Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of April 13, 2016, as printed. Commissioner Cozad seconded the motion, and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner Conway moved to read Code Ordinance#2016-06 by audio. Commissioner Kirkmeyer seconded the motion, which carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of Hearings conducted on April 13, 2016, as follows: 1) USR16-0004 - Michelle Wilson, 2) USR15-0069 - Jerre Bradt and Billee Rosenthal, do Sterling Energy Investments, 3) USR15-0070 - Clyde and Janice Hemberger, do Sterling Energy Investments, LLC, 4) USR15-0071 - Jerrie White, c/o Sterling Energy Investments, LLC, and 5) USR15-0072 - John Johnson, do Sterling Energy Investments, LLC. Commissioner Conway seconded the motion, which carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PUBLIC INPUT: No public input was given. Minutes, April 18, 2016 2016-1326 Page 1 BC0016 BIDS: • 1)APPROVE BID#B1600072, ROOF TOP UNIT (1551 N 17TH AVE BUILDING) - DEPARTMENT OF BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, presented the four (4) bids received and stated staff recommends awarding the bid from Reliant Heating and Air Conditioning for the amount of $54,800.00. Commissioner Cozad moved to approve said low bid. Seconded by Commissioner Conway, the motion carried unanimously. NEW BUSINESS: 1) CONSIDER MEMORANDUM OF UNDERSTANDING FOR STATE LOW INCOME ENERGY ASSISTANCE PROGRAM (LEAP) AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of Department of Human Services, reviewed the contract that will allow the County to opt out of the statewide contract and select an outside vendor. Commissioner Moreno moved to approve said memorandum of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 2) CONSIDER CONTRACT AMENDMENT #1 FOR COLORADO COMMUNITY RESPONSE GRANT AND AUTHORIZE CHAIR TO SIGN: Commissioner Cozad stated the grant is to provide voluntary services to families that have been in connection with the Department of Human Services. Commissioner Conway moved to approve said amendment and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. • 3) CONSIDER CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2015-25268) FOR PARCEL #0961-21-0-00-096: John Lefebvre, Weld County Treasurer, stated the erroneous tax assessment was placed on a mobile home that was completely destroyed by fire and the Treasurer's Office needs to write off $81.80, which includes accrued interest. Commissioner Conway moved to approve said cancellation of tax lien. The motion,which was seconded by Commissioner Moreno, carried unanimously. • 4) CONSIDER ADJUSTMENT OF TAX LIEN SALE CERTIFICATE (TS CERT 2003-1882) FOR PARCEL #0803-32-3-02-002: Mr. Lefebvre stated this is for a mobile home the planning department ordered to have it removed and it was removed but the back taxes need to be paid in the amount of $622.22. Mr. Lefebvre explained they are meeting with planning staff to update some of the processes so these taxes will not fall thru the cracks. Commissioner Cozad moved to approve said adjustment of tax lien certificate. The motion was seconded by Commissioner Conway, and it carried unanimously. I 5) CONSIDER GRANT AGREEMENT FOR VICTIM/WITNESS SOFT INTERVIEW AND TECH IMPROVEMENTS AND AUTHORIZE CHAIR TO SIGN: Jennifer Oftelie, Sheriff's Office, explained this grant will help off-set the monthly CiviCore database fees. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously. 6) CONSIDER REVOCABLE LICENSE AGREEMENT FOR USE OF CHASE PLAZA FOR EVENTS AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY: Toby Taylor, Director of Buildings and Grounds, presented the agreement between the City of Greeley and Weld County for the City of Greeley to use the Plaza for after-hours events. Commissioner Kirkmeyer moved to approve said revocable license agreement and authorize the Chair to sign. Commissioner Conway seconded the motion, and it carried unanimously. I 7) CONSIDER AGREEMENT FOR PARKING AND AUTHORIZE CHAIR TO SIGN - CITY OF Minutes, April 18, 2016 2016-1326 Page 2 BC0016 GREELEY: Mr. Taylor reviewed the agreement for the County to purchase permits for forty (40) parking spaces to be used by County employees during business hours. Commissioner Kirkmeyer moved to approve said agreement and authorize Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. • 8) CONSIDER RENEWAL APPLICATION FOR A RETAIL LIQUOR STORE LICENSE AND AUTHORIZE CHAIR TO SIGN - CROW VALLEY LIQUORS, LLC, DBA CROW VALLEY LIQUORS: Frank Haug, Assistant County Attorney, presented the renewal application and noted the Sheriffs Office reported there have been no calls for service, and recommended approval. Commissioner Moreno moved to grant said license renewal and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously. • 9) CONSIDER RENEWAL APPLICATION FOR A TAVERN LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - DEWEY'S BAR AND GRILL, LLC, DBA DEWEY'S BAR AND GRILL: Mr. Haug reviewed the renewal application and noted the Sheriffs Office reported there have been no calls for service, and recommended approval. Commissioner Kirkmeyer moved to grant said license renewal and authorize the Chair to sign. The motion was seconded by Commissioner Cozad, and it carried unanimously. • 10) CONSIDER COUNTY DANCE HALL LICENSE AND AUTHORIZE CHAIR TO SIGN - CAPRICHO ROJO, LLC, DBA CAPRICHO ROJO: Mr. Haug explained the dance hall license will go with the recently approved Tavern liquor license. Commissioner Cozad moved to grant said dance hall license and authorize the Chair to sign. Commissioner Conway seconded the motion, and it carried unanimously. • 11) CONSIDER AGREEMENT FOR THE PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS - LONE STAR, LLC: Tiffane Johnson, Department of Public Works, presented the details of the agreement for the total amount of$800.00. Commissioner Conway moved to approve said agreement and authorize Chair to sign all necessary documents. The motion was seconded by Commissioner Cozad, and it carried unanimously. • 12) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST DECHANT FARMS PARTNERSHIP: Bob Choate, Assistant County Attorney, presented the next seven (7) items as a request from the County Attorney's office to file a condemnation petition and stated the residents are being represented by Doug Wieland, Condemnation Attorney. Mr. Choate explained they have offered the land owners a 30% signing incentive over the cost of the land, along with paid damages to irrigation systems and wells, since the County needs to acquire additional property for the expansion of CR 49. No public testimony was offered concerning this matter. Commissioner Cozad moved to authorize the County Attorney's Office to file proceedings in the eminent domain. The motion, which was seconded by Commissioner Moreno, carried unanimously. • 13) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST DECHANT FARMS PARTNERSHIP: Mr. Choate stated the final offer to the land owner for this parcel was for the amount of $20,267.00. No public testimony was offered concerning this matter. Commissioner Moreno moved to authorize the County Attorney's Office to file proceedings in the eminent domain. Commissioner Cozad seconded the motion, and it carried unanimously. • 14) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT Minutes, April 18, 2016 2016-1326 Page 3 BC0016 TO SECTION 38-1-101, C.R.S., AGAINST TEN HAND TRUST, ALVIN DECHANT JR., AND SCOTT DECHANT: Mr. Choate presented the final offer to purchase the property in the amount of $24,209.00. No public testimony was offered concerning this matter. Commissioner Cozad moved to authorize the County Attorney's Office to file proceedings in the eminent domain. The motion was seconded by Commissioner Moreno, and it carried unanimously. • 15) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST ALVIN DECHANT JR: Mr. Choate stated the final offer to purchase the property was in the amount of$168,755.00. Commissioner Moreno moved to authorize the County Attorney's Office to file proceedings in the eminent domain. The motion, which was seconded by Commissioner Cozad, carried unanimously. • 16) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST ALVIN DECHANT AND DONNA DECHANT: Mr. Choate stated the final offer to purchase the property was the amount of $20,000.00. Commissioner Kirkmeyer moved to authorize the County Attorney's Office to file proceedings in the eminent domain. Seconded by Commissioner Conway, the motion carried unanimously. I 17) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST SCOTT DECHANT: Mr. Choate reviewed the final offer to purchase the property for the amount of $46,464.00, and recommended approval to proceed. Commissioner Cozad moved to authorize the County Attorney's Office to file proceedings in the eminent domain. The motion was seconded by Commissioner Moreno, and it carried unanimously. 18) CONSIDER AUTHORIZING FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST ALVIN DECHANT JR. AND DAVID DECHANT: Mr. Choate presented the final offer of$18,208.00 to purchase the property and recommended approval to proceed. Commissioner Moreno moved to authorize the County Attorney's Office to file proceedings in the eminent domain. Commissioner Cozad seconded the motion, and it carried unanimously. • 19) CONSIDER RECOMMENDATION TO APPOINT COMMISSIONER JULIE COZAD TO MEAD URBAN RENEWAL AUTHORITY BOARD: Commissioner Conway moved to recommend the appointment of Commissioner Cozad. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. PLANNING: • 1) SECOND READING OF CODE ORDINANCE#2016-02, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 19 COORDINATED PLANNING AGREEMENT (KERSEY), OF THE WELD COUNTY CODE: Commissioner Conway moved to read Code Ordinance #2016-02 by title only. Seconded by Commissioner Moreno, the motion carried unanimously. Bruce Barker, County Attorney read the title for the record. Tom Parko, Director of Department of Planning Services, reported there are no changes from the first reading. No public testimony was offered concerning this matter. The motion to approve on Second Reading, which was made by Commissioner Kirkmeyer, and seconded by Commissioner Conway, carried unanimously. El 2) FIRST READING OF CODE ORDINANCE #2016-06, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 20 IMPACT FEES, OF THE WELD COUNTY CODE: Mr. Parko stated this ordinance has to do with impact fees and through a pass-around, the Commissioners reviewed the fee adjustment due to inflation, increasing the fees by 1.2% which should Minutes, April 18, 2016 2016-1326 Page 4 BC0016 go into effect June 13, 2016. Bruce Barker, County Attorney, explained that once this ordinance is approved the Commissioners will approve increases by resolution. No public testimony was offered concerning this matter. The motion to approve on First Reading, which was made by Commissioner Cozad and seconded by Commissioner Moreno, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2016-02, was approved on Second Reading, and #2016-06 was approved on First Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
