HomeMy WebLinkAbout20161133.tiff RESOLUTION RE: GRANT APPEAL CONCERNING REQUEST FOR ADDITIONAL ACCESSES, PERMIT AP16-00075 -WONDER DOG PROPERTIES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has received an appeal from Wonder Dog Properties, LLC, concerning the decision by the Department of Public Works to deny the application for an Additional Access, AP16-0075, proposed for one additional access point off of County Road 23, and WHEREAS, pursuant to Weld County Code Sections 2-4-10 and 12-5-100, such appeal to the Board is considered to be "de novo," and WHEREAS, upon consideration of all of the evidence presented, including a review of all information submitted by Wonder Dog Properties, LLC, and the Department of Public Works, the Board deems it advisable to grant the appeal and approve the application, AP16-00075, proposed for one additional access point off of County Road 23. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the appeal of Wonder Dog Properties, LLC, concerning Access Permit, AP16-00075, be, and hereby is, granted and the permit be issued. J FROM: Janet Lundquist, Public Works SUBJECT: Access Denial Appeal AP16-00075 Weld County Public Works has received a request for one new access point that was denied. The applicant is requesting one additional access point off of CR 23 south of CR 6. CR 23 is a local roadway and CR 6 is a collector roadway. The denial for the access request is due the following: 1. The access would be a net increase of accesses. The parcel currently has one existing shared access point onto CR 23. Please see the attached aerial map, application materials, and letter from the applicant. The Weld County Code language is listed below: Sec. 12-5-30. Regulation of access onto County roadways. A. One access per lot. Direct access from a public road shall be limited to not more than one(1) per legal lot, except as may be expanded or further limited or restricted by the Board of County Commissioners or staff, as a result of zoning requirements, consideration in land use applications, safety considerations, subdivision regulations, or inability to meet minimum requirements as defined in the Weld County Design Criteria. E. Additional access. If a new access is requested to a legal parcel where an existing access already exists, the additional access shall not be approved unless the denial of the new access creates undue hardship on the property owner, as determined by the Department of Public Works. I understand that you have denied my request due to the face that there is an existing shared access point already on my property . Unfortunately, this access point will not suffice for several reasons: a There is not a sufficient turning radius from the road to the bridge. For my business, and the construction of my building (already on site) we will need to be able to get large trucks and pickups with trailers safely onto the property. The existing access point is fine for cars and light trucks, but larger trucks and trucks with trailers cannot safely use this access point. The proposed access point would allow a sufficient turning radius for these vehicles. o There is no engineering or weight rating currently on the bridge. While the existing bridge is in good shape, there is no way to know what size load it will take. The proposed new bridge is currently being engineered to support 75 ,000 pounds. It will also have guardrails in place that will prevent vehicles from sliding off in icy conditions. o Putting an additional access point on the north side of the property would direct the traffic related to my business away from my neighbors house, creating a better relationship between the neighbors and myself. This would be desirable for both parties, as it would offer increased privacy, peace, and quiet. Thank you for your consideration.
