Wallace, MD, MPH Executive Director Department of Public Health & Environment DATE: September 7, 2016 SUBJECT: Lead Surveillance — Colorado Childhood Lead Poisoning Prevention Program (CCLPPP) Task Order Contract Enclosed for the Board's approval is a Task Order Contract Amendment for the Lead Surveillance — Colorado Childhood Lead Poisoning Prevention Program between the Colorado Department of Public Health and Environment (CDPHE) and the Board of County Commissioners of Weld County for the use and benefit of the Weld County Department of Public Health and Environment (WCDPHE). The Task Order term is September 30, 2016, through September 29, 2017. WCDPHE currently conducts surveillance, investigation, and reporting of elevated childhood blood lead levels (paid with local dollars). The CDPHE has offered us a contract in the amount of $18,000 to provide operational funding to fund our local lead program. This funding originates at the U.S. Department of Health and Human Services through the CDC. This is part of a State initiative to provide funding to local public health agencies that experience the largest burden of elevated childhood blood lead cases in Colorado. As a part of this proposed contract, WCDPHE will actively participate in CCLPPP workgroups and meetings to develop efficiencies through the development of systematic guidelines, processes, and reporting requirements for elevated blood lead cases by collaborating with the State and other counties. WCDPHE will continue to conduct case investigations on elevated childhood blood lead levels as we have in the past, however, now our findings will be reported to CDPHE. No additional FTE will be required to provide the grant deliverables. This contract amendment was approved for placement on the Board's agenda via pass -around dated August 30, 2016. FACTUAL RECITALS The parties entered into a Master Contract dated January 171, 2012, with contract routing number 13 FAA 00051. Pursuant to the terms and conditions of the Master Contract the parties entered into a Task Order Contract dated July 241, 2016, with encumbrance number 20160000000000001338, and task order contract routing number 16 FHHA 82441, hereafter referred to as the "Original Task Order Contract", whereby the Contractor was to provide to the State the following: This project serves to provide operational funding to local public health agencies that experience the largest burden of elevated childhood blood lead cases in Colorado. The public health agencies will actively participate in CCLPPP workgroups and meetings to develop efficiencies through the development of systematic guidelines, processes, and reporting requirements for elevated blood lead cases. The State promises to increase the amount of funds to be paid to the Contractor by Eighteen Thousand Dollars, ($18,000.00) for the renewal term of One (1) year, ending on September 30`h, 2017, in exchange for the promise of the Contractor to perform the increased specifications to the work described herein. NOW THEREFORE, in consideration of their mutual promises to each other, stated below, the parties hereto agree as follows: 1. Consideration for this Task Order Amendment to the Original Task Order Contract consists of the payments and services that shall be made pursuant to this Task Order Amendment, and promises and agreements herein set forth. 2. It is expressly agreed to by the parties that this Task Order Amendment is supplemental to the Original Task Order Contract, contract routing number 16 FHHA 82441, referred to herein as the Original Task Order Contract, which is by this reference incorporated herein. All terms, conditions, and provisions thereof, unless specifically modified herein, are to apply to this Task Order Amendment as though they were expressly rewritten, incorporated, and included herein. 3. The following new provision is hereby added to the body of the Original Contract: Performance Outside the State of Colorado and/or the United States [Not applicable if Contract Funds include any federal funds] Following the Effective Date, Contractor shall provide written notice to the State, in accordance with the Notices and Representatives provision, within 20 days of the earlier to occur of Contractor's decision to perform, or its execution of an agreement with a Subcontractor to perform, Services outside the State of Colorado and/or the United States. Such notice shall specify the type of Services to be performed outside the State of Colorado and/or the United States and the reason why it is necessary or advantageous to perform such Services at such location or locations. All notices received by the State pursuant to this provision shall be posted on the Colorado Department of Personnel & Administration's website. Knowing failure by Contractor to provide notice to the State under this provision shall constitute a material breach of this Contract. B. This Task Order Amendment is issued pursuant to paragraph 5 of the Original Task Order Contract. This Task Order Amendment is for the renewal term of September 30th, 2016, through and including September 29th, 2017. The maximum amount payable by the State for the work to be performed by the Contractor during this renewal term is Eighteen Thousand Dollars, ($18,000.00) for an amended total contract financial obligation of the State of Thirty Six Thousand Dollars, ($36,000.00). This is an increase of Eighteen Thousand Dollars, ($18,000.001 of the amount payable from the previous term. Of the maximum amount for this renewal term Zero Dollars, ($0.00) are attributable to a funding source of the State of Colorado and Eighteen Thousand Dollars, ($18,000.00) are attributable to a funding source of the United States Government (see Catalog of Federal Domestic Assistance (CFDA) number 93.753). Of the amended total financial obligation of the State referenced above Zero Dollars, ($0.00) are attributable to a funding source of the State of Colorado and Thirty Six Thousand Dollars, ($36,000.00) are attributable to a funding source of the United States Government. The revised specifications to the original Statement of Work and revised Budget, if any, for this renewal term are incorporated herein by this reference and identified as "Exhibit E" and "Exhibit F". The Original Task Order Contract is modified accordingly. All other terms and conditions of the Original Task Order Contract are reaffirmed. 4. The Effective Date of this Task Order Amendment is September 30th, 2016, or upon approval of the State Controller, or an authorized delegate thereof, whichever is later. 5. Except for the General Provisions and Special Provisions of the Original Task Order Contract, in the event of any conflict, inconsistency, variance, or contradiction between the terms and provisions of this Task Order Amendment and any of the terms and provisions of the Original Task Order Contract, the terms and provisions of this Task Order Amendment shall in all respects supersede, govern, and control. The Special Provisions shall always control over other provisions of the Original Task Order Contract or any subsequent Task Order Amendments thereto. The representations in the Special Provisions to the Original Task Order Contract concerning the absence of personal interest of state of Colorado employees are presently reaffirmed. 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE. I. Entity Name: Weld County Department of Public Health and Environment Contract Term: September 30, 2016 through September 29, 2017 II. Project Description: This project serves to provide operational funding to local public health agencies that experience the largest burden of elevated childhood blood lead cases in Colorado. The public health agencies will actively participate in CCLPPP workgroups and meetings to develop efficiencies by establishing systematic guidelines, processes, and reporting requirements for elevated blood lead cases. Additionally, utilizing current, established elevated blood lead case management/investigation protocols within their respective agency, they will conduct case investigations on elevated childhood blood lead levels and report investigation findings to CDPHE. HI. Definitions/Acronyms: 1. CDPHE Colorado Department of Public Health and Environment 2. CCLPPP Colorado Childhood Lead Poisoning Prevention Program 3. Elevated Blood Lead Level A level of at least 10 micrograms per deciliter (µg/dL) 4. LPHA Local Public Health Agency 5. SOW Scope of Work 6. Target Geographical Area Weld County IV. Work Plan: Goal #1: Prevent and ultimately eliminate childhood lead poisoning in Colorado. Objective #1: No later than the end of this contract, the Contractor shall provide each child identified with an Elevated Blood Lead Level in the Target Geographical Area with proper care, education, and information about lead poisoning in an effort to reduce his/her lead level. Primary Activity #1 The Contractor shall perform exposure investigations in the Target Geographical Area. Sub -Activities #1 1. The Contractor shall conduct exposure investigations to determine the cause of an Elevated Blood Lead Level in the home of children with confirmed Elevated Blood Lead Level test results, as reported to the Contractor by CDPHE. 2. The Contractor shall notify CDPHE, via email, if there is insufficient staff capacity and ability to perform exposure investigations. a. If the Contractor does not have the staff capacity and/or ability to perform an exposure investigation, CDPHE will assist to coordinate or conduct the investigation. 3. The Contractor shall collect exposure investigation information via a method approved by CDPHE, and submit these findings to CDPHE. 4. The Contractor shall report investigation findings via a follow-up letter to the families of the children with Elevated Blood Lead Levels and the family's healthcare providers. Primary Activity #2 The Contractor shall design and provide educational materials related to lead poisoning. Sub -Activities #2 1. The Contractor shall have the option of creating new educational materials under this project. 2. The Contractor shall provide the family of every child with an Elevated Blood Lead Level in the Target Geographical Area, with educational materials that promote lead poisoning prevention. The Contractor shall attend a minimum of one (1) CCLPPP conference call orientation meeting as directed by CDPHE. 2. The Contractor shall attend and participate in a minimum of one (1) Colorado Lead Coalition meetings as directed by CDPHE. The goal of these meetings shall be to develop efficiencies by establishing systematic guidelines, processes, and reporting requirements for Elevated Blood Lead Level cases. Standards and Requirements 1. The Contractor shall use a CDPHE-approved method to collect exposure investigation information to submit to CDPHE. a. Exposure investigations shall be conducted no later than 60 days after CDPHE notifies the Contractor of a confirmed Elevated Blood Lead Level test result. 2. The Contractor shall use a CDPHE-approved follow-up letter to report investigation findings to the families of the children with Elevated Blood Lead Levels, no later than 30 days after the investigation is complete. Expected Results of Activity(s) 1. Children in the Target Geographical Areawith Elevated Blood Lead Levels, and their families, receive proper care, education, and information about lead poisoning. 2. Deliverables 1. The Contractor shall notify the CDPHE Lead Surveillance Coordinator, via email, if there is insufficient staff capacity and ability to perform exposure investigations. 2. The Contractor shall submit, electronically via encrypted email, the CDPHE approved method of recording information at exposure investigations to the CDPHE Lead Surveillance Coordinator. No later than 30 calendar days after the investigation is complete. 3. The Contractor shall submit any educational materials created under this project via email to the CDPHE Lead Surveillance Coordinator. No later than 30 calendar days after the materials are finalized. V. Monitoring: CDPHE's monitoring of this contract for compliance with performance requirements will be conducted throughout the contract period by the CDPHE Lead Surveillance Coordinator. Methods used will include a review of documentation determined by CDPHE to be reflective of performance to include progress reports and other fiscal and programmatic documentation as applicable. The Contractor's performance will be evaluated at set intervals and communicated to the contractor. A Final Contractor Performance Evaluation will be conducted at the end of the life of the contract. VI. Resolution of Non -Compliance: The Contractor will be notified in writing within 15 calendar days of discovery of a compliance issue. Within 30 calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The action(s) and time line for completion will be documented in writing and agreed to by both parties. If extenuating circumstances arise that requires an extension to the time line, the Contractor must email a request to the CDPHE Lead Surveillance Coordinator and receive approval for a new due date. The State will oversee the completion/implementation of the action(s) to ensure time lines are met and the issue(s) is resolved.
