Consider Application for Tavern Liquor License 4 and authorize Chair to sign — Capricho Rojo, LLC, dba Capricho, Capricho Rojo. 5 FRANK HAUG: Good morning, Commissioners. Assistant County Attorney Frank 6 Haug. To my left is Maribel Linder who is the applicant in this case. Uh, this is a application for a 7 liquor license. I do want to give you a little bit of background just to kind of frame it for you. 8 What initially happened was this was operated by Edgar and Rodolfo Montez. They initially were 9 going to transfer the license to Maribel. They then revoked that license and so she had to submit 10 a new application, a complete new application in order to go through with this. She does have a 11 lease for that facility that goes through 2017. Uhm, I, I believe Commissioner Cozad did the 12 inspection. I'll let her make comments. You know, the, the comments that I would make to the 13 Board are she has filled everything out. She's done what she needs to do. The Sheriff's 14 Department didn't note any concerns regarding this facility. What I will tell you is that in the 15 past, we have had some difficulty, uhm, scheduling inspections and things. We have had some 16 difficulty with this sort of in between operation where it was gonna be transferred and then it 17 wasn't transferred and then, now she's doing a new application. It, it appears to me she does 18 have all of the T's crossed and the l's dotted, but what I would say is that, uhm, they need to 19 make sure that they're available when we need to inspect it and things like that, if it's approved 20 by the Board. The Health Department did provide you a summary of kind of the history here. I 21 think the main issue has been that Rodolfo, at one point, had said, "Well, I'm gonna terminate 22 the lease with Maribel." That doesn't seem to be happening anymore. The information we have 1 1 right now is that everything seems to be in order; however, there have been some back and forth 2 a little bit between the landlord and the tenant. The only other thing I would mention is that Ms. 3 Linder did have a couple of alcohol -related driving offenses. That was in the mid -to late 2008, 4 2009 range. She's completed all of that, has not had any offenses in the last six years, and I don't 5 have any indication that she hasn't done everything she needs to do for those things. So with 6 that said, it appears everything is in order. I don't know if, how you want to proceed Commish, 7 uhm, Mr. Chair, but that, those are my comments. 8 CHAIR FREEMAN: Okay. No that's good. Thank you. Commissioner Cozad? 9 COMMISSIONER COZAD: So, uhm, I'll, I'll make a, a quick report. So I, I did go 10 down and do the inspection down there and actually would have to say, I was late for the meeting 11 and, uh, so it had nothing to do with the applicant. Uhm, I think I was, I called, but I was about 12 an hour late, but I would have to say, uhm, I did the inspection on the previous, uhm, license and 13 had a hard time getting something set up and, and having the, the applicant for that liquor license 14 actually meet me when I was down there, so this time though I think, uhm, the inspection went 15 fine. Uhm, when I was there, they were doing a lot of cleaning and painting and, uh, the facility 16 itself was in, you know, really good repair and, and, uh, I, I have no concerns at all. I think there's 17 still the, the neighborhood hasn't changed from the last inspection I did about a year ago. So, 18 uhm, I have no concerns. 19 CHAIR FREEMAN: Okay. Does, does the applicant wish to, is there any comments 20 you'd like to make? 21 MARIBEL LINDER: No. 22 CHAIR FREEMAN: Okay. 2 1 MARIBEL LINDER: I just want to keep working (laughs). 2 CHAIR FREEMAN: Okay. Well with that, I'll bring it back to the 3 Board then. 4 COMMISSIONER COZAD: Uh, I would make a motion that, uh, we approve the 5 Application for Tavern Liquor License and authorize Chair to sign for Capricho Rojo, LLC. 6 COMMISSIONER CONWAY: I second. 7 CHAIR FREEMAN: It's been moved by Commissioner Cozad.
