The Weld County Thoroughfare Plan was adopted by the Board of
County Commissioners as part of the Weld County Comprehensive
Plan in September, 1973. The Thoroughfare Plan delineates the
roads proposed to be upgraded in the future. One of the aspects
involved in upgrading a road is the need for acquiring additional
right-of-way. It is important that the future right-of-way needs
be taken into account in dealing with development occurring today.
By planning ahead to reserve projected future right-of-way needs
now, the cost of acquiring needed future right-of-way will be
minimized. Also the social impacts should be lessened by insuring
adequate setbacks from future right-of-way lines for developments
occurring now.
The future right-of-way needs can be preserved by requiring the
distance needed for the future right-of-way to be included as
part of the setback regulations in the Zoning Resolution.
For the purpose of illustration, the following situation is
presented as an example:
An application for a building permit for a new
residence is made. The parcel is zoned Agricultural
necessitating a 50 ' frontyard setback. The parcel
fronts onto a county road which is proposed to be
upgraded to an arterial in the future as indicated
in the Weld County Thoroughfare Plan. The arterial
designation requires an addtiional 20' of right-of-
way on each side of the existing road right-of-way.
Therefore the setback requirement for the new
residence would be 70' from the existing right-of-
way line. This effectively accommodates the future
right-of-way needs for development taking place now.
Therefore the Department of Planning Services staff recommends the
following explanatory footnote be added to Section 3. 14 of the
Weld County Zoning Resolution after the column identified as the
"Minimum Front Yard Setback" :
(5) The front yard setback shall be measured from the
adjacent edge of the right-of-way line of the abutting
public road. If the abutting public road is not des-
ignated to be upgraded to a higher classification as
defined by the Weld County Thoroughfare Plan, the
front yard setback shall be measured from the existing
right-of-way line of the public road. If the abutting
public road is designated to be upgraded to a higher
classification as defined by the Weld County Thorough-
fare Plan necessitating additional right-of-way, then
the setback shall be measured from the future right-of-
way line.
The future right-of-way line is determined by adding
the distance of the additional needed right-of-way
to the existing right-of-way line. 70p/ce,!

The following is a list of the right-of-way needed
for road designations as defined in the Weld County
Thoroughfare Plan:
a. Arterial or Rural Arterial - 100' Row
b. Expressway - 130' Row
c. Rural Expressway - 200' Row
d. Freeway - 250' Row
The future right-of-way line (measured from the centerline
of the road) is determined by dividing the needed right-of-
way as defined above in half.

Proposed amendment to Section 3.14 of the Weld County
Zoning Resolution requiring additional frontyard
setback in all zone districts to meet the future
right—of—way needs a* required in the Weld County
Thoroughfare Plan. (Certified copy of amended
Section 3.14 of the Weld County Zoning Resolution
is attached hereto)

Amend Section 3 . 11 of the Weld County Zoning Resolution by
adding as a reference (5 ) after the column identified as the

to the text .

The Weld County Planning Commission will conduct a public hearing
