BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MAY 9, 2016
The Board of County Commissioners of Weld County . Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building , Greeley, Colorado , May 9 . 2016 , at the hour of 9: 00 a . m .
P ROLL CALL : The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Mike Freeman , Chair
Commissioner Sean P. Conway , Pro-Tern - EXCUSED
Commissioner Julie A. Cozad
Commissioner Barbara Kirkmeyer - EXCUSED
Commissioner Steve Moreno

P MINUTES : Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of May 4 . 2016 , as printed . Commissioner Cozad seconded the motion , and it
carried unanimously.
2 CERTIFICATION OF HEARINGS : Commissioner Cozad moved to approve the Certification of
Hearings conducted on May 4 . 2016 , as follows : 1 ) USR16-0007 - Hans Wimmer, and 2) USR16-0006
- Red Oilfield Services . LLC . Commissioner Moreno seconded the motion , which carried unanimously.
AMENDMENTS TO AGENDA : There were no amendments to the agenda .
P CONSENT AGENDA : Commissioner Moreno moved to approve the Consent Agenda as printed .
Commissioner Cozad seconded the motion , and it carried unanimously.
PUBLIC INPUT: No public input was given .
BIDS :
L- 1 ) PRESENT BID #B1600088 . CRUSHED AGGREGATE TYPE II ( 1 /2" CHIPSEAL) -
DEPARTMENT OF PUBLIC WORKS : Trevor Jiricek. Director of General Services , presented the sole
bid received and stated staff will make a recommendation on May 23 . 2016.

2) PRESENT BID #B1600098 . ION CHROMATOGRAPHY SYSTEM - DEPARTMENT OF PUBLIC
HEALTH AND ENVIRONMENT: Mr. Jiricek presented the three (3) bids received and stated staff will
bring back a recommendation on May 23 , 2016 .
NEW BUSINESS :
1 ) CONSIDER TWO (2) AGREEMENTS FOR PURCHASE OF IN-HOME SERVICES AND
AUTHORIZE CHAIR TO SIGN : Judy Griego, Director of Department of Human Services , presented the
terms for the two (2) agreements for In-home services . Commissioner Moreno moved to approve said
agreements and authorize the Chair to sign . The motion was seconded by Commissioner Cozad , and it
carried unanimously.
2 ) CONSIDER STANDARD FORM OF AGREEMENT FOR BUILD PHASE OF 822 7TH ST.
BUILDING REMODEL (BID #B1500177) AND AUTHORIZE CHAIR TO SIGN - GROWLING BEAR .
COMPANY . INC : Toby Taylor. Director of Buildings and Grounds . reviewed the details of the agreement
for the build phase . Commissioner Cozad moved to approve said agreement and authorize the Chair to
sign . Seconded by Commissioner Moreno , the motion carried unanimously.
3) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY
FOR IMPROVEMENTS TO INTERSECTION OF CR 47 AND STATE HIGHWAY 392 AND AUTHORIZE
CHAIR TO SIGN ANY NECESSARY DOCUMENTS - C . ALLAN AND CINDI HUNT: Tiffane Johnson .
Department of Public WorkS , presented the terms of the agreement for the amount of $ 1 , 650. 00 .
Elizabeth Relford , Department of Public Works , explained the local agency has requirements to secure
the right-of-way when there is a project with CDOT . Commissioner Moreno moved to approve said
agreement and authorize the Chair to sign all necessary documents . The motion , which was seconded
by Commissioner Cozad , carried unanimously .
0- 4) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR WELD COUNTY VS .
DECHANT CONDEMNATION LITIGATION AND AUHTORIZE CHAIR TO SIGN - DON OSTRANDER :
Bob Choate , Assistant County Attorney, stated this agreement will allow Don Ostrander to provide
outside counsel at his current rates . Commissioner Cozad moved to approve said agreement and
authorize Chair to sign . The motion was seconded by Commissioner Moreno . and it carried
unanimously.
5) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY , APPROVE
SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES , AND DELEGATE AUTHORITY TO
CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS : Chris D'Ovidio, Senior Accountant,
reviewed the items that need to be declared surplus and go to auction May 13, 2016 . Commissioner
Moreno moved to declare said equipment as surplus property and delegate authority to the Controller
to sign any necessary documents . The motion , which was seconded by Commissioner Cozad , carried
unanimously .
PLANNING :
a 1 ) FIRST READING OF CODE ORDINANCE #2015-25 , IN THE MATTER OF REPEALING AND
REENACTING WITH AMENDMENTS , CHAPTER 23 ZONING (WATER LINES) . OF THE WELD
COUNTY CODE : Commissioner Cozad moved to read Code Ordinance #2015-25 by title only. It was
seconded by Commissioner Moreno , and the motion carried unanimously. Bruce Barker, County
Attorney, read the title for the record . Tom Parko. Director of Planning Services. recommended
continuing this matter to have a full Board present. and he also requested to remove reference to 1041
regulations from the title. No public testimony was offered concerning this matter. Commissioner Moreno

moved to continue this matter to May 16, 2016 . The motion was seconded by Commissioner Cozad ,
and it carried unanimously.
V 2) SECOND READING OF CODE ORDINANCE #2015-26, IN THE MATTER OF REPEALING
AND REENACTING, WITH AMENDMENTS , CHAPTER 23 ZONING (OIL AND GAS) . OF THE WELD
COUNTY CODE (CON'T FROM 2/29/2016Commissioner Cozad moved to read Code Ordinance #2015-
26 by title only and , seconded by Commissioner Moreno, the motion carried unanimously. Mr. Barker
read the title for the record . Mr. Parko recommended continuing this matter after the stakeholder
meeting . Dan Haley, president of the Colorado Oil and Gas Association , explained to the Board that he
feels there needs to be more time to investigate the impacts on the USR . Commissioner Cozad moved
to continue second reading to June 1 , 2016 . and final reading to June 20 , 2016. Seconded by
Commissioner Moreno, the motion carried unanimously.
P 3) FINAL READING OF CODE ORDINANCE #2016-02, IN THE MATTER OF REPEALING AND
REENACTING WITH AMENDMENTS , CHAPTER 19 COORDINATED PLANNING AGREEMENT
(KERSEY) , OF THE WELD COUNTY CODE : Commissioner Moreno moved to read Code Ordinance
#2016-02 by title only. The motion was seconded by Commissioner Cozad . and it carried unanimously.
Mr. Barker read the title for the record . Mr. Parko stated that no changes have been made since second
reading . No public testimony was offered concerning this matter. The motion to approve on Final
Reading , which was made by Commissioner Cozad and seconded by Commissioner Moreno , carried
unanimously. Commissioner Cozad extended her appreciation to Mr. Parko for working with the
communities to get all the agreements completed .
4) SECOND READING OF CODE ORDINANCE #2016-06. IN THE MATTER OF REPEALING
AND REENACTING WITH AMENDMENTS , CHAPTER 20 IMPACT FEES , OF THE WELD COUNTY
CODE: Commissioner Cozad moved to read Code Ordinance #2016-06 by title only. The motion was
seconded by Commissioner Moreno. and it carried unanimously. Mr. Barker read the title for the record .
Mr. Parko stated there have been no changes made since first reading . No public testimony was offered
concerning this matter. The motion to approve on Second Reading , which was made by Commissioner
Moreno, and seconded by Commissioner Cozad . carried unanimously.
RESOLUTIONS AND ORDINANCES : The resolutions were presented and signed as listed on the
Consent Agenda . Code Ordinance #2016-02 was approved on Final Reading and Code Ordinance
#2016-06 was approved on Second Reading .

Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
