A public hearing was conducted on April 13 , 2016 . at 10 : 00 a . m . . with the following present:

The following business was transacted :
hereby certify that pursuant to a notice dated March 23 , 2016, and duly published
March 30 , 2016, in the Greeley Tribune, to consider the request of Jerre Bradt and
Billee Rosenthal . c/o Sterling Energy Investments . LLC , for a Site Specific Development Plan and
Use by Special Review Permit. USR15-0069, for Mineral Resource Development Facilities,
including Oil and Gas Support and Service (six (6) compressors) in the A (Agricultural) Zone
District. Bob Choate, Assistant County Attorney. made this a matter of record .
Chair Freeman reviewed . for the applicant and the public. the procedures to follow should
either case result in a tie vote due to four Commissioners being present and one Commissioner
excused .
Kim Ogle , Department of Planning Services, reported this case was continued on
February 10 , 2016 , to allow for state mandated mineral notification : and , continued again on
March 23 , 2016 , due to a County closure related to inclement weather. He presented a brief
summary of the proposal and reviewed the location stating the site is not within the three (3) mile
referral area of any municipality. Mr. Ogle described the surrounding property uses, nearest
residence , and reported receiving no correspondence related to this application . He explained the
applicant's intent is to expand their operations in Weld County and he stated at this location there
will be six (6) compressors at full buildout operating 24 hours a day and seven (7) days a week.
Mr. Ogle stated nine (9) referrals were sent out and staff received four (4) responses with
comments taken into consideration . He displayed images of the site and surrounding properties

and entered the favorable recommendation of the Planning Commission into the record, as
written .
Janet Lundquist, Department of Public Works representative , provided a brief overview of
the transportation plans and requirements stating the Access Permit has been approved for
access from County Road (CR) 93, AP#14-00106. She stated due to low traffic volume , there is
no tracking control or Improvements Agreement required.
Wayne Howard , Planning Services Engineer representative. reviewed the drainage and
grading requirements and explained this project is accountable to the old drainage code based
on the date of inception ; furthermore, the only requirement is a water quality feature and Grading
Permit if disturbing more than one ( 1 ) acre.

Lauren Light, Department of Public Health and Environment, reviewed the
provisions stating portable toilets are allowed . She explained the relevant Conditions and
Development Standards . In response to Commissioner Cozad , Ms. Light stated the SPCC (Spill
Prevention Control and Countermeasure) Plan can be addressed by the applicant. but that her
understanding is that it is based on how much is stored in the condensate.
Dena Lund and Abby Rimel , represented the applicant and presented a PowerPoint
Presentation reviewing the basic plan for operations, site location . existing compressors
combined with additional compressors at full buildout for this location , equipment, and storage.
She clarified that the requirement for a SPCC Plan is due to the storage of liquids. Ms . Lund
further explained the approximate truck trips . Air Pollution Control Division Permit. employees
requirement to be OSHA trained , and that the equipment is on a Skata System to be monitored
24 hours a day and seven (7) days a week with personnel assigned to visit the site every day.
No public testimony was offered concerning this matter.
Commissioner Cozad suggested a minor correction to Development Standard ( DS) #3. She
further suggested deleting DS #21 . The Board agreed .
In response to Commissioner Moreno , Ms . Rimel and Mr. Ogle clarified the letter in question
is for a different compressor station application .. to be heard later today.
In response to Chair Freeman , Ms . Lund indicated a concern regarding the requirement for
a Weld County Grading Permit. Commissioner Cozad stated the Grading Permit is required if
more than one ( 1 ) acre is disturbed . Mr. Howard concurred .
LiCA In response to Chair Freeman , Ms. Lund . on behalf of Jerre Bradt and Billee Rosenthal , c/o
Sterling Energy Investments . LLC , indicated they have reviewed , and agree to abide by, the
Conditions of Approval and Development Standards , as amended .

Commissioner Cozad moved to approve the request of Jerre Bradt and Billee Rosenthal ,
c/o Sterling Energy Investments, LLC, for a Site Specific Development Plan and Use by Special
Review Permit. USR15-0069 , for Mineral Resource Development Facilities, including Oil and Gas
Support and Service (six (6) compressors) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission , with the Conditions of Approval
and Development Standards as amended and entered into the record . The motion was seconded
by Commissioner Conway, and it carried unanimously. There being no further discussion , the
hearing was completed at 10: 39 a. m .
This Certification was approved on the 18th day of April , 2016.
