the facility shall be removed, treated or disposed of in
accordance with all applicable rules and regulations. All spills will be reported to
local, state and federal agencies in accordance with all state and federal
regulations.
7. Secondary containment shall be constructed around tanks to provide containment
for the largest single tank and sufficient freeboard to contain precipitation.
Secondary containment shall be sufficiently impervious to contain any spilled or
released material. Secondary containment devices shall be inspected at regular
intervals and maintained in good condition. All secondary containment will comply
with the provisions of the State Underground and Above Ground Storage Tank
Regulations.
8. Adequate drinking, hand washing and toilet facilities shall be provided for employees
and patrons of the facility, at all times. If employees or contractors are on site for
less than 2 consecutive hours a day portable toilets and bottled water are
acceptable. Records of maintenance and proper disposal for portable toilets shall
be retained on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be serviced by
a cleaner licensed in Weld County and shall contain hand sanitizers.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to On -site Wastewater Treatment Systems. A
permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10. Process wastewater (such as floor drain wastes) shall be captured in a watertight
vault and hauled off for proper disposal. Records of installation, maintenance, and
property disposal shall be retained.
11.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling. All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
12. The facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S.
13. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit Application and obtain a permit from the Air Pollution Control
Division, Colorado Department of Public Health and Environment, as applicable.
14. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
15. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
16.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

An access permit has been approved for the access to the site (AP16-00353).
AP16-00353 Special Requirements or Comments:
"Parcel 130920000041. Utilize existing shared access point on CR 20 (1 -Small Commercial) located
approx. 360 ft. East of Hwy 85."
For shared accesses, Public Works strongly recommends that the property owner establish an access road
maintenance agreement so future owners of the properties will be aware of their requirements for shared
maintenance of the access road. This is not a requirement for the recorded exemption but is recommended
to avoid property owner conflicts in the future.
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users.
Roads:
County Road 20 is a gravel road and is designated on the Weld County Road Classification Plan as a local
road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site plan
the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way.
This road is maintained by Weld County.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state
highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify
the access permit or for any additional requirements that may be needed. (State Highway 85)
Traffic:
Latest ADT on CR 20 was taken on 10/16/2014 which counted 229 vpd with 33% trucks.
The traffic information submitted with the application materials indicated that there will be approximately 15
daily roundtrips.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
Less than 20 passenger vehicle round trips/day, no upfront tracking control requirements.
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
*** Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
A development standard will be included on the recorded site plan. "The access shall be maintained to
mitigate any impacts to the public road including damages and/or offsite tracking."
Improvements and Road Maintenance Agreement:
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day
or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard
will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The
access on the site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking.
CONDITIONS OF APPROVAL:
A. The plan shall be amended to delineate the following:

the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for
NON -URBANIZING areas.
Detention pond waived and a simple drainage narrative:
A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for
an exception to detention requirements listed below.
The applicant has submitted an acceptable drainage narrative stating that they meet 1.A.10 Non -Urbanizing
areas where the total project stormwater runoff of less than or equal to 10 cfs for the 1 -hour, 100 -year,
storm event. This narrative was written, signed and stamped by Elliot De Jongh, PE #48296 with
THEngineering, LLC.
MS4:
This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized
area with state mandated, higher water quality requirements
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact a Engineering representative from the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:

Geologic Hazard Area:

The Fire District has following comments from the submitted MJUSR plans for the expansion of
the County Truck and Auto facility located south of and adjacent to CR 20; East of and adjacent
to State Highway 85. The plans were reviewed for compliance with 2012 International Fire
Code (IFC) as adopted by the Fort Lupton Fire Protection District and the Weld County
Commissioners.
Construction Documents
Three (3) sets of construction documents (site, civil, architectural, electrical, mechanical,
plumbing, and fire alarm shop drawings) shall be submitted to the Fort Lupton Fire Protection
District for review and approval prior to construction. Please visit

Modifications
An approved water supply capable of supplying the required fire flow for fire protection shall be
provided to premises upon which facilities, buildings or portions of buildings are hereafter
constructed or moved into or within the jurisdiction. 2012 IFC 507.1
Whenever there are practical difficulties involved in carrying out the provisions of this code, the
fire code official shall have the authority to grant modifications for individual cases, provided the
fire code official shall first find that special individual reason makes the strict letter of this code
impractical and the modification is in compliance with the intent and purpose of this code and
that such modification does not lessen health, life and fire safety requirements. The details of
action granting modifications shall be recorded and entered in the files of the department of fire
prevention. 2012 IF C104.8
a. The Fort Lupton Fire Protection District understands that having the applicable
water supply (2,250 gpm for 2 hours) and fire hydrants (2) required by Appendix B and C of the
2012 IFC for an 11,000ft2 Type IIB (steel) building would be financially impracticable because
there is no sustained water supply close to the site.
b. The Fort Lupton Fire Protection District is using Section 104.8 to require a
monitored commercial fire alarm in accordance with National Fire Protection Association
Standard 72 in lieu of the required water supply and fire hydrants.

Fire Service Features
Address:
New buildings shall have approved address numbers placed in a position that is plainly legible
and visible from the street or road fronting the property. These numbers shall contrast with their
background. Address numbers shall be Arabic numbers or alphabetical letters. Numbers shall be
a minimum of 4 inches (101.6 mm) high with a minimum stroke width of 0.5 inch (12.7 mm).
Address numbers shall be maintained. 2012 IFC 505.1
Fire Apparatus Access Roads:
Approved fire apparatus access roads shall be provided for every facility, building or portion of a
building hereafter constructed or moved into or within the jurisdiction. The fire apparatus access
road shall comply with the requirements of this section and shall extend to within 150 feet of all
portions of the facility and all portions of the exterior walls of the first story of the building as
measured by an approved route around the exterior of the building or facility. 2012 IFC 503.1.1
Fire apparatus access roads shall have an unobstructed width of not less than 20 feet, exclusive
of shoulders, except for approved security gates in accordance with Section 503.6, and an
unobstructed vertical clearance of not less than 13 feet 6 inches. 2012 IFC 503.2.1
The road surface and road maintenance stated in the dust abatement plan meets the requirements
for road surface. 2012 IFC 503.2.3
The required turning radius of a fire apparatus access road shall be 19' 5" inside and 44' 2" wall
to wall (see attached turning radius template). 2012 IFC 503.2.4
If security gates are installed, they shall have an approved means of emergency operation. The
security gates and the emergency operation shall be maintained operational at all times. Electric
gate operators, where provided, shall be listed in accordance with UL 325. Cates intended for
automatic operation shall be designed, constructed and installed to comply with the requirements
of ASTM F 2200. 2012 IFC 503.6.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a Site Specific Plan, an amendment to a site specific development plan
and use by special use permit no. USR-1459 to add a building to an existing automotive
business. The existing business provides truck and auto sales along with service work to
vehicles. The existing business will be expanded to a total of 5 to 7 customers and 4 to 6
employees daily from 7:30 am to 6:00 pm. There is an existing well (permit no. 254153) and
septic system that will continue to serve the property, though employees currently drink
bottled water. Some landscaping around the business is proposed, though no details were
provided. The application materials indicate that the existing home on the site will be used
for storage purposes; it is unclear if tenants will continue to occupy the home.
Well permit no. 254153 was issued on November 11, 2013 pursuant to Section 37-92-
602(3)(b)(I) and the policy of the State Engineer dated April 9, 1985 to use an existing well for
drinking and sanitary purposes inside a commercial business at a rate of 15 gpm. Water from
the well should not be used for lawn or landscape irrigation, or for any other purposes outside
the business building structure. Annual withdrawal from the well is limited to 1/3 acre-foot
of water per year; a totalizing flow meter is required on this well.
The commercial uses described in the application materials appear to fit within the limits of
well permit no. 254153, however at no point should this well be used for any landscape
watering or other irrigation on the property. Should landscape development be required as a
part of the county permit, the applicant must obtain irrigation water from a legally available

source. It is unclear if the existing house on the property will continue to be occupied.
Pursuant to the State Engineer's Policy 2011-3, the applicant may use well permit no. 254153
for household drinking and sanitary purposes in addition to uses at the commercial business,
so long as the total amount of water used for the commercial and household uses does not
exceed the 1/3 acre-foot limit on the well permit; at no point should the well be used for
outdoor household uses such as lawn and garden irrigation.
So long as the applicant follows the conditions of permit no. 254153 and maintains diversion
records from the well, this office has no objections to this proposal. If you, or the applicant,
