RE: CORRECTION OF RESOLUTION DATED FEBRUARY 23, 1977, REGARDING
SUBDIVISION EXEMPTION NO. 41 - JESS KOHLER.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on the 23rd day of February, 1977, the Board of
County Commissioners of Weld County, Colorado, reviewed the re-
quest of Jerry and Renee Stehman for an exemption of land to
be transferred to them from Jess Kohler, from the definition of
"subdivision" and "subdivided land" in Section 30-28-101 (10) , CRS
1973, as amended, and in Section 2-1 of the Weld County Sub-
division Regulations, and
WHEREAS, a Resolution was passed and approved by the Board
of County Commissioners on February 23, 1977 ; however, the legal
description mentioned in said Resolution was incorrect, and, there-
fore, has caused inconvenience for the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the transfer of certain
lands located in Section 21, Township 6 North, Range 64 West of
the 6th P.M. , Weld County, Colorado, and being more particularly
described as follows :
A Tract of land located in the SEa of Section 21,
T. 6 N. , R. 66 W. , of the 6th P.M. , Weld County,
Colorado, being more particularly described as
follows:
Commencing at the Sa Cor. of said Sec . 21 ,
and considering the South line of the SEa
to bear N 88°54 ' 22" E, and with all other
bearings contained herein being relative
thereto;
Thence N 00°00 ' 00" E, along the West line of
the SEa of Sec. 21, a distance of 30. 00 feet;
Thence N 88°54 ' 22" E, a distance of 670. 71 feet;
Thence N 00°54 ' 22" E, a distance of 1272 . 00 feet;
Thence N 89°14 ' 22" E, a distance of 30. 01 feet
to the True Point of Beginning;
Thence N 89 °14 ' 22" E, a distance of 108. 00 feet;
Thence S 00°54 ' 22" W, a distance of 109 . 00 feet;
Thence S 89°14 ' 22" W, a distance of 108 . 00 feet;
Thence N 00°54 ' 22" E, a distance of 109 . 00 feet
to the True Point of Beginning
be, and hereby is, exempt from the definition of "subdivision"
and "subdivided land" found in Section 30-28-101 (10) , CRS
1973, as amended, and Section 2-1 of the Weld County Subdivision

Regulations.
BE IT FURTHER RESOLVED bythe Board of County Commissioners,
that said aforementioned transfer of lands from the definition
of "subdivision" and "subdivided land" , has created a second
parcel of land more particularly described as all that Part of
the SE4 of Section 21, Township 6 North, Range 64 West of the
6th P.M. , excepting that portion more particularly described
in the legal description on the first page of this Resolution,
subject to all easements of record, as more fully set forth in
the following description, to-wit:
A Tract of land located in the SE4 of Sec, 21,
T. 6N. , R. 66W. , of the 6th P.M. , Weld County,
Colorado, being more particularly described as
follows :
Commencing at the S4 Cor. of siad Sec. 21,
and considering the South line of the SE4
to bear N. 88°54 ' 22" E, and with all other
bearings contained herein being realtive
thereto;
Thence N 00°00 ' 00" E, along the West line of
the SE4 of Sec. 21, a distance of 30 . 00 feet;
Thence N 88°54 ' 22" E, a distance of 670. 71
feet to the True Point of Beginning;
Thence N. 00°54 ' 22" E, a distance of 1163 , 00
feet; Thence N 00°54 ' 22" E, a distance of 109 . 00
feet; Thence N 89°14 ' 22" E, a distance of 30 . 01
feet; Thence S 00°54 ' 22" W, a distance of 109. 00

Said Tract of land to be used for a 30 foot
Roadway Easement and contains 1. 463 acres.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 15th day of
August , A.D. , 1977.
