RE: APPROVAL OF RECORDED EXEMPTION NO. 310 - JIMMIE & EULENE
SHOOK.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing
held on the 27th day of March, 1978 , in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of a certain parcel of land, as
shown on the plat known as Recorded Exemption number 310, being
the property of Jimmie & Eulene Shook, described as Part of the
SWa of Section 25, Township 2 North, Range 68 West of the 6th
P.M. , Weld County, Colorado, being more particulary described
as follows:
A Tract of land located in the Southwest Quarter (SWa)
of Section 25, T2N, R68W of the 6th P.M. , in Weld
County, Colorado; said tract being more particularly
described as follows:
Beginning at a Point on the West line of said Section 25
fran whence the Southwest corner of said Section 25 bears
500°29'00" W, 366.35 Feet; Thence N00°29'00" E, 989.95 feet;
Thence S89°31'00" E, 422.70 feet to a point on the approximate
Centerline of the Sullivan Ditch; Thence along said Centerline
of the Sullivan Ditch the following courses and distances:
S00°18'00" E, 222.82 Feet; S11°29'00" W, 210.00 Feet;
S21°37'00" W, 230.00 Feet; S37°58'00" W, 265.00 Feet;
S00°40'00" E, 135.50 Feet;
Thence N89°48'00" W, 144.27 Feet to the Point of Beginning,
Thus described Tract containing 7.304 acres.
All bearings relative to the West line SWa, Sec. 25 Taken as

does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-lA(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Jimmie and Eulene Shook, be, and
hereby is , exempt from the definition of the terms , "sub-
division" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
March, A.D. , 1978.

Dear Commissioners :
The attached application, plat , and related materials are in reference
to a request by Jimmie & Eulene Shook for a lot size variance and recorded
exemption . The parcel of land in question is described as Pt . SW4 Section
25, T2N, R68W of the 6th P.M. , Weld County, Colorado. The property con-
tains 7. 3 acres of Class II irrigated soils . The request is to split the
property into parcels of 3. 507 acres and 3 . 797 acres . This property is
located 1 mile west of the Town of Frederick. The east property line of
the property is the Sullivan Ditch. As indicated by the Shooks in a
letter dated February 23 , 1978, they wish to obtain relief from the in-
flationary costs of constructing a home on the proposed Parcel B.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be ap-
proved for the following reasons :
1 . The proposed split conforms with the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivision Reg-
ulations) and the Weld County Comprehensive Plan since the use will
be compatible with the surrounding agricultural uses . The 7 acre
parcel in question has low utility for agricultural use due to the
small acreage involved.
2 . The Town of Frederick has recommended approval of this request .
3 . The Tri-Area Planning Commission has indicated they have no objec-
tions to the request .
4. The request complies with the provisions of Section 9-4(A) of the
We . County Subdivision Regulations.

Gentlemen:
This letter, the attached survey, and related materials
constitute our request to seek a recorded exemption to divide
our 7 . 3 acre tract into two parcels as described in the follow-
ing data.
Parcel A shall be comprised of 3. 507 acres more or less as
described in the attached survey. Union REA power service is
available to the property. Domestic water service can be pro-
vided by Weld Central Water District of Greeley. An approved
septic system would complete the essential services to the home-
site.
Parcel B shall be comprised of 3 . 797 acres more or less as
described in the survey. It has an existing four bedroom bi-level
home situated thereon and serviced by utilities as stated for
parcel A.
We seek this split to obtain some relief from the infla-
tionary costs of constructing the home on parcel B. We believe
the proposed splits would yield homesites generally compatible to
others in the area and specifically agreeable to the land form of
the 7. 3 acre tract. Thus, we could afford the more reasonably
priced home and homesite.
