Chris Gathman — Planner 11/12/2015 To whom it may concern, We are extremely opposed to the Miller NFl LLC project. First thing this area is zoned Agricultural. We have already had issues here from Miller. The rain came and washed Frac material onto our neighbor's property. We do not want the traffic or noise either. If this was in town next to someone's house this would never come up. We have lived out here before all the oil activity began. The county does not keep up the roads even with increased traffic. These bad roads are extremely hard on our vehicles. These tanks would also encourage rattlesnakes. Again we are saying no to this Miller Project case # USR15-0073. Ask yourself would you want this right next to your home and your children? Would you let us put up a trailer park out here? If this project is approved we will have no choice but to file a lawsuit against Miller HFl LI.C and Weld County. This would devalue our property tremendously. We have worked for many years to have a place like this. We will not sit back and let a company finically devastate us. All for their personal financial gain with no regard to us or our family. We have a young child in our home. This is unsafe for everyone involved. Again we do not want the ground water and air polluted. We live clear out here because it used to be peaceful. The oil companies have stolen that peace from us. Chris I had mailed our complaint to you by certified mail here is a copy. I have included the report from the mud farm results. Please note the high levals of diesal fuel, aresnic and Napthalene. I have also included the MSDS for Napthalene that shows can cause organ failure. We are real people with real children. Our six your old Grandson lives here we want to do everything we can to protect him and the rest of our family. Our lives and our home should matter. You would never put these toxins next to someone in town. I had asked since April for this report and just recieved it this Monday. What about our well water? This could one day hit the aquafir. Beside all the health concerns what about our property values. . The noise and traffic will be bad. We have moved here for peace the oil companies have stolen that from us . The road are already bad. What will happen on County rd 83? No one will be able to come out here without 4 wheel drive. You are saying that they could deliver all times day and night. Again would you want this next to you? If Miller can not follow the rules for the mud farm , why would he now follow them. Here is a picture of two tanks they just moved in . with out a permit. You can not guarantee the tanks will be empty. We can not put up a second home here but for some reason you are wanting to zone our Ag community into Industrial. If we wanted to live next to an industrial park we would live in town. Again this would not happen to anyone living in town. With all the tanks it would encourage more rattlesnakes. Whats next a trailer park out here for the oil workers? When we moved here it was peaceful) and a great place to raise our family . We paid the price to live in an area zoned Ag . Not Industrial . Please consider our familys health, the value or our home and our right to live in a peaceful place. That is what we bought. (Noble) conducted confirmation soil sampling on November 12 , 2015 at the Miller North #1 Spreadfield (Site) to assess the post-incorporation arsenic levels. Location Description The Site is located in Weld County at the northwest corner of the intersection of County Road 83 and County Road 70. The legal site description is Section 11 , Township 6 North, Range 62 West, 6th Principal Meridian . The historical application area is currently being utilized as an active agricultural field by the landowner. Sampling Procedures On November 12, 2015, Olsson collected fifteen samples from the site as depicted on the attached Soil Sample Location Map as well as one composite sample. The samples were collected using clean sampling equipment and placed into laboratory prepared glassware. Equipment was cleaned with Alconox and deionized water between samples. Each sample represents six to eight inches below the surface of the windrow. Samples were delivered by hand on the same day to ALS Environmental laboratory (ALS) in Fort Collins, Colorado following chain of custody procedures. A subset of the samples were corn posited and ground by ALS using the following procedures. After the samples were delivered to the lab they were transferred to an aluminum pan and spread out across the bottom of the pan and allowed to air dry. When dry, the sample was sieved through a 1/4-inch sieve to remove large rocks, grass, twigs. The sample was then sectioned into several approximate 2-inch sections. A small aliquot from each section was taken to create an approximately 20 gram subsample. This aliquot was ground and used for metals analysis or arsenic by EPA Method 6020A. Analytical Results A copy of the laboratory analytical report is included as Attachment 2 and is summarized in attached Table 1 as well as attached Soil Sample Location Map. Benzene, toluene, ethylbenzene, and total xylenes (BTEXZ) were non-detect (ND) for all soil samples. Naphthalene was below the Table 910-1 concentration levels of 23 mg/kg for all samples. All pH samples were within the Table 910-1 standards of 6-9. . All soil samples were below Table 910-1 standards for sodium adsorption radio (SAR) of less than 12. Arsenic ranged between 2.5 mg/kg for SS13 and 7.8 for SS 11 ; all samples were above the Table 910-1 concentration levels of 0.039 mg/kgElectrical conductivity (EC) ranged between 0.31 millimhos per centimeter (mmhos/cm) and 7.7 mmhos/cm; six samples were above the table 910-1 standard of 4 mmhos/cm. A composite sample was run for PAH's (polycyclic aromatic hydrocarbons). All results were below Table 910-1 standards, results are summarized in attached Table 1 . Summary and Conclusions Olsson collected fifteen samples and on composite sample from the Miller 1 Spreadfield which were submitted for laboratory analysis at ALS. TPH , BTEX, naphthalene, pH, SAH , and PAH's were all below Table 910-1 standards. EC ranged between 0.31 millimhos per centimeter (mmhos/cm) and 7.7 mmhos/cm with six samples above Table 910-1 standards; however, these were similar to previous samples collected by LT Environmental on behalf of Noble. Arsenic concentrations ranged from 2.0 to 7.8 mg/kg ; all above Table 910-1 standards of 0.039 mg/kg. Soils in Weld County are characteristically high in Arsenic and these samples are within 1 .25 normal background ranges for the area. No further action was taken. • All internal standard recoveries were within acceptance criteria with the following exception: Internal Standard Sample Direction 1 ,4-Dichlorobenzene-d4 -4, -7, -8, -11 & -12 Low The samples were re-analyzed to evaluate whether the original outlier was due to matrix effects or laboratory performance. The re-analysis also had internal standards outside the control limits, which suggests the presence of matrix effects. All remaining acceptance criteria were met. GC/MS Semivolatiles: The samples were analyzed using GC/MS following the current revision of SOP 506 based on SW- 846 Method 8270D. TVPH is a multicomponent mixture and is quantitated by summing the entire carbon range, rather than individual peaks. The carbon range integrated in this test extends from C6 to C10 All acceptance criteria were met. DRO: The samples were analyzed following the current revision of SOP 406 generally based on SW-846 Methods 8000C and 8015D. TEPH is a multicomponent mixture and is quantitated by summing the entire carbon range, rather than individual peaks. The carbon range integrated in this test extends from C10 to C28. All acceptance criteria were met. Metals: The samples were analyzed following SW-846, 3ifi Edition procedures. Analysis by ICPMS followed method 6020A and the current revision of SOP 827. Samples 17 through 31 were prepared utilizing the following procedures: The sample was transferred to an aluminum pan and spread out across the bottom of the pan and allowed to air dry. When dry, the sample was sieved through a 1 /4 inch sieve to remove large rocks, grass, twigs. The sample was then sectioned into several —2 inch sections. A small aliquot from each section was taken to create an -20 g subsample. This aliquot was ground and used for metals analysis or arsenic by ICP-MS method 6020k The digestate was treated through a cation column to remove potential interferences. All acceptance criteria were met.
