ALLOCATION METHODOLOGY COMMITTEE APPOINTMENTS AND AUTHORIZATION TO MAKE A
BINDING DECISION ON THE AGREED UPON ALLOCATION METHODOLOGY OF FOREST SERVICE FUNDS
TO WELD COUNTY AND WELD COUNTY SCHOOLS AGREEMENT
In accordance with Title III of the Bankhead-Jones Farm Tenant Act (7 U.S.C. 1012), the USDA Forest
Service is required to make payments to counties for receipts from USDA Forest Service land from
grazing fees and mineral receipts. Weld County will be receiving funds from oil and gas extraction
payments from the Pawnee Grasslands located in Weld County. In 2009 House Bill 09-1250 was passed
that created a new methodology to allocate the funds received from the Forest Service. Under the new
allocation methodology 25% of the funds must be used for county roads and bridges, and 25% must be
allocated to the schools in the county. The other 50% is to be allocated between the two purposes at the
direction of a committee of three County Commissioners and three school district representatives.
The purpose of the funds from the Forest Service is to mitigate the impacts of the federal lands to the
county and school districts in the form of a payment in lieu of taxes, since the federal lands are tax
exempt. Even though only five Weld County school districts (Eaton RE -2, Ault -Highland RE -9, Briggsdale
RE -11, Prairie RE -11, and Pawnee RE -12) are located in the 192,930 acres of the Pawnee Grasslands
under HB 09-1250 the amount of funds allocated to each school district in the county shall be in the
proportion that its pupil enrollment during the preceding school year bears to the aggregate pupil
enrollment in all districts in the county during said preceding school year.
In accordance with HB 09-1250 school districts within each county receiving such funds shall select a
total of three representatives to meet with three County Commissioners to discuss the allocation of the
unallocated portion of the funds. There is no statutory guidance or no statutory requirement how the
three school district representatives will be selected. This is at the discretion of the local school districts.
The three Weld County school district selected by all the Weld County school districts to serve on this
committee per HB 09-1250 are:

ALLOCATION METHODOLOGY COMMITTEE APPOINTMENTS AND AUTHORIZATION TO MAKE A
BINDING DECISION ON THE AGREED UPON ALLOCATION METHODOLOGY OF FOREST SERVICE FUNDS
TO WELD COUNTY AND WELD COUNTY SCHOOLS AGREEMENT
In accordance with Title Ill of the Bankhead-Jones Farm Tenant Act (7 U.S.C.
• Superintendent of Weld School District RE -5J Johnstown -Milliken
• Superintendent of Weld School District RE -9 Ault -Highland
• Superintendent of Weld School District RE -12 Pawnee
In accordance with HB 09-1250 it is necessary for all Weld County school districts receiving Forest
Service funds allocated under HB 09-1250 to formally authorize the three selected school
representatives to make a binding decision on the agreed upon allocation methodology. The funds
received by the county cannot be allocated until an agreement is reached by the committee of the three
County Commissioners and three school representatives. Therefore, the undersigned on behalf of the
school district indicated below hereby agrees to authorize the above three school district
representatives to make a binding decision on the agreed upon allocation methodology on behalf of the
school district indicated below.
Since it is anticipated with the oil and gas development in the Pawnee Grassland there will be these
Forest Service revenues in the future, so the methodology developed will be used for future yearly
allocations also. Therefore, this agreement and authority shall remain in place until rescinded in writing
by the school district indicated below.
The undersigned hereby certifies that he or she has authority to sign this said agreement on behalf of
the school district indicated below.
