E. , Development Engineer SUBJECT: USR15-0079, RLU Holdings The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Construction storage yard for Northwinds of Wyoming This project is west of and adjacent to CR 39 and is north of CR 40. Parcel number 105530100028. Access is from CR 39. Access: An access permit has been approved for 2 small commercial accesses to the site (AP15-00591 ). Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. Roads: County Road 39 is a paved road and is designated on the Weld County Road Classification Plan as a collector road , which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right- of-way. This road is maintained by Weld County. Traffic: Latest ADT on CR 39 was taken on 3/2013 which counted 1803 vpd with 32% trucks. A traffic narrative was submitted with the application materials and indicated that there will be approximately 8 truck and 60 passenger daily roundtrips. The majority of expected traffic routes are north on CR 39. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. 4 to 10 round truck trips/day (tandem or semi-trucks): Access onto paved roads requires a tracking control device and a minimum of 100ft of recycled asphalt/road base OR 300ft of asphalt. (SURFACE IMPROVEMENTS LESS THAN 300 FT MAY BE ALLOWED IF SITE CONSTRAINTS WOULD PROHIBIT MEETING CONDITION . ) *Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device *** Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. A development standard will be included on the recorded site plan. "The access shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking ." Improvements and Road Maintenance Agreement: An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), outline when offsite improvements will be triggered , and include a maintenance agreement for the haul routes. Improvements/Road Maintenance Agreement: An example agreement is available at: http://www.co.weld.co. us/Departments/PlanningZo_ ning/Land UseApplicationsAssista nce/ApplicationAssist ance. html An Improvements Agreement is required for sites with required offsite improvements. Collateral is required to ensure the improvements are made. Road Maintenance is typically included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. Drainage Requirements: A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required . Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information . Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain : This area IS NOT in a FEMA regulatory floodplain . CONDITIONS OF APPROVAL: A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this location. Road maintenance including dust control, damage repair, specified haul routes and future traffic triggers for improvements will be included. (Department of Public Works) B. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II , of the Weld County Code. (Department of Planning Services-Engineer) 2. The accesses on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking . Memorandum To: Kim Ogle From: Lauren Light, Environmental Health Services Date: January 22 , 2016 Re: USR15-0079 RLU Holdings, LLC Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for a mineral resource development facility including oil and gas support (roust-a-bout, pipeline construction , construction and excavating service) in the A (Agricultural ) Zone District. The application indicates that approximately 50 to 75 employees will access the site on a regular basis. A portable toilet and bottled water can be used for employees who are on site for 2 consecutive hours or less and 2 or less full time employees on site. A septic system will be installed when the shop/office is constructed and Central Weld County Water District will supply water. The existing 3 bedroom residence is served by Central Weld Water and an OWTS , permit SP-0900022 . The neighborhood meeting minutes indicate no tanks will be located on the site . We recommend that the following requirements be incorporated into the permit as development standards: 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100 . 5, C . R. S . ) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination . 2 . No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20- 100. 5 , C . R. S . 3 . Waste materials shall be handled , stored , and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris , and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14 , Article 1 of the Weld County Code . 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations . 5 . The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C . R. S . 6 . Adequate drinking , hand washing and toilet facilities shall be provided for employees, at all times. For employees or contractors on site for less than 2 consecutive hours a day, and 2 or less full time employees on site , portable toilets and bottled water are acceptable . Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7 . Any septic system located on the property must comply with all provisions of the Weld County Code , pertaining to On-site Wastewater Treatment Systems. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 8. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal . Records of installation , maintenance, and proper disposal shall be retained . 9. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission , and the Environmental Protection Agency. 10 . All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling . All chemicals must be stored secure, on an impervious surface , and in accordance with manufacturer's recommendations . 11 . The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code . This violation was initiated due to the operation of a commercial business without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied , all but 1 (one) Commercial Vehicle shall be removed from the property 30 (thirty) days of denial or the violation will proceed in court accordingly. PVIC's first concern is regarding Applicant's use of PVIC's ROW as an access point. As part of this application , RLU relies upon PVIC's ROW as its access into the property, but RLU does not have PVIC's permission to do so. Furthermore, property records show that RLU does not own the land underling the ROW, and therefore has no legal right to use the ROW for any purpose. RLU's Site Layout Plan also shows an access road running across PVIC's ROW. Both of these representations are incorrect; there is no shared access across PVIC's ROW. As background , this parcel was the subject of a prior recorded exemption , RE-4306, application dated November 9, 2005. At the time, PVIC submitted comments to clarify that this parcel did not have permission to use PVIC's ROW as an access point. A copy of PVIC's letter, dated December 21 , 2005, is attached . Subsequently, a plat was recorded at Reception #3371479 that shows an additional easement for access into the parcel that is separate from PVIC's ROW. A copy of the plat is also attached . As the Planning Department recognized at that time, the owner of the subject property does not have legal access into the parcel using PVIC's ROW. RLU purchased the property late fall 2015, and began using PVIC's ROW without permission . PVIC separately contacted RLU to resolve this issue, even before RLU submitted the current application . At this time, RLU does not have PVIC's consent to use its ROW as access into its property. PVIC reviewed RLU's application to evaluate whether any change in its position is warranted in the circumstances. RLU proposes to change the use of its property from agricultural to commercial for oil and gas development. The application estimates that there will be significant increase in the number, frequency and kind of vehicles entering and leaving the property on a daily basis. This type of use is incompatible with PVIC's use of its ROW and would interfere with PVIC's ability to access, operate, and maintain the ditch . PVIC cannot consent to this interference with its ROW. If the Planning Department approves RLU's application , PVIC requests that it is made clear that the approved access into the parcel continues to be separate from PVIC's ROW. RLU should begin using its legal access point immediately, prior to conducting any other work on the property. Any plat, site plan , or other representation of the property recorded in conjunction with the project should be corrected to reflect the correct access layout. 2 . Drainage Plan for the Property. PVIC's second concern is that Applicant proposes to create a point source drain into the Evans No. 2 Ditch and create a detention pond abutting the ditch . Applicant's proposed drainage plan includes allowing drainage to "sheet flow un-detained to the north" as well as to capture water in a detention pond with subsequent point-source release into the ditch . In both instances, the water will intercept the Evans No. 2 Ditch with the potential to increase the drainage burden . Under Colorado law, a property owner does not have the right to increase drainage into an irrigation ditch over historical levels. RLU must ensure that its drainage plans do not alter the manner or quantity of runoff into the ditch . Sufficient structural protections in accordance with applicable law must be in place to protect the ditch from failure of the detention pond and drainage structure . Water quality protections in accordance with law must also be in place to ensure that RLU's drainage does not impair the quality of the water draining into the ditch . LYONS GADDIS Al TORiNEYS & COUNSELORS February 1 , 2016 Page 3 Additionally, any increased drainage or runoff that occurs across PVIC's ROW will increase maintenance and repair of the ditch road , and should also be mitigated . 3. Interference with PVIC's ROW. PVIC's next concern is about Applicant's general use of PVIC's ROW for storage and other purposes separate from access. All construction , storage, vehicle parking or other uses of the property must occur outside of the ROW to prevent interference with PVIC's maintenance and operation of the ditch . As an example, Applicant's Site Layout Plan depicts an unidentified box overlaying PVIC's ROW. Because this box is unlabeled , it is unclear what it represents. PVIC requests that all sketches, plans and permits be updated to remove any reference to any structure, construction , or other use overlapping PVIC's ROW to prevent interference with the ROW. 4. Appropriate Mitigation Required . PVIC's final concern is about the volume of traffic estimated in the application , and the potential negative impact that such traffic will have on the ditch and its ROW. If its application is approved , RLU should be required to take appropriate mitigation steps, including erosion control and dust abatement procedures as needed , to protect surrounding property owners. Thank you for notifying PVIC of this application and for keeping PVIC informed of all similar applications that have the potential to impact PVIC's ditch and/or PVIC's ROW and access to the ditch . Because each application is different, and PVIC's property interest varies depending on the location , PVIC values the opportunity to provide input wherever the Evans No. 2 Ditch and PVIC's interests may be impacted . Reester Our office submitted comments on the above application on behalf of Platte Valley Catherine A. Tallerico Scott E. Holwick Irrigation Company ("PVIC") on February 1 , 2016. Since that time, PVIC has met Cameron A. Grant with the Applicant, RLU Holdings, LLC's ("RLU") regarding some of the issues Matthew Machado PVIC raised . PVIC submits the following additional comments on this application : Regarding use of PVIC's Evans No. 2 Ditch right-of-way ("ROW") for access to its Madoline Wallace-Gross parcel , RLU acknowledges that the legal access into the property is adjacent to, Chad A. Kupper and not overlapping with , PVIC's ROW. RLU agrees that it will realign its access Blair M. Dickhoner Elizabeth M. Joyce and create a new road adjacent to the ROW. RLU's road will not interfere with PVIC's access to its ROW. RLU will appropriately delineate the new road and add signage for visitors to its property so that increased traffic will not interfere SPECIAL COUNSEL with PVIC's ROW. If RLU creates a new access road separate from PVIC's ROW Wallace H. Grant as described , no agreement with PVIC is necessary and PVIC has no additional Suzan D. Fritchel Eve I. Canfield concerns regarding the access road to this property. SENIOR CLyons I RLU also acknowledges that it may not use PVIC's ROW for storage, parking , Richard N. So long as all of RLU 's activity (including parking , storage , temporary or permanent structures, or any other encroachment) takes place outside of PVIC's ROW, PVIC has no additional concerns regarding physical interference with its ROW. RLU proposes to create a detention pond with two structural elements, each capable of releasing retained drainage into PVIC's ditch : a regulated outlet and an overflow spillway. PVIC does not object to the release of drainage from the RLU detention pond into its ditch , provided that such drainage is released in historic amounts and replicates, as possible, historic patterns. However, RLU and PVIC have not discussed how RLU will construct its outlet into PVIC's ditch , or how it will time its proposed releases into PVIC's ditch . Because RLU does not own the property underlying PVIC's ROW or PVIC's ditch , RLU must obtain permission from PVIC prior to constructing a new outlet that will connect with PVIC's ditch . PVIC believes that further discussion with RLU is necessary to resolve these details. However, PVIC does not object to the County approving this application provided that such approval is conditioned upon future agreement between RLU and PVIC on this issue. PVIC requests that the County's approval of RLU's application contain conditions to reflect these issues, namely: 1 . Legal access to this parcel remains separate from PVIC's ROW. 2 . No structures, development, or other use of PVIC's ROW is allowed . All plats, maps, sketches, etc. that will be recorded should be updated to reflect no interference with the ROW. 3. RLU shall design its detention pond and drainage structures in the usual and customary manner to meet all federal , state, and local regulations including setbacks, safety, stability, and water quality standards. No structures shall increase erosion or impair ditch stability and integrity. 4. RLU 's use of the property shall not alter the manner or quantity of drainage into the ditch over historical levels. Any contained or point source flow shall be regulated to recreate historic runoff patterns. 5. RLU will obtain PVIC's consent and agreement prior to constructing the drainage outlet from its detention pond or any other structure that will intersect with or abut the ditch . Thank you for notifying PVIC of this application and for considering all of the issues raised in PVIC's comments. Based on our current understanding that RLU is working in good faith to resolve the issues that PVIC has identified , PVIC does not plan to attend the public hearing set for March 1 , 2016 . PVIC will submit additional comments in the future if necessary. Parcel # 105530100028 is currently being sewed with water through tap #3004. The District has additional requirements that must be met if tap #3004 is connected to lines that provide water for the types of activity described in the amendment application. We require a Reduced Pressure Zone (RPZ) backflow assembly to be installed after the meter as containment. The landowner will need to contact Dean Clarkin at our office to determine the exact requirements for their property, as instructions for installation are specific to the property and a full survey of the tap holder's water usage practices for their business may be required.
