BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
JUNE 1, 2016
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, June 1, 2016, at the hour of 9:00 a.m.
Ei ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of May 25, 2016, as printed. Commissioner Moreno seconded the motion, and
it carried unanimously.
el AMENDMENTS TO AGENDA: Commissioner Cozad moved to add the following under New
Business as number 18) Consider Agreement Concerning Purchase of Permanent Easement for the
Weld County Parkway LNG Fueling Station and authorize Chair to sign all necessary documents -
Roadifer Revocable Living Trust. The motion was seconded by Commissioner Conway, and it carried
unanimously.
CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PROCLAMATIONS:
12 1) PROCLAMATION OF REMEMBRANCE - CHUCK CARLSON: Chair Freeman read the
proclamation for the record. Each one of the Commissioners recognized the civic contributions made by
Mr. Carlson and extended their appreciation for him being a founder of the Home Rule Charter. (Clerk's
Note: the Board paused for a photo opportunity.)

IR COMMISSIONER COORDINATOR REPORTS: Commissioner Cozad reported that she attended
the NACO Conference and the Commissioners attended the Memorial Services at Linn Grove Cemetery
where Mike Finn, City of Greeley Council member was the honorary speaker and she read the
proclamation on behalf of the Board. Commissioner Conway represented the Board at the Berthoud Hill
ground-breaking. Commissioner Moreno stated he attended the NACO Conference. Commissioner
Kirkmeyer commended the COG team and announced she had the opportunity to meet with the Union
Pacific Railroad to discuss the U.S. Highway 85 right-of-way. Chair Freeman reiterated the importance
of the NACO conference the Board attended.
BIDS:
la---" 1) APPROVE BID #B160093, ROOF REPLACEMENT (JAIL PORTION) - DEPARTMENT OF
BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, reviewed the nine (9) bids
received and stated staff recommends awarding the low bid from Empire Roofing Company, in the
amount of $23,929.63. Commissioner Conway moved to approve said low bid. Seconded by
Commissioner Moreno, the motion carried unanimously.
?E 2) APPROVE BID #B1600097, ROAD BASE SUPPLY (CLASS 6) - DEPARTMENT OF PUBLIC
WORKS: Mr. Jiricek presented the five (5) bids received and recommended awarding the bids as outlined
in staff's memo. Commissioner Cozad moved to approve said bids as recommended by staff in the memo.
The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.
NEW BUSINESS:
• 1) CONSIDER CONTACT AMENDMENT #2 FOR 2015-2018 COMMUNITY SERVICES BLOCK
GRANT (CSBG) AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of Department of Human
Services, presented the amendment for reimbursement of operating costs and other various services.
Commissioner Moreno moved to approve said amendment and authorize the Chair to sign. The motion,
which was seconded by Commissioner Kirkmeyer, carried unanimously.
IR 2) CONSIDER AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN - CATHOLIC
CHARITIES OF WELD COUNTY: Ms. Griego reviewed the agreement for reimbursement for up to
fourteen (14) nights of stay for the homeless. In response to Commissioner Conway, Ms. Griego
explained if there are agencies wanting to shelter the homeless they need to apply for funds.
Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded by
Commissioner Moreno, the motion carried unanimously.
12 3) CONSIDER AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN - GREELEY
TRANSITIONAL HOUSE: Commissioner Moreno moved to approve said agreement and authorize the
Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
• 4) CONSIDER AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN -A WOMAN'S
PLACE: Commissioner Cozad moved to approve said agreement and authorize the Chair to sign. The
motion, which was seconded by Commissioner Conway, carried unanimously.
O 5) CONSIDER TASK ORDER CONTRACT AMENDMENT #2 FOR CHILD FATALITY
PREVENTION SYSTEM AND AUTHORIZE CHAIR TO SIGN: Dr. Mark Wallace, Director of Department
of Public Health and Environment, reviewed the terms of the agreement for the amount of $12,500.00.
Commissioner Conway moved to approve said task order amendment and authorize the Chair to sign.
The motion, which was seconded by Commissioner Cozad, carried unanimously.

IR 6) CONSIDER TASK ORDER CONTRACT AMENDMENT #2 FOR WOMEN'S WELLNESS
CONNECTION AND AUTHORIZE CHAIR TO SIGN: Dr. Wallace reviewed the details of the amendment
for women's wellness connection for the uninsured and under insured population. In response to
Commissioner Conway, Dr. Wallace explained since implementing the program there have been five (5)
cases of early detected breast cancer. Commissioner Conway moved to approve said contract
amendment and authorize the Chair to sign. The motion, which was seconded by Commissioner
Kirkmeyer, carried unanimously.
IR 7) CONSIDER TASK ORDER CONTRACT FOR YOUTH SUBSTANCE ABUSE PREVENTION
INITIATIVE AND AUTHORIZE CHAIR TO SIGN: Dr. Wallace presented the terms of the contract which
is supported by the Colorado marijuana tax. Commissioner Cozad stated this is an important program
and moved to approve said task order and authorize the Chair to sign. Seconded by Commissioner
Conway, the motion carried unanimously.
O 8) CONSIDER VETERAN'S SERVICE OFFICER'S MONTHLY REPORT AND CERTIFICATION
OF PAY FOR APRIL, 2016, AND AUTHORIZE CHAIR TO SIGN: Toby Taylor, Veterans Officer,
presented the report for April, 2016, and stated the office received 454 phone calls and 459 office visits.
Commissioner Kirkmeyer moved to approve report and certification for pay for April, 2016, and authorize
the Chair to sign. Commissioner Conway seconded the motion, and it carried unanimously.
• 9) CONSIDER QUOTE FOR SECURITY INTELLIGENCE PLATFORM AND AUTHORIZE CHAIR
TO SIGN - LOGRYHTHM, INC: Mike Wallace, Director of Public Safety Communications, presented the
quote for a security and monitoring system. Commissioner Conway moved to approve said quote and
authorize the Chair to sign. The motion, which was seconded by Commissioner Moreno, carried
unanimously.
e 10) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES AND AUTHORIZE CHAIR TO
SIGN - THE BLUE CELL, LLC: Roy Rudisill, Director of the Office of Emergency Management, reviewed
the terms of the agreement. Commissioner Kirkmeyer moved to approve said agreement and authorize
the Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously.
El 11) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR TIER II HAZARD RISK
ASSESSMENT AND AUTHORIZE CHAIR TO SIGN - ARISTATEK, INC: Mr. Rudisill stated this
agreement will assist local emergency agencies complete a risk and hazard assessment. Commissioner
Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion was seconded
by Commissioner Moreno, and it carried unanimously.
IR 12) CONSIDER AGREEMENT FOR RELOCATION OF POTABLE WATER FACILITIES FOR CR
49 CORRIDOR EXPANSION PROJECT AND AUTHORIZE CHAIR TO SIGN - CENTRAL WELD
COUNTY WATER DISTRICT: Cameron Parrot, Department of Public Works, reviewed the details of the
agreement for relocation of potable water facilities. Commissioner Kirkmeyer moved to approve said
agreement and authorize the Chair to sign. Commissioner Moreno seconded the motion, and it carried
unanimously.
El 13) CONSIDER TEMPORARY CLOSURE OF CR 57 BETWEEN CRS 64.5 AND 66: Janet
Lundquist, Department of Public Works, presented the details of the closure effective May 31, 2016,
through June 3, 2016, and stated staff will use water for dust abatement and standard road signs and
barricades. In response to Commissioner Conway, Ms. Lundquist explained staff has worked to

coordinate schedules with irrigation ditch companies. Commissioner Moreno moved to approve said
temporary closure. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.
ER 14) CONSIDER TEMPORARY CLOSURE OF CR 53 BETWEEN CRS 34 AND 36: Ms. Lundquist
reviewed the closure effective June 21, 2016, through June 24, 2016, and stated staff will use magnesium
chloride for dust abatement, and message boards in advance. Commissioner Cozad moved to approve
said closure. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
12 15) CONSIDER TEMPORARY CLOSURE OF CR 53 BETWEEN CRS 40 AND 42: Ms. Lundquist
presented the closure effective June 14, 2016, through June 17, 2016, and stated staff will be using
magnesium chloride for dust abatement and standard road signs and barricades, with message boards
in advance. Commissioner Cozad moved to approve said closure. Seconded by Commissioner Conway,
the motion carried unanimously.
• 16) CONSIDER TEMPORARY CLOSURE OF CR 4 BETWEEN CRS 91 AND 95: Ms. Lundquist
reviewed the closure effective June 14, 2016, through June 17, 2016. Staff will use standard road signs
and barricades. Commissioner Conway moved to approve said temporary closure. The motion, which
was seconded by Commissioner Kirkmeyer, carried unanimously.
E2 17) CONSIDER TEMPORARY CLOSURE OF CR 61 BETWEEN CR 68 AND STATE
HIGHWAY 392: Ms. Lundquist requested a closure for the replacement of Crow Creek Bridge effective
June 27, 2016, through October 28, 2016. In response to Commissioner Cozad, Ms. Lundquist confirmed
she coordinated with CDOT, and will inform them when there is a detour route. Commissioner Conway
suggested coordinating with Noble Energy and Wells Ranch. Commissioner Kirkmeyer moved to approve
said closure. Commissioner Moreno seconded the motion, and it carried unanimously.
IR 18) CONSIDER AGREEMENT CONCERNING PURCHASE OF PERMANENT EASMENT FOR
THE WELD COUNTY PARKWAY LNG FUELING STATION AND AUTHORIZE CHAIR TO SIGN
NECESSARY DOCUMENTS - ROADIFER REVOCABLE LIVING TRUST: Tiffane Johnson, Department
of Public Works, presented the details of the agreement for the amount of $860.00. Commissioner
Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion, which was
seconded by Commissioner Cozad, carried unanimously.
PLANNING:
• 1) SECOND READING OF CODE ORDINANCE#2015-26, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING (OIL AND GAS), OF THE WELD
COUNTY CODE (CON'T FROM 5/9/2016): Commissioner Conway moved to read Code Ordinance
#2015-26 by title only. The motion, which was seconded by Commissioner Kirkmeyer, carried
unanimously. Bruce Barker, County Attorney, read the title for record. Tom Parko, Director of the
Department of Planning Services, requested this be continued to allow work sessions for review of the
comments recently received. No public testimony was offered concerning this matter. Commissioner
Cozad moved to continue the second reading to July 11, 2016, and the final reading to August 8, 2016.
The motion was seconded by Commissioner Moreno, it carried unanimously.
2) FINAL READING OF CODE ORDINANCE #2016-06, IN THE MATTER OF REPEALING AND
REENACTING WITH AMENDMENTS, CHAPTER 20 IMPACT FEES, and OF THE WELD COUNTY
CODE: Commissioner Moreno moved to read Code Ordinance #2016-06 by title only. The motion was
seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read the title for the record.
Mr. Parko stated there have been no changes since the second reading. No Public testimony was offered

concerning this matter. The motion to approve on Final Reading, which was made by Commissioner
Moreno and seconded by Commissioner Cozad, carried unanimously.
3) CONSIDER ZONING PERMIT FOR ACCESSORY STORAGE, ZPAS16-0002 - CARR, LLC, C/O
MONICA SWEERE : Wendi Inloes, Department of Planning Services, presented the details of the zoning
permit for a semi-trailer being used as accessory storage and displayed a photo of the property. Monica
Sweere, resident of Fort Collins, explained the property was purchased with the intent to build a family
home on it and she assumed placing the semi-trailer was an allowable use on the parcel because there
were trailers stored on other neighboring properties. Furthermore, when they discovered they were in
violation they applied for a permit. In response to Commissioner Cozad, Ms. Sweere explained the
contents of the trailer contain building materials, other personal possessions and will be removed once
the home is built. Ms. Sweere stated they are reevaluating if they want to build a home; but they have
intent to build within the next 18 months or sell the property. Ei Bruce Ransier, resident of Carr,
reviewed the issues with the land owner having a trailer set on the parcel and would not like to see the
unsightly storage left on the property. Commissioner Conway questioned if there is some
accommodations that can be made to help out the neighbor with establishing and building a home. Mr.
Ransier would like a reasonable time frame established. 0 Bree Lukens, resident of Carr, expressed
concerns that the property owner will not abide by the Weld County Code and the zoning requirements.
Ms. Lukens states the semi-trailer is not compatible with the A (Agricultural) Zone in the middle of town.
In response to Commissioner Cozad, Ms. Lukens stated there are thirty (30) residents that have a cargo
trailer or RV stored on their property. El Linda Lacock, resident of Carr, stated she is opposed to the
owner using this parcel as a dumping ground. Commissioner Cozad proposed the possibility of a time
limit on this permit and inquired if the residents would be open to allowing this trailer on the property if
there was a time limit. CI Christine Schnieder, resident of Carr, explained they aren't opposed to having
new neighbors move in, but she would like to see this property taken care of, and she has concerns that
the land owners have never reached out to the residents of Carr to communicate the intent of the property.
Jackie Newbower, resident of Carr, expressed her concerns that she feels the property owner is
going to build commercial business and not a residence. Ms. Newbower stated she would accept a time-
frame for the permit and a limit of how many trailers can be stored on the property. Cl Willa Hintergardt,
resident of Carr, stated she would like to see the applicant meet the following requirements: the first being
that the applicant come into full compliance with the application within thirty (30) days, provide a complete
and full explanation of how the Carr, LLC semi-trailer meets the standards of an accessory storage trailer,
a full explanation of the intended use of the property, and that the trailer be inspected for safety.
0 Ms. Sweere explained they have not applied for a well permit, because she wasn't quite sure of the
water usage from the home. She stated she would be grateful if the Commissioners granted a permit for
18 months, so she would have more time to decide if she wanted to build a home on the parcel. She
expressed her surprise at the reaction she has received from the neighbors because she believed she
meets the requirements per the Code. Commissioner Conway requested a commitment from the
applicant about building her home so the trailer doesn't sit there for 18 months. Ms. Sweere expressed
there is a double-standard when it comes to her trailer because many of the other residents have more
than one trailer parked on their properties. C Commissioner Moreno expressed hesitancy at granting
a permit for 18 months because of a lack of commitment from the applicant. Commissioner Kirkmeyer
stated she is in favor of granting an 18-month permit, with the requirement that a building permit be
applied for within the next 60 days. El Commissioner Cozad stated she is in favor of granting the
18-month permit, with conditions and allow them 60 days to make a decision about building a home.
Commissioner Conway stated he is in agreement with granting the permit and tying it to a building permit
being applied for within the next 12 months, with a six (6) month extension available. Commissioner
Moreno referred back to legal counsel. El Mr. Barker stated there is no section of the Code that allows

for a time limit; he suggested the following condition be added: "This permit is granted for accessory use
of a semi-trailer being used for storage during construction of a single-family dwelling on the parcel, being
no more than eighteen (18) months from the date of signing of this Resolution. And such accessory use
shall end if no building permit for a single-family dwelling permit is applied for and received within 60 days
of the signing of this Resolution." Commissioner Kirkmeyer moved to approve ZPAS16-0002, with the
conditions as listed in the Resolution and the addition from the County Attorney. The motion was
seconded by Commissioner Conway. a Commissioner Kirkmeyer acknowledged that she hopes the
neighbors and the applicant can come to an understanding and find a welcoming environment. The
motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2016-06 was approved on Final Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 11:21 a.m.
