COMER. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on July 6, 1977 in the Chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Robert E. Resolution May 17, 1977 Page 2 development is located adjacent to an existing municipality (City of Greeley) and in compliance with the Comprehensive Plan of that Municipality. 3, The City of Greeley Planning Commission has recommended this rezoning request be approved since the proposed commercial use agrees with the City's Comprehensive Plane 4. The Weld County Health Department has indicated that the proposed commercial development is in compliance with Weld County and State Health Standards and Regulations. 5, The Weld County Engineering Department indicated no engineering problems could be identified, 6. The Western Hills Fire Protection District indicated they had no problems with the approval of this request, 7. The applicant has submitted a petition form signed by several of the surrounding property owners in support of Mr. Comer's request. To date our office has not received any opposition to this rezoning request from any of the other surrounding property owners. Comment : 1, The Commercial Unit Development Plans shall be amended to reflect the access limitations as defined in the development standards prior to recordation of the plans. Comer Commercial Unit Development Development Standards 1. The permitted uses on the hereon described property are: a. The manufacture and storage of formed plastic products by the use of vacuum and thermo-forming equipment, b. A tooling and machine shop which is utilized to fabricate molds and dies for vacuum and thenru-forming equipment, c. Retail and wholesale distribution of formed plastic products, and d. An office area These permitted uses shall be conducted within the facilities and structures shown on the unit development plans. No facilities or structures in addition to those shown and approved on these plans shall be permitted unless this unit development plan is amended to reflect those requested changes. 2. The following structures shall be removed: a. 10' x 30' wood frame building b. 25' x 25' ("L" shaped) wood frame building c. 3 steel storage tanks d. Pump house e. Existing corrals and fencing, and f. The concrete islands and light posts of the former service station. 3. The setbacks for all structures shall comply with the requirements of Sections 3.14 and 3.15 of the Weld County Zoning Resolution. 4. Twenty-seven asphalt paved parking spaces shall be provided as shown on the plans. 5. Landscaping shall be provided as follows: a. Lawn areas shall be established as shown on the plans, and b. A windbreak shall be planted along the south border of the property. 6. One 5' x 7' sign may be installed on the front lawn as shown on the unit development plans. 7. Access shall be limited as follows: a. Access onto U.S. Highway 34: 1. Only one 35' access shall be permitted, 2. The east side of said 35' access shall be located a minimum of 160 feet from the centerline of Cherry Avenue, and 3. A driveway permit shall be obtained from the State Department of Highways. b. Access onto Cherry Avenue: 1. Open access shall be permitted for the full frontage onto Cherry Avenue except access shall not be permitted within 50 feet of the existing south right-of-way line of U.S. Hwy. 34. 8. As shown on the unit development plans, an additional 20' right-of-way for U.S. Highway 34 shall be reserved. 9. All applicable Weld County and State Health Standards and Regulations shall be adhered to. 10. The property in question shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and the growth of noxious weeds. 11. The Unit Development Plans shall be limited to the facilities as shown on the plans submitted and governed by the development standards stated above and all applicable Weld County Regulations. Anv changes to the plans and/or the development standards shall require the approval of an amendment to this Unit Development Plan. Is it impractical, impossible, or undesirable to develop the land according to its current zoning classification? At this time, the property is zoned estate residential. We do have a "Variance of non-conforming use" for the use of the existing buildings on the property for the specific intent of plastic sign and other plastic products manufacture by the use of vacuum and thermo-forming machines. However, due to the immense amount of business which has generated within the past few months, we now or will soon require expansion to a much larger facility. It is undesirable to develop this property according the existing zoning classification or to extend a "Variance of non-conforming use". 2. Would the proposed rezoning benefit the entire county by allowing a typical development which is needed and cannot locate in other parts of the county? This particular location is not within the incorporated area of Greeley, however, it is outlined on Greeley's comprehensive plan as being an area of future commercial use. Our "type" of business would qualify as one which would be permitted within a commercial district (with restrictions) since it is a "clean" operation. By "clean", we would be defined as one which has no fumes or noxious odors arising from the facility, no smoke or steam generated by the equipment or buildings, no pollutants or radioactive materials dumped on or drained out on the property or any other method of contamination of the environment. 3. Would the proposed rezoning benefit the lands adjoining the area requesting the change? Should the property be zoned commercial, we feel the adjoining lands would be benefited since it may encourage further commercial development of land in this area. Should the expanded use of this area by commercial developers continue, this proposed location may be incorporated within the city in the near future, benefiting all of us with city police protection, fire protection, sewage lines, road maintenance, and general property cost stabilization. 4. What features apply to the property requesting rezoning which would make it logical to rezone this tract and not to rezone in a similar manner surrounding properties which may have like land use characteristics? The frontage property (to US Highway 34) whichwe request be considered zoned commercial is on a main route of traffic between Greeley and Ft. Morgan. Why are other areas in the county already zoned according to the requested classification, unsuitable for the development which is proposed? The size of the proposed facility and the large potential of future expansion requires that we have access to a larger plot of property. Other areas within the county which presently fall under commercial use zoning are prohibitive for this reason and also because of the higher cost of that property. 6. What proof of evidence is available that the original rezoning is faulty or that changing conditions in the area justify the rezoning at this time? Changing conditions rather than faulty original zoning warrants this request for zoning change. This particular site was at one time a gasoline service station with a 2,300 square foot cement block building on the property. Property both east and west of this site is presently zoned business and industrial and includes a motel, farm equipment distributor (LuDerts), machine shop, wood planing shop, vegetable stand, commercial center (34 Centre), and a foo d market. This area along East Highway 34 is suitable for commercial use because of its frontage to a major highway. 7. Please submit economic or other evidence that the area covered by the petition, need additional commercial or business in the area? In Greeley's comprehensive plan, this particular area is outlined for future commercial use. At this time we have no idea when this area may be incorporated within the city. In the same respect, we cannot specifically categorize when or how much economic growth in this area would justify incorporation within the city. However, our proposed facility, Phase I construction, would consist of 11,776 square feet at a cost of $180,000. With the addition of $100,000 to 150,000 of equipment, we intend to operate two (2) 8-hour shifts with employment of 20-30 full time personnel. Projected gross sales is anticipated at $2 million during 1977. Our current customers include Teledyne Water Pik, Kodak, Monfort Beef Packing, Dubuque Meat packing, Circle-C Beef and many others. Expanded sales staff into the Rocky Mountain region will increase our gross in 1982 to $10 million. At that time we will attempt to go into Phase II construction. The proposed building is intended to facilitate equipment which meet the 310 million sales demand. The direct contribution to the community would be in employment and in additional revenue to the economy. By 1982, with $10 million gross sales, we would be employing 50 to 60 full time personnel or equivalent to $1.4 million in wages and salary annually. 8. Give some evidence of the proposed business or commercial enterprise that are to locate in the reqested area and the tenative time schedule for construction. Plastic Art Products, Ltd is primarily involved in forming thin (3) gauge plastic into various shapes and figures such as display packaging, which includes clear plastic covers and shaped or indented bases where the product is displayed. The company is also involved in commercial plastic sign making and in producing plastic sheets which are used to cover the bones on certain cuts of meat in the meat processing industry. The proposed facility will consist of one building approximately 82' x 128' (Phase I construction) and later an addition of 178' x 64' (Phase II construction). The building will be built of prestressed concrete or concrete block with landscaping on three side and paved area on one side. BOB COMER PLASTIC ART PRODUCTS 1226 East 18 Street Greeley The rezoning request involves a change of zone from Estate Residential to Industrial . Mr. Comer explained to Administrative Review Team members that he was representing his business, Plastic Art Products . The business is located on East 18 Street in an unincorporated area of Weld County. Mr. Comer commented that the plastic fabrication operation had been in business for approximately four years at that location. It had been operating in a structure which had previously been commercial in use, and he had been informed in recent conversation with Weld County Planning officials that the plastic products activity at the site was probably technically in violation of the non-conforming use of the previous commercial structure. He continued that in the past four years his company has spent a great deal of time and effort in cleaning up the facility from its previous condition. The neighbors in general support the activity. He explained that Plastic Art Products is primarily a manufacturer of plastic signs and miscellaneous products. The company operates a "Vacuum former" which converts sheets of plastic into different plastic components. Currently the firm manufactures plastic components for Kodak, Waterpik and Monfort of Colorado. The business increases expected in the near future will be enough to warrant a second vacuum former machine. Currently the staff of Plastic Art Products at that location consists of twelve full-time employees and three or four part-time employees. The expansion which Mr. Comer has in mind will involve no increase in staff. However, the proposal would involve an increase in the size of the structure in order to house the expanded activity as well as the expanded storage areas. Mr. Comer commented that it was his intention to remodel the structure, expand it, and landscape the area. That property improvement would also include the removal of a number of large gasoline storage tanks from the property. Mr. Comer continued that the current facility is served by a water tap from City of Greeley water lines on East 18 Street. The property is additionally served by a well which is operating on the site. It is anticipated that no additional water service would he needed to accommodate the new facility. The City of Greeley water tap would be sufficient for the operation. The Western Hills Fire Station is located directly across the street from this facility, and fire protection is assumed to be no problem. No fumes or noxious odors arise from this facility in that it is simply a vacuum-forming operation of plastic sheets. There is no storage of flammable liquid components involved in this operation . Although this item consists of so many variables, such as meteorology, emission values, etc. , there are presently no definite parameters to follow. In development proposals such as hospitals, private residences, etc. , where air pollution is a sensitive issue, the best course of action is to keep them as far away as possible from air pollution sources and out of valleys where pollutants tend to collect. Frank Smith and I made a field check which indicated there is no existing drainage facility in the area. I also contacted Max Karner at the City of Greeley . He indicated site retention was the only way to handle runoff and it was acceptable to him. The Engineering Department will therefore accept the plan as submitted.
