A public hearing was conducted on March 30 , 2016 , at 10: 00 a. m . . with the following present:

The following business was transacted :
P I hereby certify that pursuant to a notice dated February 12 . 2016, and duly published
February 17 . 2016, in the Greeley Tribune , a public hearing was conducted to consider the
request of Circle B Land Company, LLC . c/o M3 Construction , LLC, for a Site Specific
Development Plan and Use by Special Review Permit, USR15-0078. for a Mineral Resource
Development , including Oil and Gas Support and Service (storage of tanks, vessels, pipe racks,
other oil and gas production equipment and more than one cargo container as an accessory
structure) in the A (Agricultural) Zone District. Bob Choate , Assistant County Attorney. made this
a matter of record .
Chair Freeman instructed the applicant and reviewed for the public, with two (2) of the
five (5) commissioners being excused , the vote must be unanimous for the case to be approved
today.
Kim Ogle , Department of Planning Services . presented a brief summary of the proposal in
relation to the location and history of prior recorded exemption to create the parcel . He stated the
site is not located within the three (3) mile referral area of any municipality. Mr. Ogle described
the surrounding properties and uses and clarified there has been no correspondence received to
date. He reviewed the operation to include a storage yard, oil and gas service and support, hours
of operation , daily vehicle trips are dependent on activity, and clarified the site is unmanned . Mr.
Ogle stated eight (8) referral agencies reviewed the case and two (2) offered comments for

consideration . He displayed images of the site and surrounding views and entered the favorable
recommendation of the Planning Commission into the record as written .
Janet Lundquist, Department of Public Works representative , provided a brief overview of
the transportation plans and requirements . stating the access is a shared access off of County
Road (CR) 52. She clarified the number of round trips and requirements for tracking control and
an Improvements Agreement.
P Wayne Howard , Planning Services Engineer representative, reviewed the drainage and
grading requirements. In response to Chair Freeman , Mr. Howard clarified that Condition of
Approval (COA) #1 . D can be stricken due to having met this requirement.
Lauren Light, Department of Public Health and Environment. provided the water and sewer
provisions stating a portable toilet will be on-site and Development Standards (DS) #6- 12 address
typical Environmental Health items .
Doug Dennison , applicant, stated this is the second storage yard they have permitted
through the County, which is beneficial for storing and staging equipment in the field closer to
operations . thereby eliminating truck traffic. He explained they are in the process of
commissioning a water gathering line to deliver water by pipeline , which will further reduce truck
traffic.
IR In response to Commissioner Moreno , Mr. Dennison stated he is certain there are snakes
and rodents out there, as it is a remote rural site. Mr. Dennison also stated the lighting is on a
switch system .
No public testimony was offered concerning this matter.
In response to Chair Freeman , Mr. Dennison indicated no concerns with the Conditions of
Approval or Development Standards.
Chair Freeman reviewed the deletion of COA #1 . D for the applicant.
In response to Chair Freeman , Mr. Dennison indicated they have reviewed . and agree to
abide by, the Conditions of Approval and Development Standards . as amended .
Commissioner Moreno moved to approve the request of Circle B Land Company. LLC , c/o
M3 Construction , LLC , for a Site Specific Development Plan and Use by Special Review Permit,
USR15-0078 , for a Mineral Resource Development, including Oil and Gas Support and Service
(storage of tanks , vessels, pipe racks , other oil and gas production equipment and more than one
cargo contain as an accessory structure) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission , with the Conditions of Approval
and Development Standards as amended and entered into the record . The motion was seconded
by Commissioner Conway. who also stated these staging sites are mutually beneficial in remote

locations and that he is pleased with the proposed water gathering line. The motion carried
unanimously and the hearing was completed at 10 :44 a. m .
This Certification was approved on the 4th day of April , 2016 .
