Home My WebLink About20161186 RESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION AGAINST SHERWOOD DONALD LANGLEY AND ELIZABETH GARBER, CIO WASTE CHASERS FOR VIOLATION OF THE WELD COUNTY CODE -ZCV16-00016 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Sherwood Donald Langley and Elizabeth Garber, do Waste Chaser, ZCV16- 00016, are allegedly in violation of the Weld County Code, specifically Commercial storage and uses within Agricultural Zone that is not permitted, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation was not corrected, and WHEREAS, on the 14th day of March, 2016, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time the matter was continued to April 4, 2016, to allow the property tenant adequate time to remove the containers. The storage of Waste Chaser's dumpsters and portable toilets pose a significant safety risk being situated within the floodway. If a significant early spring melt were to occur, flooding concerns along with damage to public and private property and person injury would be present.
