HomeMy WebLinkAbout20162281.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 20, 2016 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, July 20, 2016, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly ER MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of July 18, 2016, as printed. Commissioner Cozad seconded the motion, and it carried unanimously. la AMENDMENTS TO AGENDA: There were no amendments to the agenda. El CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PRESENTATIONS: O 1) RECOGNITION OF SERVICES, DEPARTMENT OF JUSTICE SERVICES - VICENTA VAN DRIEL: Chair Freeman read the certificate for the record recognizing Ms. Van Driel for her outstanding service. Doug Erler, Director of Department of Justice Services, presented her with a plaque and a pin. Commissioner Cozad invited her back to participate in many of the volunteer positions which would benefit from her outstanding skill set. Commissioner Moreno congratulated her on her retirement and invited her back to hold a position on one of the many boards. Commissioner Kirkmeyer thanked her for being part of Team Weld and to have fun with retirement. Chair Freeman stated he loved the passion she brought to her job. IR PUBLIC INPUT: Vincent Holton, resident of Eaton, expressed his frustration with a seasonal worker from Public Works threatening the residents about the weed issues. Commissioner Kirkmeyer t(DI 3O1Co --C-' ryt\inUi2s- Si5112Ci Minutes, July 20, 2016 2016-2281 Page 1 BC0016 referred Mr. Holton to Jay McDonald, Director of the Department of Public Works, and stated she will follow up with him as the Public Works coordinator. Commissioner Conway clarified for the public that violations have to come through the Board. O COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno stated he and the Area Agency on Aging staff toured the University of Northern Colorado and observed how the meals for "Meals on Wheels" are prepared and distributed to the residents in the community. Commissioner Kirkmeyer participated in legislative issues dealing with the restaurant inspections, Quality Child Care Initiative and changes to the Child Welfare Allocation. Commissioner Conway attended the Chief Poncelow fundraiser dinner where there were several hundred people in attendance. He also attended the funeral of former Colorado Senator William Armstrong. Commissioner Cozad attended the High Plains Library Board Meeting, and they will be having some budget meetings in August. She attended the Hill -n -Park Meeting and Michelle Martin, Department of Planning Services, and City of Evans Planning, where they focused on sidewalks and trails. Lastly, she stated the Board received approval of the Workforce Development Grant, on the condition the Board is willing to change the name. Commissioner Conway stated the High Plains Library District is expecting a huge hit to their budget, because of the impacts from the oil and gas industry. Chair Freeman stated he met with the City of Evans City Council and congratulated Commissioner Kirkmeyer for presenting the legislative issues. BIDS: • 1) REJECT BID #61600111, ENGINEERING/DESIGN FOR COURTS HOLDING - DEPARTMENT OF BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, requested that the Board reject this bid because staff would like to pursue a more cost effective approach. Commissioner Conway moved to reject said bid. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. PLANNING: O 1) CONSIDER ZONING VIOLATION, ZCV16-00071 - MID PLAINS INVESTMENTS, C/O RUSSELL RICHARDSON: Bethany Pascoe, Department of Zoning Compliance, presented the details of the zoning and building violations. She displayed slides of the various actions and violations for the property and stated staff has received correspondence from the Fire and Sheriff departments about safety concerns. Ms. Pascoe outlined the three (3) options for the Board to consider and played a threatening voice mail left by Mr. Richardson. In response to Commissioner Conway. Ms. Pascoe stated she tried several times, on several occasions to return Mr. Richardson's phone call. She reported this has been an on -going violation dating back to 2011. She said he removed a camper trailer in 2015, only because she was able to contact his probation officer. Commissioner Conway asked the County Attorney for direction on how to proceed with the violation. In response to Commissioner Cozad, Ms. Pascoe recommended this case be referred to County Court for this case and avoid District Court. Delbert West, surrounding property owner, expressed his frustration with the violations on the property. He stated he has kept up with the weed maintenance in the past and was told by the Sheriffs Office that Russell Richardson would be able to sue him. In response to Commissioner Conway, Mr. West explained he has been dealing with this since Mr. Richardson bought the property in 2011, and, furthermore, he feels Mr. Richardson lacks the resources to cleanup the property. Commissioner Cozad stated after the discussion she favored referring this to County Court. Mr. Barker explained the differences of referring this matter to the County Court or the District Court. Commissioner Conway stated he feels like they keep moving backwards on the process of this property. . Commissioner Kirkmeyer moved to refer the matter to County Attorney's Office for immediate action and staff is directed to pursue court action in the most efficient and expedient process. The motion was seconded by Commissioner Cozad, and it carried unanimously. Minutes, July 20, 2016 2016-2281 Page 2 BC0016 2) CONSIDER BUILDING VIOLATION, BCV16-00020 - MID PLAINS INVESTMENTS, C/O RUSSELL RICHARDSON: Tonya Johnson, Department of Building Compliance, reviewed the details of the violations. She explained the property is in continued violation because the representative has not taken proper measures to make sure the property is secure. She indicated even though the power was removed from the site in March, and the City of Greeley shut off the water to the site in 2011, there are people believed to be camping or "squatting" in a house on the site. She stated a Code enforcement officer boarded up the building and no one was to enter. Lastly, Ms. Johnson reported on June 30, 2016, a building violation case was opened and as on previous inspections, it was discovered that the buildings are not habitable or safe. Ms. Johnson outlined the options available to the Commissioners and asked that they move forward with the Abatement process. In response to Commissioner Cozad, Ms. Johnson explained the Abatement process for the record. Bruce Barker, County Attorney, clarified the Code for the Abatement of Dangerous Buildings. Mr. Barker stated the owner of the building in violation has a chance to appeal the process. He expressed he would like to make sure that every option has been exhausted before there is an order to demolish the buildings, so the order cannot be appealed. El Commissioner Kirkmeyer moved to refer tis matter to the County Attorney's Office for immediate action and staff is directed to pursue the most efficient and expedient court action. The motion, which was seconded by Commissioner Conway, carried unanimously. Commissioner Kirkmeyer warned the public and staff to proceed with caution. Commissioner Cozad requested a status report within the next few weeks. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
