RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR SCHOOL -BASED HEALTH
CENTER AND AUTHORIZE CHAIR TO SIGN - SUNRISE COMMUNITY HEALTH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for a
School -Based Health Center between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Human Services,
and Sunrise Community Health, commencing July 1, 2016, and ending June 30, 2017, with further
terms and conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for a School -Based Health Center
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and Sunrise
Community Health be and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of September, A.D., 2016, nunc pro tunc July 1, 2016.

Memorandums of Understanding (MOU's) with Weld
County School District 6 (WCSD6) and Sunrise
Community Health (Sunrise)
Please review and indicate if you would like a work session prior to placing these items on the
Board's agenda.
Request Board Approval of the Department's Memorandums of Understanding (MOU's)
with Weld County School District 6 (WCSD6) and Sunrise Community Health. The
Department and WCSD6 continue to commit to providing eligibility determination functions at
School Based Health Centers, supporting family health insurance needs. This outreach will
consist of three (3) days per week and support all District 6 students. The cost of salary and
benefits will be the responsibility of Human Services. WCSD6 shall reimburse Human Services
at a cost not to exceed $2,000.00 per month and the agreement total will not exceed $24,000.00
during the period of July 1, 2016 through June 30, 2017.
Services will be provided at the Sunrise Kids Care Clinic located in WCSD6 buildings. Sunrise
has requested an additional Memorandum of Understanding for this site along with an
Attestation Statement. There will be no monetary exchange associated with the Sunrise MOU.
I do not recommend a Work Session. I recommend approval of these MOU's and the signing of
the Attestation Statement.

MEMORANDUM ()F UNDERSTANDING
BETWEEN
SUNRISE COMMUNITY HEALTH ANI)
WELD COUNTY DEPARTMENT OF HUMAN SERVICES
This Agreement is made and entered into between Sunrise Community Health. hereinafter
rclerred to as "St lNRISIT and Weld Count Department of Human Services, hereinafter
referred to as "WCf)l IS".
Whereas, W('1)1IS has trained personnel and computer programming to complete
Medicaid applications; and
Whereas, SUNRISE has actinic inWeld C Cot tiny Distil 6buildings; iuid
Whereas, families come to the SIJJNRISFC'lnicwhoareinneed ofenroilment and immediate
verification ofcligibility of Medicaid services;
NOW THEREFORE, in consideration of the mutual promises set forth herein, the parties
hereto agree as follows:
1. Agreement. One part-time Medicaid Intake Spu. ialist to he assigned to work at a Sunrise Community
l lealth (`'link within a Weld County Iistrict 6 School and work at the School Rased I leaith C'entersupporting
family health insurance needs :7 days per week.
1.1. -File specialist cialist will 1 responsible for determining proga run eligibility for Colorado
Medicaid, and entering the data into the Colorado Benefits Management Systems to
complete the eligibility determination process on site for families.
Employment. [he Medicaid Intake Specialist shall be an employee of the WCDI IS. As
such, the specialist will be subject to the policies, rules, regulations, directives and orders of
the county. The specialist will be subject to the supervision ofthe WCI)IIS, and shall work
the same scheduled hours as the WCDHS employees.
2. j. Salary and Benefits. The cost of the salary and benefits for the specialist. shall be the
responsibility of WCDI IS and District 6 through a separate agreement.
2.2. Workplace. The specialist will have a confidential workplace and access to a
computer. the internet and phone and office supplies. WCDI IS will establish
connectiv itv to the Colorado Benefits Management System and other automated systems
required by the specialist.
2.4. Qualifications and selection. The specialist will be selected by the WCI)HS in
accordance with I finnan Resource qualifications, An experienced worker will be
initially placed, with the option of replacing the worker with a fully trained new
worker at a later date. The specialist will be required to speak Spanish fluently.
Liability Coverage. WCI)lIS and SUNRISE shall exchange evidence of insurance showing
general liability coverage in the minimum amount of the Colorado Governmental immunity
Act for protection from claims for bodily injury, death, property damage, or personal injury
which may arise through the execution of this agreement. Recipients of such evidence shah be
the SUNRISE Chief Executive Officer and the Director of WCDIIS. Such evidence shall be
approved by each recipient prior to commencement of this agreement.
4. Immunity. Nothing in the Agreement shall be construed (i) as a waiver by either party of
immunity provided by common law or by statute, specifically including the Colorado
Governmental immunity Act, Section 24-10-101, cl.seq. C.K.S., as it may be amended from
time to time; (ii) as creating as assumption of any duty or obligation with respect to any third
party where no such duty previously existed; or (iii) as creating any rights enforceable by such
third parties.
5. Termination. This agreement may be terminated without cause by either SUNRISE or
WCDIIS upon 30 days written advance notice.
6. Entire Agreement. This agreement contains the entire understanding of the parties with
respect to the subject matter hereof, and all other understandings or agreements shall be
deemed merged into this agreement. Amendments of this agreement may only he made if in
writing and signed by both of the parties hereto.
7. Third Party Beneficiaries. It is expressly understood and agreed that the enforcement of the
terms and conditions of this agreement, and all rights of action relating to such enforcement,
shall be strictly reserved to the undersigned parties and nothing in this agreement shall give
or allow any claim or right of action whatsoever by any other person not included in this
agreement. It is the express intention of the undersigned parties that any entity other than the
undersigned parties receiving services or benefits under this agreement shall be an incidental
beneficiary only.
8. Confidentiality. All parties to this agreement and the Medicaid Intake Specialist
employed under this agreement shall comply with all federal, state and county laws
and regulations governing confidentiality, subject only to statutory exceptions applicable to
criminal investigations and proceedings.
9. .,amendment. Any amendment of this agreement may be made only by written
agreement and signed by all parties hereto.
