RE: APPROVE OF CHAIR'S SIGNATURE ON RESOLUTION OF THE WELD COUNTY
TASK FORCE CONTROL BOARD AUTHORIZING TRANSFER OF EQUITABLE
SHARING FUNDS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Resolution of the Weld County Task
Force Control Board Authorizing the Transfer of Equitable Sharing Funds (Resolution
09/20/16 - 01); in the amount of $80,000.00 to the Weld County Drug Task Force for the various
expenses associated with moving the Weld County Drug Task Force to a new location, a copy of
which is attached hereto, and
WHEREAS, by and through Section IV.B. of the Intergovernmental Agreement
Establishing the Weld County Task Force, approved by the Board by Resolution No. 99-2902,
dated December 8, 1999 ("the IGA"), the Weld County Asset/Seizure Forfeiture Oversight
Committee ("the Forfeiture Oversight Committee") was established for the purpose of considering
asset forfeiture funds or property accumulated by the Weld County Task Force, pursuant to
Section IV.C. of the IGA, and
WHEREAS, pursuant to Section IV.B. of the IGA, the Board Chair is a member of the
Forfeiture Oversight Committee, and
WHEREAS, after review, the Board deems it advisable to approve of the Chair's signature
on said resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board approves of the Chair's signature on the Resolution of the Weld
County Task Force Control Board Authorizing the Transfer of Equitable Sharing Funds
(Resolution 09/20/16 - 01), in the amount of $80,000.00 to the Weld County Drug Task Force, for
the various expenses associated with moving the Weld County Drug Task Force to a new location,
a copy of which is attached hereto.

WELD COUNTY TASK FORCE CONTROL BOARD
Resolution 09/20/2016-01
A RESOLUTION AUTHORIZING THE TRANSFER OF NON -EQUITABLE SHARING
FUNDS IN THE AMOUNT OF $80,000 TO THE WELD COUNTY DRUG TASK FORCE,
FOR THE FOLLOWING NEEDS:
Physical Relocation of the Task Force off site:
The Weld County Drug Task Force has been at its current physical location for
approximately the last ten years. Various circumstances such as unit growth, changing
technology needs, and safety concerns necessitate moving the task force operations to a new
location. These funds are being requested to pay for the various expenses associated with
such a move.
WHEREAS, the Weld County Task Force Control Board is established to oversee the
operations of the Weld County Task Force; and
WHEREAS, the Weld County Task Force Control Board has the authority to purchase or lease
equipment, machinery, and property to achieve the purposes of the Task Force; and
WHEREAS, the Weld County Task Force Control Board has the authority to enter into
contracts; and
WHEREAS, all assets forfeitures or property accumulated by the Weld County Task Force
remains under the authority of the WCTF Control Board for disbursement in accordance with grant
provisions and state statutes; and
WHEREAS, in the best interest of the citizens of Weld County and the City of Greeley, the
WCTF Control Board at the regularly scheduled meeting of September 20, 2016, authorized the
transfer of non -equitable sharing funds for the amount of $80,000; and
WHEREAS, such funds may not be used to supplant existing budgeted funds in the receiving
agency's current fiscal year budget as per the Equitable Sharing Agreement, the receiving entity
must use the additional funding for law enforcement expenditures;
Now, therefore, be it resolved that the Weld County Task Force Control Board approves and
recommends to the Weld County Drug Task Force Asset/Seizure Forfeiture Oversight
Committee the transfer of $80,000 to the Weld County Drug Task Force:
