RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR THE SHARING OF VOTER
REGISTRATION SERVICES AND AUTHORIZE CHAIR TO SIGN -TOWN OF ERIE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement for the
Sharing of Voter Registration Services between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Clerk and
Recorder's Office, and the Town of Erie, commencing February 24, 2016, with further terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for the Sharing of Voter Registration
Services between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Clerk and Recorder's Office, and the Town of
Erie, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of February, A.D., 2016.

RE: IGA for Erie Voter Registration

Brief description of the problem/issue:
Erie is requesting to hire one of Weld County's Voter Registration Specialists to help with voter registration and
to get access to the statewide SCORE system, which allows them to register people. Due to the state's security
requirements, Erie must hire someone qualified to access the statewide system. We have done this previously
with Erie in 2014. There is no cost to the county,and we do not lose any working time from the Voter Registration
Specialist.
What options exist for the Board? (Include consequences,impacts,costs,etc. of options)
I. Approve the IGA so that Erie can utilize the services of the Voter Registration specialist.
2. Not Approve the IGA.

INTERGOVERNMENTAL AGREEMENT FOR THE SHARING OF VOTER
REGISTRATION SERVICES
THIS INTERCJOVER1'MENTAL AGREEMENT ("IGA") is made and entered into
effective as of the 22 day of dfa , 2016, A.D. between the COUNTY OF WELD, a
political subdivision of the State of Col do, whose address is P. O. Box 758, 1150 O Street,
Greeley, CO 80632,hereinafter referred to as, "Weld Cty,"an th Tow of Erie, a political
subdivision of the State of Colorado, with address of PO 767) ;'hereinafter referred
to as, "Erie." Both entities may be referred to herein individually as "Jurisdiction," or
collectively as "the Jurisdictions."
WITNESSETH:
WHEREAS, intergovernmental agreements to provide functions or services, including
the sharing of costs of such services or functions, by political subdivisions of the State of
Colorado, are specifically authorized by C.R.S. § 29-1-203, and other sections of the Colorado
Revised Statutes, and
WHEREAS, Town of Erie is in need of the services of Voter Registration, and
WHEREAS, Weld County employs a Voter Registration Specialist, and said professional
has time available to offer to assist Town of Erie in Voter Registration, and
WHEREAS, Weld County is willing to share the services of its Voter Registration
Specialist with Town of Erie,pursuant to the terms of this IGA, in order to assist Town of Erie.
NOW, THEREFORE, in consideration of the mutual promises and covenants expressed
herein, the Jurisdictions agree as follows:
1. Sharing of Voter Registration Services. Weld County consents to having its Voter
Registration Specialist spend a portion of his or her time each week assisting the Town of
Erie in Voter Registration. The Weld County Voter Registration Specialist shall keep
careful track of his or her time spent. Weld County shall bill Town of Erie for all costs of
said professional on Town of Erie work, at the rate of$12 per hour, which shall include
all costs for said professional's time and travel expenses incurred by Weld County. The
Voter Registration specialist will be present at the Town of Erie for the 2016 Municipal
Election on the following dates and times:
Thursday, March 31S`,2016 to Friday, April 1s`, 2016 from 8:00 a.m. to 5:00 p.m.
Monday, April 4th, 2016 from 8:00 a.m. to 5:00 p.m.
Tuesday, April 5th, 2016 (Election Day) from 7:00 a.m. to 7:00 p.m.

2. Employment Status of Voter Registration Specialist. Nothing contained in this IGA, and
no performance under this IGA by the Voter Registration Specialist shall in any respect
alter or modify the status of said professional for purposes of worker's compensation or
his or her benefits or entitlements,pension, levels or types of training, internal discipline,
certification, or rank procedures, methods, or categories, or for any purpose, or condition
or requirement of employment.
3. Insurance Coverage for Voter Registration Specialist. Weld County shall maintain its
own insurance coverage, for both liability and damage, for the Voter Registration
Specialist.
4. Assignment. This IGA shall be binding upon the successors and assigns of each of the
Jurisdictions hereto, except that neither Jurisdiction may assign any of its rights or
obligations hereunder without the prior written consent of the other Jurisdiction.
5. No Third-Party Beneficiary. It is expressly understood and agreed that enforcement of
the terms and conditions of the IGA, and all rights of action relating to such enforcement,
shall be strictly reserved to the Jurisdictions, and nothing contained in this IGA shall give
or allow any such claim or right of action by any other or third person on such IGA. It
is the express intention of the Jurisdictions that any person other than the Jurisdictions
receiving services or benefits under this IGA shall be deemed to be an incidental
beneficiary, only.
6. Amendments. Amendments to this IGA may be made only upon unanimous consent by
both Jurisdictions. Such consent shall become effective upon its receipt in writing at the
addresses set forth above.
7. Termination. Either Jurisdiction may terminate this IGA, with or without cause, upon ten
(10) days prior written notice sent to the other Jurisdiction at the address set forth above.
8. Execution of IGA. This IGA may be executed by each Jurisdiction on a separate
signature page. Original signature pages will be held by each Jurisdiction.
