WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the 504 Compliance Committee for the Weld County Government has submitted a 504 Transition Plan to the Board of County Commissioners of Weld County, Colorado, and WHEREAS, the purpose of said Transition Plan is to meet Step II of the 504 compliance process to assure that the facil- ities of the Weld County Government do not present physical barriers to the handicapped, and WHEREAS, the Board of County Commissioners deems it advis- able to accept said 504 Transition Plan as submitted by the 504 Compliance Committee. NOW, THEREFORE, BE IT RESOLVED by the Board of County Cans- missioners of Weld County, Colorado that the 504 Transition Plan submitted by the 504 Compliance Committee be, and hereby is, accepted. The purpose of the self evaluation questionnaire is to help you and your department evaluate your current policies and practices. It is the principle process through which compliance with Section 504 of the Rehabilitation Act is to be assessed and full participation in programs and activities is to be insured. 2. There is no specific way in which your department must implement the questionnaire. Ideally, it would be best to involve several people within your department. 3. One questionnaire has been marked for Personnel Department Use Only, however, a copy has been included in your packet to help you become aware of the broad scope of employment practices that the 504 Regulations cover. 4. Answer each question fully giving supporting documentation where necessary. Some questions may not be applicable to your department. If not, indicate "not applicable" and explain why. 5. The questionnaire is to be completed and returned to the Commissioners Office by May 20, 1980. 6. The 504 Compliance Committee will review your responses after which time your department will be scheduled for an interview with the 504 Compliance Committee. The purpose of the interview is to give the committee an opportunity to clarify any questions they may have regarding your self evaluation document. 7. After completion of the interview process the committee will compile the results of the questionnaire into one Self Evaluation Plan which will be presented to the Board of Commissioners for approval . 8. General Make-up of Agency/Department 1 . List the major programs or services which your department offers. 2. List the .funding sources, both local and non-local , which support your programs and services. 3. Who is the person responsible for the administration of your department? Name and title? 4. Describe steps that will be taken to modify policies, procedures, and statements that have been found to discriminate against the handicapped. D. Services 1 . Is your department' s intake area for client services accessible to all classes of handicapped persons? 2. If not, describe what accommodations your department will make to provide intake services to handicapped persons in the most integrated setting possible. 3. Discuss how procedures used in taking applications for client services will assure that no handicapped person will be discrim- inated against including the blind, profoundly deaf, and persons needing assistance with reading or writing. 4. Discuss procedures which will be taken to assure that all employees and clients are informed that the department does not discriminate against the handicapped. 2. Discuss how your department will make continuing efforts to assure that employees and clients are aware of Weld County' s policy of non-discrimination. a. Are appropriate notices posted on bulletin boards? b. Do materials for new employees and/or clients contain appropriate statements? c. Is our non-discrimination policy contained in information- al brochures? d. Describe briefly Weld County 's system of wage and salary administration. Discuss any policies or procedures in this system that discriminate or have the effect of discriminating on the basis of handicap, • 8. Discuss any discrimination (or potential for discrimination) that may exist in personnel actions such as hiring , upgrading, promotion , demotion, transfer, lay-off, termination , the right of return from lay-off, and rehiring. 9. List any contractual relationships that Weld County has with regard to its employees particularly with providers of fringe benefits. 10. Based on a review of the specific terms of fringe benefit plans including medical , hospital , accident, life insurance, and retirement policies or plans list terms that discriminate on the basis of handicap. 11. List all programs of leave granted by the institution , including leaves of absence, vacation , sick leave, and other leave. Discuss , in general , the accessibility of the institution 's facil - ities that are used by employees and applicants (including the Personnel Office) . 2. Describe, in general terms, the modifications that are likely to be required in order to insure equal employment through reasonable accommodations . 3. List any parking or housing facilities that the institution makes available to its employees or applicants for employment. For each facility, indicate whether or not accessibility has been achieved for handicapped persons and if not, what steps will be taken to insure equal opportunity for handicapped persons to use such facilities . 4. Describe the general or organizational process whereby decisions regarding accommodations will be made for applicants who require them because of undue hardship. 5. Describe steps that will be taken to ensure adequate documentation of any decisions regarding refusal to hire or promote due to undue hardships. 6. Describe the grievance procedures that will allow employees or potential employees to file complaints with Weld County on matters related to Section 504. C. Pre-employment Inquiries/Criteria 1. List all test or selection criteria used for employment decisions . For each , note the skill or achievement level , that the test or criterion purports to measure. • 7) Self Evaluation Questionnaire Page 3 Personnel/Employment 2. For each test or criterion listed in (1) describe steps that will be taken to ensure that it measures solely what it pur- ports to measure and that impaired sensory, manual , or speaking skills (unless those skills are the ones it purports to measure) are not being measured as well . 3. List from (2) those test or criteria that screen out (or tend to screen out) handicapped employees or applicants . 4. Are there inquiries on application forms or during interviews regarding whether an applicant is handicapped or regarding the severity of a handicap. If no, discuss safeguards that exist to ensure that no such inquiry is made during the application and hiring process. If yes , discuss steps that will be taken to make certain that this procedure is discontinued or modified to conform to Section 504 requirements. 5. Discuss steps that will be taken to ensure that no pre—employment physical examinations are given to handicapped applicants where they are not required of any other employee. O WELD COUNTY • 504 TRANSITION PLAN 'i) In September, 1973, Congress passed a law that prohibits discrimin- ation on the basis of physical or mental handicap in every federally assisted program or activity in the country. This law is Section 504 of the Rehabilitation Act and it establishes a mandate to end discrimination and to bring handicapped persons into the mainstream of American Life. The regulation sets forth the discriminatory acts which are prohibited in the areas of employment, program accessibility, education and health, welfare and other social service programs. The intent of the law is to make all benefits and services available to handicapped persons as soon as possible. To that end, the act outlines a three-step process for recipients of federal funds to achieve compliance with the law. Recognizing the need for county government and the many programs it sponsors to be accessible to the handicapped, the Board of Commissioners of Weld County, Colorado, filed a letter of Assurance with the Office of Civil Rights on August 23, 1978, as the first step in complying with the law. Subsequent to giving assurance that the Board would comply with Section 504 of the Rehabilitation Act, the Board of Commissioners also appointed a five member steering committee to do the planning re- quired to bring county government into compliance with the law. This committee, called the 504 Compliance Committee for Weld County, consists of the following individuals: Leonard Roe, Chairman, County Commissioner Linda Piper, Vice Chairman, Division of Human Resources Andy Petruzzi , Supervisor, Buildings and Grounds Nick Martinez, Personnel Department Dean Tuttle, Professor Special Education, Handicapped Representative The Compliance Committee held its first meeting onFebruary 1 1979. At that time, a schedule was outlined to provide for meetings on the first and fourth Thursdays of every month. Following the mandate of the 504 regulations, the committee established as its first priority the identification of all physical barriers that limit the accessibility of county programs or activities to handicapped persons. This evaluation included all county owned buildings, lease agreement buildings , and donated space buildings where county sponsored activities occur on a regular basis. To Complete the survey the committee appointed an evaluation team composed of two members of the steering committee, a volunteer handi- capped person from the community, and a representative from the depart- ment or program being evaluated. A site inspections checklist based on American National Standards Institute accessibility standards (Exhibit A) was reviewed and adopted by the committee to insure that each facility would be judged equally. Working on a daily schedule, the evaluation team examined 31 build- ings between March 15, 1979, and March 30, 1979. The findings from these site visits and methods and target dates for making the necessary structural changes to meet accessibility requirements is the principle purpose of this Transition Plan as presented to the Board of County Commissioners and the citizens of Weld County. This plan, as adopted, fulfills the second part of the three part process requiring a Transition Plan when structural changes to facilities are needed. ID About This Report The results of the site inspections follow and comprise the major portion of the Transition Plan as required by the 504 Act. The purpose of this plan is to identify in each facility the physical obstacle that limits accessibility, assign expected and actual dates of achieving accessibility, and state the estimated cost of elimin- ating the physical barrier. Facilities are grouped according to county-owned buildings , lease agreement buildings, and donated space buildings . Donated space buildings represent a special condition whereby a county-sponsored program is held on a regular basis in a facility which is donated to the program using the space. This condition applies generally to The Weld Senior Nutrition meal sites, Weld Head Start buildings , and temporary polling places designated during elections. The format for reporting the results of the evaluation of donated space buildings has been modified to include comments which identify, when necessary, owner of the building and any other special situation which will affect the ability of the program to correct physical barriers. Costs and target dates were not stated for donated space buildings. It will be the responsibility of the Program Directors and owners of donated space facilities to reach reasonable solutions to barrier problems, especially where the barrier is a major one. If no solution is possible the program shall make plans to move to an accessible facility. In a few instances where buildings are county owned or leased the target dates for barrier elimination have been stated as "Matter Under Study". This statement signifies that the remedy is major and that an alternative solution is being considered by the 504 Committee and the Board of County Commissioners. The Transition Plan will be amended when a decision is reached on the remedy. In other instances the committee has stated "Alternative Solution Possible" where a barrier can be eliminated by changing the location of a program or one or more functions within a program. In every instance the committee has sought reasonable solutions without compromising the intent of the law. The one hundred and sixteen ( 116) polling places which are selected by the Weld County Clerk and Recorder, are temporary facilities used during national , State, and local elections. A site by site survey of the poll- ing places was not conducted by the Committee, however, a policy has been developed within the Clerk and Recorder's Office to insure that handi- capped persons have alternative polling procedures available on election days . An outline of that policy is part of the following report. It will be the responsibility of the 504 Compliance Committee to monitor progress on barrier removal . Completion dates which extend beyond the Federally mandated, June, 1980, deadline will require an amendment to the plan identifying steps that will be taken each year of the transition period. Newly constructed facilities must be readily accessible to and useable , by the handicapped from the day of completion. Design, construction, or alteration of facilities shall be in conformance with the "American .National Standard Specifications of Making Buildings and Facilities Accessible to, and Useable by, the Physically Handicapped", published by the American National Standards Institute, Inc. (ANSI A 117. 1 - 1961 (R 1971). The ANSI Standards are the only standards accepted by the federal government for determining whether or not a building is access- ible. Because the law is very specific about the use of the ANSI Standards, the 504 Compliance Committee recommends that all future speci- fications adopted for the construction of new and renovated facilities include the ANSI Standards specifications. Responsible for carrying out the implementation of this Transition Plan will be the Board of Weld County Commissioners working through the 504 Compliance Committee. Primary consideration is given to selecting facilities which will accommodate persons in wheel chairs and elderly persons who might have difficulties in climb- ing steps. When an accessible building is not available within the precinct boundary, the law requires that another facility must be designated within the precinct. However, a voter has as an alternative the right to vote by absentee ballot. Weld County also uses a portable data vote punch machine. Election judges may *hand carry the data vote machine out of the polling place to allow a person to vote from his car. This method accommodates many persons who prefer to vote in their own precinct and are able to travel to the polling place by car even though they are not able to physically enter the building. Also, in compliance with Colorado State Law 1-5-107(2) which applies to a county of 100,000 or more, one accessible polling place must be available which has been designated as the County Clerk and Recorder's Office within the Centennial Building of Greeley, Colorado. A registered voter from anywhere in Weld County who needs an accessible polling place may vote at the Centennial Building on election day regardless of precinct registration. Conclusion Many of the physical barriers to the handicapped which have been identified in this report require a minimum of time and expense to remedy. Others require major modifications and some require further study to see if a more cost effective alternative solution. is possible. In every instance it has been the goal of the committee to meet both the letter and intent of the 504 Handicapped Law while at the same time seeking reasonable solutions.
