WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 31st day of October, 1977 , in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land, being the property of Gladys Pearson, located on the W1 of the NEB of Section 34 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, and more particu- larly described as follows, to-wit: The W1 of the NEQ of Section 34, Township 6 N, Range 65 W of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the NE Corner of said Sec. 34, and consid- ering the North line of said Sec. 34 as bearing North 90°00'00" West, with all other bearings contained here- in relative thereto; thence North 90°00'00" West, along said North line, 1322.35 feet to the True Point of Beginning; thence continuing North 90°00'00" West, along said North line, 1322.35 fact; thence South 01°10'00" East, 2646.15 feet; thence South 89°59'45" East, 1320.44 feet; thence North 01°07'31" West, 2646.21 feet to the True Point of Beginning. The parcel of land is described as the W; of the NE* of Section 34, TSN, R65W of the 6th P.M. , Weld County, Colorado. Said property is located l ; miles north of the Weld County Municipal Airport . The subject property contains 80. 256 acres of Class II and III irrigated soils . The request is to split the property into parcels of . 870 acres and 79. 386 acres. Both of the two resulting parcels would contain an existing set of improvements. As explained in a letter dated October 6, 1977, submitted by Ralph E. Waldo, Jr. , the request is to sever the .870 acre parcel with an existing house as the homesite for Gladys Pearson who owns the entire 80 acre parcel in conjuntion with her two sisters and brother . Based upon the information submitted and the adopted policies in the county, the Department of Planning Services Staff recommends the request be approved for the following reasons: 1 . The proposed split conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regu- lations) , the intent clause of the Agricultural District (Section 3. 3a of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that each resulting parcel would have an existing set of improve- ments and the use would be compatible with the surrounding agricultural uses. 2. The City of Greeley Planning Commission has indicated they have no opposition to the approval of this recorded exemption. 3. Pearson and Louise E. Wymore as Trustees of the Henry Rothlisberger Trust dated November 6, 1972. The reason this Recorded Exemption is requested is that Gladys V. Pearson has resided in the residence property on this quarter section of land for approximately ten years and, during this time, she and her husband have assisted in looking after her father, Henry Rothlisberger, and her mother , and have in the past operated a dairy there. The farm has been left to Gladys V. Pearson and her two sisters and brother. This farm has been the home of Gladys Pearson for most of her life. She wishes to stay there and it is the wish of the brother and two sisters to convey to her their interest in this residence and almost an acre of land so that she can be the owner of it and continue to make that her home. At the present time and for some years, there have been two residence properties on this property. The Recorded Exemption as requested would make the dividing line between the two houses, which is a line of trees and a small irrigation ditch, the division line and the property being subdivided out would then eventually be deeded to Mrs. Pearson as her property. Mrs. Pearson is already an owner of one-fourth of the property and her two sisters and brother are the owners of the other three- fourths of the property. The water has been obtained from the North Weld County Water District for some years and a septic tank and leach field have been in operation and been successful for a goodly number of years for both residences on the place.
