HomeMy WebLinkAbout20160082.tiffHEARING CERTIFICATION DOCKET NO. 2016-03 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR15-0058, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (STORAGE YARD FOR MISCELLANEOUS OILFIELD EQUIPMENT INCLUDING TANKS, SEPARATORS, FLARES, PIPES AND MISCELLANEOUS PARTS) IN THE A (AGRICULTURAL) ZONE DISTRICT - STATE OF COLORADO - STATE BOARD OF LAND COMMISSIONERS, C/O BONANZA CREEK ENERGY AND OPERATING COMPANY, LLC A public hearing was conducted on January 13, 2016, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair - EXCUSED Commissioner Sean P. Conway, Pro -Tern Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Planning Services Engineer representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated November 13, 2015, and duly published November 18, 2015, in the Greeley Tribune, a public hearing was conducted to consider the request of State of Colorado — State Board of Land Commissioners, c/o Bonanza Creek Energy and Operating Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR15-0058, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (storage yard for miscellaneous oilfield equipment including tanks, separators, flares, pipes and miscellaneous parts) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Chair Pro-Tem Conway reviewed, for the applicant and public, the procedures to follow should the hearing result in a tie vote due to four Commissioner's being present and one Commissioner excused. Ei Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated the primary purpose for this Use is for storage of equipment related to the oil and gas industry. He verified the application is in response to a Zoning Violation, ZCV15-00089, due to the operation of commercial storage without the proper permits. Mr. Gathman defined the number of personnel accessing the site and the hours of operation. He clarified the applicant is proposing to lease a 20 -acre section of this property which is owned by the State and the applicant has also applied for a Subdivision Exemption, SUBX15-0027. Mr. Gathman stated the site is not located in the three (3) mile referral area of any municipality. He displayed images and entered the favorable recommendation of the Planning Commission into the record as written. • Wayne Howard, Planning Services Engineer representative, provided a brief overview of the transportation plans and requirements and stated the approved access is from CR 388 and through the 70 Ranch property (Access Permit AP#15-00395). He reviewed the average daily traffic counts to include truck percentages and stated the traffic narrative indicated 10-20 round trips per day. Mr. Howard reviewed the haul routes and stated there is no tracking control or Improvements Agreement required and the site does meet the qualifications for a drainage exemption. He reviewed the typical items related to Public Works. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating portable toilet are acceptable and there will be no washing or maintenance of vehicles and no fuel storage on -site. She stated Development Standards (DS) #4-#10 reflect relevant Environmental Health items. • Melissa Mayer, applicant, stated the application is for a laydown yard solely for storage. In response to Chair Pro -Tern Conway, Ms. Mayer explained the circumstances surrounding the violation and clarified it was at another site that had been there for many years and once they were aware of the violation they moved quickly to begin the USR process. • No public testimony was offered concerning this matter. ID In response to Chair Pro-Tem Conway, Ms. Mayer stated she has no concerns with the Conditions of Approval or Development Standards. • The Board had no recommended changes. el In response to Chair Pro-Tem Conway, Ms. Mayer, on behalf of the State of Colorado — State Board of Land Commissioners, do Bonanza Creek Energy and Operating Company, LLC, indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Kirkmeyer moved to approve the request of State of Colorado — State Board of Land Commissioners, do Bonanza Creek Energy and Operating Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR15-0058, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (storage yard for miscellaneous oilfield equipment including tanks, separators, flares, pipes and miscellaneous parts) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner 2016-0082 PL2391 HEARING CERTIFICATION - STATE OF COLORADO - STATE BOARD OF LAND COMMISSIONERS, C/O BONANZA CREEK ENERGY AND OPERATING COMPANY, LLC (USR15-0058) PAGE 3 Cozad, and it carried unanimously. There being no further discussion, the hearing was completed at 10:27 a.m. This Certification was approved on the 18th day of January, 2016.
