WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 18th day of July, 1979 at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Vernon and Alice Noble, 7600 Plateau Road, Longmont, Colorado 80501, for the granting of a Special Use Permit for a hog opera- tion on the following described real estate, to-wit: A tract of land in the Southwest Quarter of Section 5, Township 3 North, Range 68 West of the 6th P.M. , in Weld County, Colorado and being more particularly described as follows: Beginning at the West Quarter corner of said Section 5, thence South along the West line of said Section 5, 1113. 15 feet, thence South 89°52 ' 15" East, 334. 49 feet to a point on the approximate centerline of the Howard Lateral Ditch, thence along said approximate centerline of said Howard Lateral Ditch the following courses and distances: South 17°19' 20" East, 182. 98 feet; South 31°39 ' 18" East, 514. 70 feet; South 86°31' 16" East, 192. 33 feet to a point of intersection of the aforementioned Howard Lateral Ditch and a large eroded drainage ditch (Holmes Draw) bearing Northeasterly, thence along the approximate centerline of said drainage ditch the following courses and distances : North 68 °15' 57" West, 116. 47 feet; North 17°42' 54" West, 94. 05 feet; North 43°56' 24" East, 332. 20 feet; North 14°48 ' 43" West, 100. 55 feet; North 31°10' 34" East, 364. 123 feet; North 61°19' 49" East, 73. 94 feet; Thence North, 922. 73 feet to a point on the North line of the aforementioned Southwest Quarter, Section 5; Thence South 89°58 ' 34" West, 1172. 43 feet to the point of beginning; Thus described tract containing 35. 000 acres. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a hog operation on the abovedescribed real estate, and 79u :> a PR 11 WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a hog operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the petitioners for a Special Use Permit for a hog operation on the hereinabove described tract of land be, and hereby is, granted subject to the Development Standards contained in the Special Use Permit noting that Development Standard #3 has been met and deleting Development Standard #8 because the Board feels that the applicants have substantially met the requirements of the Plan- ning Commission due to only a 6-week period between applicants ' construction of the house and the Water District' s change to a 4-inch line. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated June 5, 1979 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Section 3. 3 . (E)(2) and 6 . 1(4) of the Weld County Zoning Resolution . The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county . This determination is based upon the following : A. The proposal is for an agri-business in the agriculturally zoned area, with existing land uses being predominantly agricultural . B. The following referral agencies have set forth no objections to this request : 1. Weld County Engineering Department , letter dated May 22 , 1979 . 2 . The Berthoud Fire Department , letter dated May 15, 1979 . 3. Weld County Extension Services, letter dated May 16 , 1979 . 4 . Colorado Geological Survey , letter dated May 16 , 1979 . 5 . Longmont Soil Conservation District , letter dated May 22 , 1979 . The Planning Commission recommendation for approval is conditional upon the following: 1. The attached Development Standards being recommended and approved for the Special Use Permit . 2. No building or electrical permits for the hog operation shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services . 3 . The Planning Commission ' s recommendation for approval is subject to the applicant showing the Board of County Commissioners that Mr. Noble has written assurance of an adequate water supply for the operation in the form of a certified letter from Little Thompson Valley Water District and further that an additional Development Standard be added which would not allow a tap into the existing Little Thompson Valley Water District line until it is enlarged. • Vernon and Alice Noble - SUP DEVELOPMENT STANDARDS 1. The permitted uses on the hereon described parcel shall be a hog farrowing and finishing operation and shall be limited to the facilities shown which are designed to handled a total of 600 head of hogs. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission , and sanitary disposal systems . 4 . Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968 . The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division . 5 . All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6 . There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 7. There shall be no permanent structures allowed in the ditch right-of-way easement as shown hereon . 8. No water tap shall be permitted into the existing Little Thompson Valley Water District water lines from subject property until said water lines are in fact enlarged. 9. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. Comments: 1. The Town of Mead Planning Commission has reviewed the request and stated in a letter dated May 22, 1979 that the Board moved and seconded that no action be taken for or against this request . 2. The Howard Lateral Ditch Company has reviewed the application and requested in a letter dated May 15, 1979 ample room in order to clean the ditch. A 40 ' easement exists on the plat for the ditch company ' s access to the ditch. 3. The Weld County Health Department has reqviewed the request and has several recommendations which have been incorporated into the attached Development Standards . 4. To date our office has received 2 letters opposing this request for a Special Use Permit for a hog operation. A public hearing was conducted On July 18 , , 1979 at 2: 00 P . RUSSELL ANSON PLANNING DEPARTMENT REPRESENTATIVE, TOM HONN 'The following business was transacted : I hereby certify that pursuant to a notice dated June 11, 1979 duly published June 14 , 1979 and July 5 , 1979 in the Platteville Herald, a public hearing was held on the request of Vernon and Alice Noble for a Special Use Permit for a hog operation. Mr. Vernon Noble was present for the hearing and reviewed his plans. No one in attendance at the hearing was opposed to the granting of the special use permit. The Weld County Planning Commission recommended that this request be approved with development standards and conditions. After all the testimony was received, Commissioner Steinmark made a motion to approve Special Use Permit #393, noting that condition #3 has been met sufficiently, accepted all the development standards except #8 , because the six week delay is a reasonable time in which to allow the operation to be hooked up to the water line, and that development standard #9 be renumbered to be #8 . Commissioner Roe seconded the motion and it carried unanimously. Mr. Honn asked the Board to inform the Planning Commission of reasons when a decision is made different from their recommendation. The Planning staff' s recommendation was to continue the request to the June 19, 1979 Planning Commission meeting. NW4 SW4j Section 36, T6N, R66W LOCATION : Northeast of the intersection of 35th Avenue and F Street, south and west of the railroad tracks APPEARANCE: Glenn Billings DISCUSSION: Mr. Billings stated that Mr. Erickson is in the housing construction business and is presently renting office space, but does not have adequate facilities to store his equipment and material . He now desires to construct an office building for this purpose and would Planning Commission "inutes 'Page 2 ' June 5, 1979 like to build an additional small office which would be rented out. The remainder of the buildings to be built in the future will be for dry storage. He then discussed the recommendations by the City of Greeley as regards the entrance to the site and comments by the Colorado and Southern Railroad Company. There being no questions at this time, Tom Honn read the Planning Staff' s recommendation for approval and the Development Standards . Mr. Otis then asked if Mr. Erickson was willing to bear the cost of some of the items as stipulated in the Development Standards (i. e. , landscaping) . Mr. Erickson stated he felt there would be no problem concerning this . Mr. Otis was also concerned that this could perhaps have a junkyard appearance, but this will be screened from surrounding neighbors . MOTION: Be it therefore resolved to recommend approval based on the staff ' s recommendation with the Development Standards to the Board of County Commissioners . Motion by Jerry Kiefer, seconded by Fred Otis . A vote of "aye" was cast by Percy Hiatt, Ben Nix, Fred Otis , Jerry Kiefer, Frank Suckla, and Bette Kountz. Chuck Carlson cast an abstention vote. Motion carried. APPLICANT: Darrell and Donna Uhrig CASE NUMBER: CUP-48 : 79 :8 SUBJECT : Single Family Residence on a Parcel under the Minimum Lot Size LEGAL DESCRIPTION: Pt. Nz SEk, Section 18, T2N, R67W LOCATION: Approximately 1 mile north of Firestone APPEARANCE : John Dent DISCUSSION: Mr. Dent stated that the Uhrig' s wish to construct a residenc on this 40 acre parcel and also wish to conduct a swine farrowing operation of approximately 30 sows . He stated that to his knowledge he knows of no objections from surrounding neighbors and feels the use is consistent with the surrounding uses . There being no questions at this time, Tom Honn read the staff' s recommendation for approval and the Development Standards. Mr. Dent then couauented on one of the comments in the staff recommendation regarding the septic system. He stated that there has been some confusion regarding this in that there is presently no septic system on the property. The Uhrig' s are waiting for approval or denial of the Conditional Use Permit before proceeding with the installation of a system. The Health Department had inspected the property in front of the Uhrig' s which is completed. Mr. Suckla commented that he had viewed the property and feels the Uhrig' s are doing a good job and that the request should be granted. Ben Nix expressed concern that the operation could enlarge in the future. Mr. Uhrig assured him he has no intention of enlarging it any more than 100 head. It will be operated on a limited basis. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the staff' s recommendation. Motion by Frank Suckla, seconded by Percy Hiatt. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Fred Otis , Jerry Kiefer, Frank Suckla, Bette Kountz, and Chuck Carlson. Motion carried. EZ, Section 24, TlON, R62W LOCATION: Approximately 3 miles south and 2 miles west of Grover APPEARANCE : Frances Ryan, Licensing Engineer DISCUSSION: Ms . Ryan first brought the Planning Commission up-to-date as to what has been occurring at the Grover test test and what is anticipated in the next 6 to 8 months and 1 to 5 years . The present request is to amend Development Standard #1 for a six month extension to allow for the conclusion of aquifer restoration and the commencement of surface reclamation. Ms . Ryan then explained the procedure for reclamation. Wyoming Mineral Corporation is in its final stages of groundwater restoration. It is anticipated that a final public hearing with the Colorado Water Quality Control Couuuission will occur in mid- late summer of 1979, with surface reclamation couauencing in the fall . If Wyoming Mineral Corporation needs to remain on the site for the continued groundwater restoration program, then this permit extension will allow them to do so. There being no questions at this time, Tom Honn read the staff ' s recouuuendation for approval . General discussion followed regarding plugging the holes in the area. MOTION: Be it therefore resolved to recommend approval based on the staff' s recouuuendation to the Board of County Commissioners . Motion by Percy Hiatt, seconded by Jerry Kiefer. APPLICANT: Virgil Ottinger CASE NUMBER: SUP-391 : 79 : 13 SUBJECT : Swine Farrowing and Finishing Operation LEGAL DESCRIPTION: Pt. S2j Section 22, T6N, R64W LOCATION: Approximately 3/4 mile northeast of Gill APPEARANCE : Virgil Ottinger DISCUSSION: Mr. Ottinger had applied for a Special Use Permit for this type of operation several months ago and withdrew the application because of a great deal of opposition from surrounding neighbors . Since that time, Mr. Ottinger has found this 75 acre tract of land and would like to have the swine operation on it. The hog confinement operation will be for approximately 1, 800 head. Both Mr. Ottinger and his plan plan to build a residence on the property. Tom Honn then read the staff' s recommendation for approval and the Development Standards . Discussion followed regarding the letter the Planning Staff received from W. S . Howard and his concern for a clean operation with odor controlled. Mr. Honn stated he felt this concern was adequately addressed in the Development Standards . MOTION: Be it therefore resolved to recommend approval with the Development Standards based on the Staff' s recommendation to the Board of County Commissioners. Motion by Ben Nix, seconded by Bette Kountz. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Fred Otis , Jerry Kiefer, Frank Suckla, and Bette Kountz. Chuck Carlson cast an abstention vote. SW., Section 5 , T3N, R68W LOCATION: Approximately Z mile north and 2 miles west of the Town of Mead APPEARANCE : Vernon Noble DISCUSSION: Mr. Noble stated that he needs to expand his operation, which is in another county at the present time. Mr. Noble' s operation will eventually be approximately 600 head. A controversial issue has been brought up regarding the sale of water on the property. Mr . Noble stated he is in no way connected with the sale of this water. He also stated he has a letter from the Little Thompson Valley Water District which states they will furnish him adequate water service to the site. The subject was then brought up of how the property had; come to be split over the years . This process was explained by Mr. Leonard Hergenreter regarding his personal involvement in the property. Mr. Hergenreter also stated he is opposed to this operation as he does not feel prime agricultural cropland should be changed for hog production. Discussion followed regarding other possible sites for the operation and drainage on the property. Robert Hodgson then explained the problem he has been experiencing regarding water for his property. He has been told by Little Thompson Valley Water District that a larger line will be installed, but so far has not yet received it. Discussion followed in this regard. Tom Honn then read the staff' s recommendation for approval and the Development Standards . Discussion again followed regarding the water situation. MOTION: Be it therefore resolved to reconiuiend approval based on the staff' s recommendation to the Board of County Commissioners with the' addition of a condition of approval being that the request is approved subject to the applicant showing the Board of County Commissioners that Mr. Noble has written assurance of an adequate water supply for the operation in the form of a certified letter from Little Thompson Valley Water District and further than an additional Development Standard be added which would not allow a tap into the existing Little Thompson Valley Water District line until it is enlarged. Motion by Jerry Kiefer, seconded by Fred Otis. A vote of "aye" was cast by Percy Hiatt, Fred Otis, Jerry Kiefer, and Chuck Carlson. A vote of "no" was cast by Ben Nix, Frank Suckla, and Bette Kountz. The permitted uses on the hereon described parcel shall be a hog farrowing and finishing operation and shall be limited to the facilities shown which are designed to handled a total of 600 head of hogs. 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . 4 . Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968 . The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division. 5. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6 . There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 7. There shall be no permanent structures allowed in the ditch right-of-way easement as shown hereon . 8 . No water tap shall be permitted into the existing Little Thompson Valley Water District water lines from subject property until said water lines are in fact enlarged. 9. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. Comments: 1. The Town of Mead Planning Commission has reviewed the request and stated in a letter dated May 22, 1979 that the Board moved and seconded that no action be taken for or against this request . 2. The Howard Lateral Ditch Company has reviewed the application and requested in a letter dated May 15, 1979 ample room in order to clean the ditch. A 40 ' easement exists on the plat for the ditch company' s access to the ditch. 3 . The Weld County Health Department has reqviewed the request and has several recommendations which have been incorporated into the attached Development Standards. 4. Stock pen drainage due to a severe rainfall will be handled as follows: a diversion ditch up-drainage from the pens will channel ground water away from the pens and diversion ditch down-drainage from the pens will channel pen drain- age into the farm irrigation ditches used for pasture and row crop irrigation for dispersal . The soils are classified as Wiley-Colby complex and Weld loam. They have an agricultural land use capability of Class Ile and would be considered prime agricultural land. Permeability is moderately slow and the water holding capacity is high. Both soils demonstrate moderate shrink-swell potential and would indicate that a laboratory sample should be run for engineering design, particularly slab on grade for barn floors , driveways, and other flat work. 2. A major irrigation ditch traverses the southwest side of the property. The plan does however, make note of the easement and right-of-way. 3. The area is not in a 100 year floodplain. 4. The applicant has contacted this office for advice on waste disposal and pollution control . A series of diversions are planned around the entire hog facility. These diversions will then empty into a large flat bottom diversion leading out to the pastures. The latter diversion would start with a flat grade and increase with distance to allow the solids to settle out and be stockpiled for drying and spreading on the fields . The District completed one mile of 4 inch main as a portion of a loop on this section last fall, the balance of the loop-one-half mile- is scheduled to be constructed this fall as soon as the irrigation season is over so that the Mead Lateral may be crossed. The District has funds in reserve for this project and the project has been authorized. The District will be able to provide whatever water service is required by Mr. Noble. Water service to the proposed Noble tap will not adversely affect other customers, in fact, the larger main will provide better service. I feel that prime agricultural cropland should not be changed to hog production and concrete feed lots, when there is so much marginal land which could be used for such type of agriculture. As a Weld County taxpayer, I believe the Weld County Planning Commission has the responsibility to preserve class one land for crop production rather than diverting it to other uses which take it out of production. This land in question has the capability of producing top yields per acre of corn, sugar beets , pinto beans , and/or any other crop adaptable to this area.
