HomeMy WebLinkAbout20160784.tiff HEARING CERTIFICATION DOCKET NO. 2016-27 RE: A CHANGE OF ZONE, COZ15-0006, FROM THE A (AGRICULTURAL) ZONE DISTRICT TO THE E (ESTATE) ZONE DISTRICT - MARK AND JENNIFER PHILLIPS A public hearing was conducted on March 9, 2016, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Planning Services Engineer representative, Wayne Howard Public Works Department representative, Janet Lundquist Health Department representative, Lauren Light The following business was transacted: hereby certify that pursuant to a notice dated January 28, 2016, and duly published February 2, 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of Mark and Jennifer Phillips, for a Change of Zone, COZ15-0006, from the A (Agricultural) Zone District to the E (Estate) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. ▪ Commissioner Cozad mentioned the minor corrections to the descriptions. Mr. Choate stated sufficient notice has been given and the minor corrections can be made without re-noticing. • Diana Aungst, Department of Planning Services, presented a brief summary of the proposal stating 14 referrals were sent out and 12 agencies either did not respond or indicated no concerns. She reported the applicant has a Resubdivision also being presented today which will divide the one 8-acre parcel into two (2) 4-acre lots. Ms. Aungst stated the applicant has received approval for a building permit for a new single family home. She reviewed the relevant County roads as related to the location of the site and stated there was no correspondence received regarding this application. Ms. Aungst stated the site is located in the three (3) mile referral area of the Towns of Platteville and Milliken and both municipalities indicated no concerns. She stated she had images available for viewing and entered the favorable recommendation of the Planning Commission into the record as written. • Janet Lundquist, Department of Public Works representative, provided a brief overview of the transportation plans and requirements stating the approved Access Permit is off of County Road (CR) 25, AP#15-00580. She stated CR 25.5 is maintained by the Town of Platteville and CR 25 is a paved local roadway. 2016-0784 CC,'• C ,PL,N3,fit- 3' PL2413 HEARING CERTIFICATION - MARK AND JENNIFER PHILLIPS (COZ15-0006) PAGE 2 Wayne Howard, Planning Services Engineer representative, stated there are no Conditions required for this Change of Zone as drainage and easement requirements will be addressed in the future. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating the Central Weld County Water District will provide water, and sewer is by domestic septic. She reported the Certificate of Occupancy for the house will be released upon the final approval of the septic system and the Conditions related to Environmental Health items in the Resolution are Conditions of Approval (COA) #2F-2K. • In response to Chair Freeman, Ms. Aungst displayed images of the site and surrounding properties and views. • Jennifer Phillips, applicant, stated the reason for the rezoning is to stay in accordance with the Code. • No public testimony was offered concerning this matter. • Commissioner Cozad moved to approve the request of Mark and Jennifer Phillips for a Change of Zone, COZ15-0006, from the A (Agricultural) Zone District to the E (Estate) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Kirkmeyer. • In response to Chair Freeman, Ms. Phillips indicated she has no concerns with the Conditions of Approval. • Commissioner Kirkmeyer cited the noxious weed language as the only correction on COA #2.D. In response to Chair Freeman, Ms. Phillips indicated she has reviewed, and agrees to abide by, the Conditions of Approval, as amended. • The Motion carried unanimously.
