M U R 14-0 030 Development Standard #17 states: The facility shall operate in compliance with applicable
Colorado Air Quality Control Regulations and comply with any permits issued by the Air Pollution Control Division.
MU SRI 4-0 030 Development Standard #21 states: In accordance with the Colorado Air Quality Control
Commissions Regulation Number 2, odor detected off site shall not exceed the level of seven -to -one (:1) dilution
threshold.
MU R14-0030 Development Standard #44 states: The proper Ly owner + r ()per UN shall be responsible fat.
complying with .ail of the foregoing Development Standards. Noncompliance with any of the foregoing
Developrrpent Standards may be reason for revocation of the Permit by e Board of County commissioners.

USA -1 704 - A Site Specific Development Plan and a Special Review Permit for a
solid waste disposal site and facility (including Class I composting), an animal
waste recycling or processing facility (an anaerobic digester -based renewable
energy plant (gays)) along with a concrete batch plant to be used for construction
of the facility in the A (Agricultural) Zone District approved by the Board of
County Commissioners.
U5 74 04 approved with odor standard: In accordance with the
Colorado Air Quality Control commission Regulation Number Z odor
detected off of the site shall not exceed the level of seven -to -one (7:1)
dilution threshold_
Changes to Site Layout of U R-1704 approved by the Board of County
Commissioners changes included changing from 6 lined ponds (1 storm
water pond and 5 addition process ponds) to 3 lined ponds (2 storm
water ponds, 1 settling basin, 1 covered digester lagoon), and changing
the digester design from 24 rectangular, in ground covered, digester pits
to 5 above ground digester tanks approximately 50 -feet in height.

the facility exceeded to the 7:1 odor threshold on one (1) occasion -4/27/2016.

Dear Mr. Thomas:
Please be advised that many complaints have been received by the Department of Planning
Services' and the Department of Environmental Health for uses on your property that may not be
in compliance with M U R 14-00 30.
The following is a summary of the complaints:
Odor and smells coming from the facility
On April 27, 2016 Weld County Staff measured the facility at a level of >16:1 dlt and <32:1 dlt
(dlt = dilution to threshold)
M U SR 14-0030 Development Standards #17, #21 and #44 state:
17, The facility shall operate in compliance with applicable Colorado Air Quality Control
Regulation sand comply with any permits issued by the Air Pollution Control Division.
21. in accordance with the Colorado Air Quality Control Commission Regulations Number 2,
odor detected off site shall not exceed the level of seven -to -one (7:1) dilution threshold.
44. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of County Commissioners.
The probable cause hearing is set for Monday, July 11, 2016, at 9:00 a.m., or as soon thereafter
as the agenda of the Board of County Commissioners permits, the Board of County
Commissioners of Weld County will hold a Probable Cause public hearing pursuant to Section 2-
4-40 of the Weld County Code. This meeting will take place in the Commissioner's Hearing Room,
Weld County Administration Building, 1150 O Street, Greeley, Colorado.
If it is determined at the public hearing that there is probable cause that you are not in compliance
with MU RI4-0030, the Board of County Commissioners will schedule a Show Cause public
hearing to consider revocation of M U R 14-oo 3O _

Again, I am hopeful that you will be able to attend the Weld County Board of County Commissioners meeting on
Monday,. July 11, 2016, 9:00 am for reviews and public input on this Heartland odor matter. It will be held at the Weld
Co_ Adm. Building @ North 1V Ave and "O" Street.
We are continuing to monitor and evaluate the Heartland's odors' concentrations.
Over the months of responding to odor reports, we have obtained a single violation of the Colorado AQCC odor
standard. This standard level of odor is the same as the condition written into the USR for Heartland's operation.
Odor emanations are from multiple foci on the Heartland "campus", and not just a single process or location. Your
reference to "piles of rotting waste" is an identified location from which odors do emanate.
I have been in your area on a daily basis for "semi -quantitative" evaluation of odor. What this means is that I drive the
4 -mile periphery of the plant ( "S'CR's 49, 42, 47, and "40") and evaluate the wind direction and the presence or absence
of the characteristic "Heartland odor". If I detect this odor , I will then utilize the certified field evaluation method to
"quantitate' the odor, I have been in your neighborhood at unannounced periods of time.
I will be near your home again today I have a scheduled meeting with the Heartland managerial staff this morning at
9:00 am after which I plan to do another "4 -mile" odor survey.
Please plan to attend the meeting next Monday morning.
And, continue to notify me of your observations. Encourage your neighbors and relatives to do also.

Another update. Their continues to be a pungent odor from the plant north of the plant along 49
ever morning this week. It is very clear it is coming from the plant and not the dairy. It seems
to be most concentrated in the small dip in the road just south of 42 on 49.
I was curious, has there ever been confirmation of the source of the odor? The two main theories
are piles of rotting waste or from off -gassing of the digesters. It would be good to know what the
specific point source is..

I am including some of the Weld
County administrative., plaxuung and environmental health
staff members on thisreply to you. They are aware of the
Heartland
odor concerns, and I am keeping them regularly
updated.

County Planning and Environmental Health staff members with
the management t.eani at Heartland went well. The company is
continuing
to evaluate the problem and looking for engineered
solutions.
The company has installed one
aerosolizing system at the large lagoon and another around
the "raw" stock. (food wastes, etc.) materials receiving
and processing
area. This system is intended to deliver an "odor
neutralizer 24/7 to the air in those areas to reduce odor
concentrations.
As of this morning, James, there
are on -going concerns at the County and State (Air Pollution
Control Division) levels about the continued odor reports
from the
residents of the area around Heartland. We are responding
to those agency reviews and requests.
The h eartland facility management
team is also aware of the continuing reports of
foul-smelling odor emissions.
Please continue to communicate
with me either by phone or e-mail as you have done in the
past. I am particularly interested in odor experiences
that are worse/more
intense/more concentrated than previously reported. We
were able to obtain one violation of the Colorado and Weld
County odor standard in late April; however, all odor
evaluations since then have been less than the 7:1 dlt level
that constitutes a violation,

know and understand (lull odors you are experiencing are not
pleasant even when they are not at violation

levels.
1 am continuing to notify the
management gent of Heartland of the odor complaints that 1

Happy 4th of My weekend; it is definitely NOT happy for Ken and I or for all of

The smell so is horrific, and unbearable to the point that some of our company has
left to go into toviorn and try to see if there is a hotel that has a vacancy for them to
stay at for the rest of the weekend ! !

It has been pretty had all day and now at 5:45 pm the smell ramped up so bad that
we are ,going to have to go to town to eat because the smell is in the house and
totally disgusting.
We are so very disappointed in this whole situation it is unbelievable, the fact
there has only been 7 air quality checks since this plant opened in 2014 is just
unbelievable and the fact that Ken and I have said over and over and over again
this is being done in the evening, early morning and on the weekends when no
one is around to measure the air quality. This company is not stupid they know
exactly what they are doing!
Something HAS to be done, this is unacceptable hr us to live in this kind of
environment where we cannot even go outside of our home and enjoy the
outdoors
Our weekend is pretty much ruined, we are at the mercy of a Methane plant that is
not being regulated, how very, very sad for us and we are sure for all of our
neighbors that are smelling this stench also.
We are looking forward to the meeting on the 11th and our voices being heard,
something being done to stop this sooner than later.

This morning
I completed another portion of the APCD-requested stationary sources inspection at Heartland this morning.
Following that I drove "all over" the Heartland "homeland" and lingered at the DPS (Digester Process System) area
where I met Ted Mathews who is the "Biogas Project Manager" for A-1 Organics. He was helpful and welcomed any
suggestions that we/l may have about the operation.
At the time there several of the "super sacks" of dog food getting emptied or dumped and a truckload of past date
grocery produce was dumped. The deodorizing misting system was operating. The "Bobcat" skid -steer was operating
much as it was two weeks ago during our tour.
The odors blowing to the west and southwest from DPS area were highly unpleasant. I had the Nasal Ranger with me so
I did some measurements all of which were <7:1 d/t off -site along WCR 40. I stopped at Steve Flippen's place and did an
evaluation in his driveway east of the house and next to his garage and shop. The odor there also was <7:1 qt. The
unpleasant odors were passing to his house, but not in violation of the standard.
Really bad odor!
I did not detect any unpleasant odors anywhere else on the property, even though two MacDonald farms 'manure'
trucks came, unloaded and departed.,

able to get one reading that was in violation for state odors. Unfortunately he is not able
to come out to do testing in time to get another re=portable high result.The state says a
rate of 7 is considered a violation. To most of us a rate of 2 is very odorous and

unacceptable. I am told they are only working at 40%capacity . What are they going to

We had a faint plume at 8:47 Pm Thur as we were walking. The wind was blowing directly from the plant to us. But it
totally passed by 8;59 so it was only a very small one,
This morning at 3:47 Aa strong smelling plume came by and woke me up. All our windows were open. But by 4:06
the air was sweet and clean again. IT was pretty calm wind. So even though it was strong it only lasted 18 minutes.

i want you to be aware of an e-mail that I received this morning from one of the neighbors who lives SE of the Heartland
facility.
It was a report of foul odor emissions experienced on Tuesday night. The complainant commented that it was intense
enough to awa ken the family, one member of the family reported that it was a nauseous odor that accumulated in her
basement room.
As you know, I was not able to respond to this report two -three days later.
I remain with the plan to visit with you this morning at 9 am to go over the air permits' terms and conditions.
Thanks, again, Jason for what you and Heartland are doing to address these neighbors' continuing concerns.

Thank you, James, that you are continuing to keep us apprised of your observations and experiences at your home just 1%
rile or so SE of the Heartland facility.
I am including some of the Weld County administrative, planning and environmental health staff members on this reply
to you. They are aware of the Headland odor concerns, and I am keeping them regularly updated.
The meeting last week of Weld County Planning and Environmental Health staff members with the management team at
Heartland went well. The company is continuing to evaluate the problem and looking for engineered solutions.
The company has installed one aerosolizing system at the large lagoon and another around the "raw" stock (food
wastes, etc.) materials receiving and processing area. This system is intended to deliver an "odor neutralizer" 24/7 to
the air in those areas to reduce odor concentrations.
As of this morning, James, there are on -going concerns at the County and State (Air Pollution Control Division) levels
a bout the continued odor reports from the residents of the area around Heartland. We are responding to those agency
reviews and requests.
The Heartland facility management team is also aware of the continuing reports of foul-smelling odor emissions.
Please continue to communicate with me either by phone or e-mail as you have done in the past. I am particularly
interested in odor experiences that are worse/more intense/more concentrated than previously reported. We were
able to obtain one violation of the Colorado and Weld County odor standard in late April; however, all odor evaluations
since then have been less than the 7:1 dot level that constitutes a violation.
Again, I want to emphasize that we know and understand that odors you are experiencing are not pleasant even when
they are not at violation levels.
I am continuing to notify the management of Heartland of the odor complaints that I receive. I will notify Heartland of
your complaint but not your identity.
I will let you (and all of the other complainants) know of progress on this odor emissions matter as I receive new
information.

her up about 1:30 at night. My 25 year old daughter who has a room in the basement has said the odor has

This is my response early this morning and does not represent a "group" comment.
Heartland's completions of odor -control projects are considerable.
The walking tour was again of help to better understand the many components of the processing of the multiple stream
wastes and discards.
In response to that, may I ask or request:
A phone call or e-mail notification of when the plant is receiving and processing a large load of discarded dairy products
(yoghurt, cottage cheese, milks, creams, ice cream). I have received a couple of comments from neighbors about the
possibility of extreme odor from what they thought may have been rotted or decaying dairy materials. Does Heartland
receive "large arge loads, or are decaying dairy materials just of small volumes and mixed into the other materials?
Yesterday, even though we were in the interior of your DPS building, I did not detect the same nauseous odors
previously encountered. There was something different yesterday.
Of course, odors experienced by neighbors may be a mixture of all the volatiles that are in the air from the multiple
locations of emissions.
I have said this before: The neighbors still comment they were assured years ago during the planning and application
stages that this plant would be odor and noise free ---that they would never know the plant was there and operating.

me.

Phil,
It was my pleasure to provide you, your team, and the planning department a tour of our facility with an
emphasis of the odor mitigation systems. We are very proud of our plant and the value it brings to local
agriculture and the greater community. We also understand that this great plant comes with a few challenges,
one of which is the odors associated with a few of our plant processes. We have made a significant financial
and manpower investment to mitigate these odors by successfully installing several misting systems at each
identified plant odor source.
The specific odor control misting systems and related ongoing work to date are summarized as follows:
1) Dual misting systems installed on the substrate tanks including direct injection system within the tanks
and separate misting nozzles on each external flame arrestor.
2) Misting system installed around the perimeter of the manure and effluent pits.
3) Fixed misting system installed at the DPS unloading area and a portable misting system inside the DPS
coverall building.
4) Misting system installed around three sides of the south pond.
5) Misting system installed on the discharge of the Bi orem stack.

6) Purchased and will install an onsite meteorological station to better correlate and evaluate any off site
odors.
7) Engineering studies underway to evaluate permanent gas/odor control biofilter systems with the existing
chemical misting systems to operate as backup systems.
8) Implemented an odor response and management system.
As with and; new system, we faced some challenges making the systems efficient, reliable and effective. Here
are a few of the issues and our resolutions:
• Pump Reliability -- We started with a low volume misting system in a few of our tanks. r l,hc system was
very successful when it ran, however the pump frequently lost pressure eventually demanding near
constant attention to maintain. We found a new misting system which would treat the odor more
reliably.
• Vegetation — Initially, we installed one of the systems at ground level. Over time, the vegetation grew
around the misters preventing them from treating the odor. To solve this issue, we hung the nozzles on
posts above the vegetation.
• Tank capacity -- We started to feed the pumps from small tanks. The tanks have limited volume and we
found that the tanks were empting quickly. This caused the pump to run dry causing damage to the
pump. We ordered and installed repair kits on the pumps. We also increased operator checks to every
four hours to maintain tank levels.
• High Ambient Temperature — As daily temperatures rise we found the pumps not working very well
reducing the odor mitigation effectiveness. We spoke with the manufacturer and learned that the pumps
are designed to have a pressure at the pump suction. Our decision to use small tanks did not provide
adequate pressure, We ordered a chemical metering pump to allow us to inject the chemical into a
pressurized water system. We placed this new equipment in operation today in one of our misting
systems and observed an immediate performance improvement. Now that we have proven the fix, we
will incorporate it into each of our misting systems.
EDF EN is committed to continue maintaining compliance with the requirements of Regulation No. 2 and being
a good corporate neighbor to the surrounding community. My operating staff with corporate staff support have
worked very hard to mitigate the odors and meet these goals. We have observed a significant improvement in
our odors around the plant, but we are not done yet. We continue to monitor the systems and create new and
innovative ways to improve reliability and effectiveness.

1 received several emails from you this morning. I respond to all of their here.
First, I want to thank you for keeping me informed of the odor complaints and for letting me know what you
observe in personal response to the calls. I am not receiving as many calls as I was at first. I still respond to
every call to observe the conditions and perform an odor observation. I received a call from John Martin at
about 11:45 this morning and responded immediately. He met me at his property line to describe the odor. I
could not detect the odor at the time and spend an hour and 20 minutes monitoring around the plant as the wind
was shifting around. I detected an odor plume west of the plant on WCR 47 which I measured <2:1 Da.
I have not monitored for odors at such a great distance from the plant as have been recently reported. I am
surprised that the odor has been reported so far away from the plant and cannot comment until I am able to
make some personal observations.
We continue to improve the odor systems. We are finding some reliability issues where the misting systems
lose pressure and stop spraying. We contacted the manufacturer and learned some things we can do to improve
performance. We are currently waiting for parts delivery to implement the improvements. The operations staff
remains vigilant to maintain all misting systems in operation while we wait for parts delivery.
I think it best to discuss the other complaints and concerns tomorrow. I look forward to continuing this
important discussion with you and your team tomorrow afternoon.

is also almost three miles from the plant.

Colleagues:
One of the complaints from the weekend (and over the past 2-3 weeks) just called me.
She lives to the SE of Heartland. along WCR 49.
Her comments to me were ("paraphrased with accurately used terms"):
"Heartland company just is saying to complainants 'screw you', and does not want to do anything to solve the problem"
"Heartland company is just regarding the complainants as 'Live with it ---it is here to stay".
"The neighbors are 'pissed off and mad' that no one is doing anything about this sickening odor"
"I should not have to pay to run an a/c 24/7 just because Heartland does not want to do anything to solve this ---I want
my windows open?'
"The odor is worse than ever ---it has been awful for months and months —there are no changes"
"My husband and I are going to get legal help since Heartland is doing nothing"
"What do we have to do to get this changed?"
"What kind of odor instruments do we need to get to measure this stink ion our home?" (I did talk to her about: air
sampling,GC/MS, Nasal Ranger, Odor certification, etc.)
I asked her to put off any action until tomorrow afternoon after our 2 pm meeting. I promised her that I would return a
call to her after tomorrow's meeting. She said she would do nothing before tomorrow afternoon.
The recent tone of the complaints that I receive is getting less civil and a bit more like the above. The first complainant
who called me in November is about at the end of being "kind". This person is ready to do "the next step" (undefined).
So you know, I am informing complainants that we (Weld County officials) are having a meeting with Heartland
tomorrow afternoon to address the continued odor emissions nuisance to the area neighbors.
So you know: I have heard nothing from any of the complainants that they are going to contact the news media about
this (Greeley Tribune, Tv Channels, Denver Post). That has not even been mentioned to me at this point.

1, From a "husband" complainant who lives generally SE of Heartland. He reported that odor was horrible on
Saturday morning, June 11. He was awakened at 4:30 in the morning and had to close windows.
A follow-up call from the 'wife" of above who said that odor was bad Saturday morning and it returned Sunday
evening June 12 at 6:30- pm. She had to close windows as it continued until 9:30 pm. She commented that
odor stayed all night. Wind was from NW during the rainstorm and the odor blew in with the rain. I returned a
call to this person but she was not at home this morning. I left a message for her to return a call to me.
3. A call from a person who lives about 1 A miles SE of Heartland. Same as above: bad odor that blew in from NW
with the rainstorm. I returned a call to this person but person not at home. I left message for her to return a
call to me..
Ill attempt to consolidate all phone call complaints into one message in the future.

Jason:
I received two calls early Saturday morning about odor emissions from Heartland. The calls were to report bad odors
during the night about 1:00 am Saturday morning. I received the two calls at 6:30 am Saturday morning.
The two calls reported (paraphrased): "Odor was very bad and it awoke us; we did not want to disturb anyone during
the night so we waited until this morning to call you.
A third call came on Saturday morning from a person whose comment was (paraphrased): " ...I had to hold my breath
just to get into the car so I could go to work."
A fourth call came to me last evening at 8:25 pm. Same general comment: "bad odor". This call was from a person who
lives WSW of the Heartland plant.
I responded last evening and determined that odor along WCR 47 due west of the Heartland plant was >4:1 d/t, but <
8:1 d/t. No violation. Wind was from the east at this time.
Odor along WCR 40 due south of the building (wind from the north) with the curved "fabric" roof was >4:1 d/t, but < 8:1
d, t, Later determinations were >2:1 d/t, but <4:1d/t.
Odor was not present along WCR 42 directly north of the plant.
Additionally, I could not detect Heartland odor along WCR 49 south of WCR 40 even though the winds continued to be
primarily from the northern directions.

Yesterday you reported that a neighbor was experiencing odors at 10:00 in the morning. I immediately
responded by slowly driving CR 38 from the "Dead End" sign to the east and the intersection with CR 47 to the
west. I monitored for approximately 40 minutes when 1 had to return to the plant for a meeting. I was unable to
detect an odor plume at that time.
I am concerned about the late nightodor reports. Our systems have not been upset overnight and I cannot
identify any changing condition that may increase odors overnight. 1 will be out all night tonight looking for
odor plumes. Please let me know if you receive additional reports so I may align my findings with the reports.

This report is of additional calls received.
Two messages were leftlast evening on the Environmental Health Services phone messaging system. I
followed up with personal telephone calls with the two residents who live in the area north and south of
Heartland respectively about 1-2 miles.
In addition I had a personal meeting at 8:45 am this morning with a person who lives two miles north of the
Heartland site who experienced the disgusting odor last night at sundown. She was outside and lives about 2
miles north on WCR 49.
They reported disgusting, horrible, sickening odors last night.
One of the people said: '~We need to do something about this ---it has been going on for too long ---it is an odor
that gets into your mouth and nose and ya can't get rid of it."

This morning she is saying that odor is still present from last night;

She characterized it similarly as have the others: Not Ag., Not CAFO, Not Diary, Not manure_ She says it is
repulsive and sickening.
She experiences odor from the Horton feed lot "a lot" and said it is nothing like the cattle feed lot odor, and
definitely like dairy odor.

This is a report of the phone call odor concerns that I received yesterday, Monday, June 6, 2016.
1. A call from a person who lives SE of Heartland ---the same person who wrote last week about possible
cancellation of a wedding at their home property this summer. His comment was: "Last Saturday night was the
worst odor ever for him and his wife". Odors came about 1 am both Saturday and Sunday nights. "Horrible" as
the odor awoke them and they had to close windows which was only partly effective.
2. A new complainant called and I talked with her on the phone (not a message). She lives "generally" Vz to % mile
SE of Heartland along WCR 49. She only recently found out about the EHS odor complaint system or she would
have called a long time ago. She thought that she and her family would just have to endure the stink. She said
that odor has been awful for months and months. Yesterday was again "bad" for her.

I did NOT respond to any of the complaints with an on -location evaluation of odor using "Nasal Ranger".
An additional statement was made to me that they believe nothing will ever be done to make things better.

All systems are now in operation as discussed for the June 1, 2016 deadline. Here is a 1 i st
o DPS Unloading Pad -- Misting system installed and operational
o Manure and Effluent Pit. Misting system installed and operational
o Substrate Tank — Misting system installed and operational. We found that this system was not as reliable as
it could be. A secondary misting system was installed and is now operational.
o Biorem — Misting sting system installed and operational
o South Lagoon — Misting system installed and operational. Misting system found inadequate and has been
expanded to provide better coverage at different wind directions.
I have a strict plan in place to monitor the misting systems to ensure they remain in operation 24 hours a
day. We also increased our site odor monitoring to help us measure the effectiveness of the systems.
Please continue to infom me if reports come in. I need to know if the plan we have executed is effective and if
further expansion is required.

I have received an e-mail message and telephone calls since Friday the 27th about which I want you to be
aware.
The e-mail message was from a person who lives generally SE of the Heartland facility (his e-mail was in my
'in -box' on Tuesday morning when I arrived).
1. His comment was that odor over the weekend was "significant" on Sunday the 29th about 6 pm 10 pm and
then again on Monday the 30th at 4:30 pm.
2. He added the Collowing (direct quote): "Most nights now we cannot open up our windows because
generally at least once or twice a night the smell gets bac enough that it wakes us up. Also, my oldest daughter
is getting married at the end of this summer. For several years we have considered having it here in our

yard. We however have bad to make the decision to hold it somewhere else because we didn't want her day
mined because of the odor."

The names of the people who are also receiving this message are extensively involved with the recurrent odor concerns
that have been expressed over the months by you and your neighbors. The four people are in Weld County
administration, Weld. County Department of Planning and environmental health department.
Since you and I last exchanged messages about the odor emissions from Heartland, I have been conducting odor
evaluations as we I am able in response to telephone and e-mail complaints received.
I detected odor concentrations last month that were in excess of the "standard" that is written into Regulation No. 2 of
the Air Quality Control Commission. That standard is "in excess of 7:1 d/t", or abbreviated H>7:1 On. That was the first
time that M was able to detect a violation since I became aware of the odor problem in November 2015. The "standard"
is the same as what I wrote to you several weeks back. The day when I detected this elevated odor concentration was
when the winds were directly out north over a long period of time. This detected violation was forwarded to the Weld
County Department of Planning and the Colorado Department of Public Health and Environment, Air Pollution Control
Division for possible enforcement action.
I was in your area last Friday afternoon (the 27th) and was able to detect odor at a concentration of ">4:1 d,/t, but <8:1
d, t' (what that means is the concentration was NOT >7:1 d/t). The odor was SW of the Heartland plant along "WCR 40"
and east of 'WCR 47.
Heartland has indicated to the Weld County Department of Planning, Administration and the Environmental Health
Services that it will have a 24/7 functioning odor neutralizing system by June 1 (tomorrow). This system is designed
similarly to what may be seen at community water pollution control facilities (sewage treatment plants) where there is a
continuously aerosolizing odor mask or an odor neutralizer.
Please notify me 24/7 when you are experiencing these nuisance odors. I will attempt to respond to your area as quickly
thereafter as possible. I will comment to you If I am not able to respond at that specific time. There are now four of
your area neighbors who are notifying me when odors are a nuisance to them (a new complainant visited us here at the
health departmentabout a month ago ---he lives 3 +1- miles SSW of you).
The phone numbers below are current. The cell number I attempt to answer within a few minutes of receiving a call.
You don't need to put off notifying me "during reasonable hours? If the odor is of concern, please give me a call.

I just wanted to follow up on my voicemail from this morning. Up until about loam the odor was very strong
and actually started accumulating in my garage. It got better during the day but it is even worse this
evening. My wife and 1 were outside and we finally had to come in because it was giving us both headaches
and unfortunately I am not. exaggerating.
Overall the last month or so hasn't been too bad. Most days you can smell it for a few minutes but then it goes
away, Today however has been one of the worst days yet this year. Much like this morning, it is worst when
the wind is not blowing at all or just a slight NW wind.

spent about a couple of hours today in your
"neighborhood" as I have had three phone calls
from others about the odor in the past two days.
• I drove the county
roads surrounding the section on which Heartland Biogas is
located '' R's 49, 42, 47 and 40 {or the oil
road/driveway).
Your observations are what I am finding. A narrow band of
odiferous air when I place myself immediately downwind of
the facility.
Here is my suggestion:
• Please call me when you notice the
odor ---don't wait until it is unbearable.
• I am logging all.
calls so that I can notify the Heartland Biogas people of
the problem.

heartland facility. When we talked on the phone you had
asked to call you if the odor was unbearable. Since then I
have had a time when it was what I consider unbearable.
However, I can guarantee that if I am outside for more than
30 minutes or so I will for sure smell it at some point as
the smelt is always there, it is just a matter of the
wind. What I have noticed is that it is always a band
about 50-150' wide and it will move based on the
wind. I have considered calling you on a few
days but the wind changes direction so often it would like
be in a different direction before you got out here. On
Saturday when the air was still with the fog it was a
persistent smell all morning. Again, it wasn't
unbearable but I was cleaning out corrals and could still
smell it over the smell of the fresh manure.

It was good to speak with you earlier today. As I mentioned, T am now the Plant Manager of the Heartland
Bi e as raeil i ty and vigil I be your primary contact on site. I am available 24 hours a day to address odor
issues. Plc a % contact me any time. My contact information is listed below.
I completed Regulation No. 2 certification training last week. I expect to hear back on certification later this
week. Certification is the first step in our plan to implement a site odor monitoring program which will include
routine odor monitoring and odor complaint investigation. We plan to certify additional employees over the
next few months.
We have several odor eliminationireduction plans in work. The following list is our current efforts, our future
plans, and our estimated implementation dates.
Chemical odor elimination in Substrate Tanks — We started injecting a chemical odor eliminator into the
substrate tank air ventilation stream twoweeks ago. This has proven to produce effective odor
control. We continue to tune the system to improve reliability and effectiveness of this odor control.
. Digester Processing, System (IMPS) — Al Organics is currently seeing bids for a chemical odor
elimination system. The system will atomize a chemical odor eliminator to the truck unloading pad, the
canvas building, and the three underground tanks. A1 expects the system to be in service by May 9,
2016.
3. DPS Storage Tank — This tank has not yet been placed in service. Al is working to implement a
ventilation system similar to the substrate tanks which will include the injection of a chemical odor
eliminator into the air stream. The system will be in place before the tank is placed in service.
4. South Lagoon — E.DE is researching an engineering control for the lagoon which will take significant
time to find, engineer, and implement the improvement. In the meantime, EDF is researching chemical
odor eliminator atomization along the western edge of the lagoon. EDF expects to implement this
control by May 2, 2016,
