RE: APPROVE AGREEMENT FOR THE PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY
FOR CERTAIN IMPROVEMENTS TO COUNTY ROAD 49 AND AUTHORIZE CHAIR TO
SIGN ALL NECESSARY DOCUMENTS — JEFF AND DEANNE MAXEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with An Agreement for Purchase of Public
Road Right -of -Way for Certain Improvements to County Road 49 between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Department of Public Works, and Jeff and Deanne Maxey, with terms and conditions being
as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for the Purchase of Public Road Right -of -Way for Certain
Improvements to County Road 49 between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, and Jeff and Deanne Maxey be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair Pro-Tem be, and hereby is,
authorized to sign said agreement.

thereinafter "WCR -49"t. which will improve the alignment and construction of the roadway.

and improvements include, but is not limited to: the four strand barbed wire
fencing, six-foot (6') tall cedar privacy fence described in Exhibit B, the concrete
ditch improvements described in Exhibit D, and the water well. Owner shall
comply with the requirement to remove the well from the right of way by causing
the well to be plugged and abandoned, including the completion of all necessary
permitting requirements with the State of Colorado.
10. RIGHT OF WAY FENCE. Owner shall install a permanent fence on the right of
way line by October 31, 2016. The parties anticipate that Owner will reuse the
four strand barbed wire removed from the right of way.
COUNTY'S RIGHTS AND RESPONSIBILITIES:
1. TITLE INSURANCE. County shall at closing pay for the cost of obtaining title
insurance if County desires to obtain title insurance for the Public Road Right -of -Way.
2. RECORDING FEES. County shall at closing pay all fees associated with
recording this Agreement and / or the Special Warranty Deed.
3. IRRIGATION WATER. County shall replace culvert and necessary support
structures to transfer surface irrigation water under and across Weld County Road 49
from the Southeast Quarter of Section 24, Township 5 North, Range 65 West to the West
half of the Southwest Quarter of Section 19, Township 5 North, Range 64 West by
February 1, 2017 unless otherwise agreed to in writing by Owner. County shall
coordinate location and installation with Owner prior to construction and availability of
irrigation water to Owner shall not be disrupted by County's construction of the culvert
and support structures during the growing season.
4. COMPENSATION FOR RIGHT OF WAY. County shall pay Twelve Thousand
Eight Hundred Forty Three Dollars ($12,543.00) to the Owner for the Public Road
Right -of -Way by County warrant(s) at the date of closing.
5. COMPENSATION FOR BARBED WIRE FENCING. County shall pay Owner
Six Thousand Six Hundred Fifty Dollars ($6,650.00) for fencing including removal
and replacement of 1,900 feet of 4 strand barbed wire fence.
6. COMPENSATION FOR CEDAR FENCING. County shall pay Owner Four
Thousand Twenty One Dollars ($4,021.00) for fencing outlined Exhibit B including
removal and replacement of cedar fence.
7. COMPENSATION FOR RELOCATION OF PIPE FENCING AND SIGN.
County shall pay Owner Three Hundred Forty Five Dollars ($345.00) for Owner to
relocate existing pipe fencing and sign to the edge of the new Road Right of Way.

8. COMPENSATION FOR RELOCATION OF METAL TUBE GATES. County
shall pay Owner One Thousand One Hundred Dollars ($1,100.00) for Owner to
relocate the existing five 12 -foot -wide metal tube gates separating the corrals outside the
new Road Right of Way.
9. COMPENSATION FOR TREES. County shall pay Owner Five Thousand Two
Hundred Sixty Dollars ($5,260.00) for trees #3, 4, 5 outlined in Exhibit C.
10. COMPENSATION FOR CONCRETE IRRIGATION DITCH. County shall pay
Owner Eighty Nine Thousand Five Hundred Dollars ($89,500.00) for the removal and
replacement of the concrete irrigation ditch outlined in Exhibit D.
11. COMPENSATION FOR ADDITIONAL CONCRETE. County shall pay Owner
One Thousand Dollars ($1,000.00) for concrete not included in irrigation bid for
concrete riser/dividing structure not included in Exhibit D.
12. COMPENSATION FOR FILL DIRT. County shall pay Owner Sixteen
Thousand Seven Hundred Seventy Dollars ($16,770.00) for fill dirt necessary to
elevate the new concrete irrigation ditch to maintain flows, which is otherwise not
included in Exhibit D.
13. COMPENSATION FOR RELOCATION OF WELL. County shall pay Owner
Sixty One Thousand Two Hundred Twenty Three Dollars ($61,223.00).
Reimbursement includes construction of a small shed and all abandonment of existing
well.
14. COMPENSATION FOR NOISE ABATEMENT. County shall pay Owner Five
Thousand Nine Hundred Forty Dollars ($5,940.00) for Owner to construct a free-
standing concrete block wall for noise abatement.
15. COMPENSATION FOR DRIVEWAYS. County shall pay Owner Three
Thousand One Hundred Thirty Three Dollars ($3,133.00) for existing driveways.
16. COMPENSATION FOR ADMINISTRATIVE COSTS. County shall reimburse
Owner Three Thousand Three Hundred Thirty Six Dollars ($3,336.00) for the
oversight of removal/salvage and installation of reimbursed damages outlined above in
numbers 4 through 14 of this section (County's Rights and Responsibilities). All sums set
forth in paragraphs no. 4 through no. 16 immediately above totaling Two Hundred
Eleven Thousand One Hundred Twenty One Dollars ($211,121.00) shall be paid by
County to Owner at Closing. This sum is being paid by County to Owner in lieu of
County continuing condemnation proceedings to acquire the Public Road Right -of -Way.
The total sum of $211,121.00 shall be paid to Owner by two checks, one in the amount of
$12,843.00 for the Public Road Right -of -Way and one in the amount of $198,278.00 for
relocation and damages to Owner's improvements.

MISCELLANEOUS:
1. This Agreement and the transfers of the Public Road Right -of -Way, made
pursuant to the terms herein, shall be binding upon, all and inure to the benefit of
and be enforceable by the parties and their heirs, executors, administrators,
successors, and assigns.
This Agreement shall not be valid until it has been approved by the Board of
County Commissioners of Weld County, Colorado or its designee.
3. No term or condition of this contract shall be construed or interpreted as a waiver,
express or implied, of any of the immunities, rights, benefits, protections or other
provisions, of the Colorado Governmental Immunity Act §24-10-101 et seq., as
applicable now or hereafter amended.
4. The parties hereby agree that neither has made or authorized any agreement with
respect to the subject matter of this instrument other than as expressly set forth
herein, and no oral representation, promise, or consideration different from the
terms herein contained shall be binding on either party, or its agents or
employees.
It is expressly understood and agreed that the enforcement of the terms and
conditions of this Agreement, and all rights of action relating to such
enforcement, shall be strictly reserved to the undersigned parties and nothing in
this Agreement shall give or allow any claim or right of action whatsoever by any
other person not included in this Agreement. It is the express intention of the
undersigned parties that any entity other than the undersigned parties receiving
services or benefits under this Agreement shall be an incidental beneficiary only.
6. This Agreement embodies all agreements between the parties hereto and there are
no promises, terms, conditions, or obligations referring to the subject matter
whereof other than as contained herein.
7. This transaction shall be governed by and constructed in accordance with the laws
of the State of Colorado.
IN WITNESS WHEREOF, the parties have set their hands on the day and year first

Maxxey Farms 2 Tree Valuation
Landowners: Maxey Farms 2
Property location: 26468 WCR 49
Kersey, Colorado
Purpose: To value trees to be removed in the widening of WCR 49 that
provide landscape value to a residence.
Date of field visit: April 21, 2015
Tree function: Trees add landscape value to the house mentioned above. They also
provide shade, wildlife habitat, site protection from wind, and aesthetics.
Process: A field inventory was conducted. Information collected was tree species, tree
diameter, and location as it benefits the residence. Condition was evaluated per
the descriptions in the Appendix. The book, Guide for Establishing Values of
Trees and other plants, was utilized in determining tree values.
Plant descriptions: A total of seven trees were examined. There are seven tree
species represented. All but the Siberian elm are conventional and desirable
for our area. However, the elm here adds significant value to the site in the form
of afternoon shade. Other species present are shown in the Appendix. Tree
numbered 4 shows signs of salt damage that may have come from WCR 49. All
trees are well established, healthy and functional. See the Inventory in the
Appendix for specifics.
Discussion: Landscape trees are more valuable than those trees along roadsides or in
natural wooded areas. They add comfort and beauty to this residence. No
significant pest problems were found during the field examination. Life
expectancy of all trees is at least twenty years.
Estimated value: In my opinion, the estimated value of the Maxey Farms 2 trees is:
$ 6,890. A table in the Appendix shows individual tree values.

- I personally inspected all trees and shrubs.
- This appraisal has been made in accordance with recognized standards and
practices.
