If a question does not pertain to your use, please respond with "not applicable" , with an explanation as to why the question is not applicable. 1 . Explain , in detail , the proposed use of the property. Miller HFI requests a Use by Special Review permit to store approximately eighty-five (85) empty oil field fracking storage tanks on a three (3) to four (4) acre portion of a three hundred-twenty acre parcel. The storage area is located central to the property approximately six tenths of one mile west of Weld County Road 83. The tanks are generally used at drilling locations within Weld County and moved to new well locations as the drilling schedule requires. Due to the recent reduction of drilling and fracking operations, the tanks require short term storage. The tanks will be relocated to drilling sites as needed. There will be no employees associated with the site. One offsite driver will pickup tanks as required by the drilling schedule. The overall property is comprised of approximately 320 acres and is located west of Weld County Road 83 and north of Weld County Road 70 approximately 10 miles southeast of the Town of Briggsdale. Trucks access the site by way of an agricultural access located approximately 0. 2 miles north of Weld County Road 70 on Weld County Road 83. 2 . Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan) . Sec. 22-2-20. Agriculture goals and policies. G . A. Goal 7 . County land use regulations should protect the individual property owner's right to request a land use change. 2 . A. Policy 7 . 2 . Conversion of agricultural land to nonurban residential , commercial and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region . The proposed use is consistent with the Weld County Comprehensive Plan. The subject site is in an area that can support such development, and attempts to be compatible with the region. The site will be utilized by the oil and gas industry in the area where the stored tanks are located. 3 . Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located . The proposal is for storage of empty (racking tanks in the Agricultural Zone. This proposal is allowed in the Ag Zone as a Use by Special Review as called in Chapter 23, 23-3-40. Sec. 23-3-40 . - Uses by special review. The following BUILDINGS , STRUCTURES and USES may be constructed , occupied , operated and maintained in the A (Agricultural) Zone District upon approval of a permit in accordance with the requirements and procedures set forth in Article II , Division 4 of this Chapter. A. Mineral resource development facilities including : 2 . OIL AND GAS SUPPORT AND SERVICE. 4. What types of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. Agricultural uses that surround this site are primarily crop farming, hay production, cattle grazing, oil and gas operations and rural residential. This proposal is compatible with the surrounding agricultural uses and the Weld County Comprehensive Plan. 5 . Describe, in detail , the following : a . Number of people will use this site? One pad time employee will use the site. b. Number of employees proposed to be employed at this site? There will be no employees located at this site. c. Hours of operation? The site is projected to be available Monday-Sunday, twenty-four hours per day as necessary for the drilling schedule. d . Type and number structures to be erected (built) on this site? No structures will be associated with the storage site. e. What type and number of animals, if any, will be on this site? No animals will be associated with the storage site. f. Kind of vehicles (type, size, weight) that will access this site and how often? Typical vehicles accessing this site include one skid tank truck. The following numbers are anticipated: Skid tank truck: 1 truck at 8 trips per day or one trip per hour as necessary to move tanks g . Who will provide fire protection to the site? Briggsdale Fire Protection District h . What is the water source on the property? (Both domestic and irrigation) There will be no permanent employees on-site. Bottled water will be utilized. i . Sewage disposal system on the property? ( Existing and proposed ). There will be no permanent employees on-site. Therefore, the applicant requests a waiver from portable toilets. j . If storage or warehousing is proposed , what type of items will be stored? Storage of empty frack tanks is proposed. 6 . Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal . There is no landscaping planned with this permit application. 7 . Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Reclamation procedures are not necessary for the site as the tanks will be stored on native soil, no pads will be constructed. If necessary the area will be reseeded or farmed. 8 . Explain how the storm water drainage will be handled on the site . The Miller HFI, LLC site is a 320-acre parcel that is proposed to be used for the temporary storage of empty frack tanks. The site will not have any permanent infrastructure and is exempt from stormwater detention as described in Article Xll, Storm Drainage Criteria, Section 23- 12-20 Adoption of Storm Drainage Standards. F. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property and shall be limited to the following: h. Development of sites where the change of use does not increase the imperviousness of the site. 9 . Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin . No construction is proposed. 10 . Explain where storage and/or stockpile of wastes will occur on this site.
