Application Form 1. On Item#9 of the Application Form, the Applicant provided four(4)section numbers and did not select a quarter section or quarter/quarter section selection. The approved permit application lists the center of the area where the majority of the mining will occur as Section "8", "SW" Quarter Section and "SE" Quarter/Quarter Section. Please explain this discrepancy and revise the amendment application form, as needed, to provide the section, quarter section and quarter/quarter section information. Item#9 of the Application Form has been revised to correct the location information to list the center of the area where the majority of mining will(or in this case has)occurred. This is the same as the currently approved application; i.e., Section 8, SW Quarter Section, SE Quarter/Quarter Section. Page 2 of the application form with the revised Item#9 information is enclosed. 2. On Item#12 of the Application Form, the Applicant did not select a post mining land use selection. Please revise the Application Form to indicate a post-mining land use. The site is currently approved for "recreation"as the post-mining land use. As stated in Item#16 Description of Amendment on the Application Form and the cover letter under which the Amendment was submitted,this revision does not propose to change the currently approved post-mining land use,which is wildlife habitat and recreation. While the Application Form only allows the operator to select one post-mining land use,wildlife habitat and recreation were stated in Section 6.2 of Exhibit E in AM-003 as the post-mining land use. The same post-mining land use was reiterated in Section 6.2 of Exhibit E in TR-4. However, in order to satisfy the Division's requirement, Item#12 has been revised on the Application Form to indicate"recreation"as the post-mining land use. The Division requires the Applicant to provide documentation giving the signer,John Colin, the authority to sign on behalf of the company. The authorization document may be in the form of by-laws, resolution, affidavit signed by corporate secretary, certified secretary statement or a notarized statement on company letterhead. Enclosed is the required documentation. Rule 1.10 -Amendment to a Permit 4. Rule 1.10.1 states, there shall be filed with an application for a 112 Reclamation Permit amendment...the same content as required for an original application, except that the Applicant will not be required to submit any information which duplicates applicable previous submittals.However, the Applicant shall clearly describe where in the original application and supporting documents the information not included in the amendment application, but necessary to render the amendment technically adequate, may be found. The Applicant did not provide the following exhibits required to deem the amendment application complete for filing: This revision proposes to update the reclamation plan to reflect the current landscape of the Longmont Distel Operations site and to identify remaining areas for post-mining reclamation and areas for flood restoration following the catastrophic flood event throughout the St.Vrain Creek watershed in September 2013. Exhibit F-1 —Post 2013 Flood Conditions, Restoration, Improvements and Remaining Post- Mining Reclamation, as submitted with the amendment application on March 25,2016, identifies these areas. Rule 6.4.1 -Exhibit A -Legal Description—Legal descriptions for properties within the current approved permit boundary are set forth in Exhibit A of the original application(1989),Amendment AM-001 (1994),Amendment AM-002(1998), and Amendment AM-003 (2000). No additions or deletions are proposed in this Amendment Application AM-04. Rule 6.4.2 -Exhibit B -Index Map—See Exhibit B of AM-003. Rule 6.4.3 -Exhibit C -Pre-mining and Mining Plan Map(s) of Affected Lands—The only change associated with Exhibit C requirements as it applies to this amendment application is the map portraying surface owners of record,as some parcels of land have changed ownership since AM-003. A map portraying the parcels of land within the permit boundary and those parcels containing land within 200- feet of the permit boundary is therefore provided in this section. A list of the owners of the parcels portrayed on the map is also provided in this section. Rule 6.4.4 -Exhibit D -Mining Plan-All extraction activity was completed prior to this Amendment Application. Processing and sales of material from an adjacent operation(Permit No.M-1994)is ongoing. See Exhibit D of AM-003. Rule 6.4.5 -Exhibit E -Reclamation Plan- Aggregate will continue to reclaim lands affected by its operations that were not impacted by the September 2013 flood in accordance with the currently approved reclamation plan as set forth in Exhibit E of Technical Revision TR-04. AGGREGATE Mr.Peter Hays,Division of Reclamation,Mining and Safety May 16,2016 Page 3 Restoration and improvements in flood impacted areas within extents of mining related disturbances of Longmont Distel will be completed in accordance with City of Longmont's Resilient St.Vrain Project as submitted in the City's Section 404 permit application to U.S. Army Corps of Engineers(Application No. NWO-2015-02224-DEN). The work proposed under the 404 permit application is summarized in the "Sandstone Ranch Reach Improvements Summary"as provided by the City and submitted with the amendment application on March 25, 2016. In a continuing partnership with Longmont, Aggregate will perform certain post-flood improvements activities in accordance with the"Resilient St.Vrain Project". The areas for which Aggregate will provide this work are adjacent to its ongoing processing and reclamation activities and are identified on Exhibit F-1,which was submitted with the amendment application on March 25,2016. Rule 6.4.7 -Exhibit G -Water Information—Water information was included under Additional Information, Water Augmentation as set forth in the cover letter submitted with this Amendment Application on March 25,2016. As noted in that letter,the post-mining depletions at Longmont Distel Operations are covered under Longmont's February 20,2013 approved permanent augmentation plan (District Court, Water Division 1,Case No.2009CW271). A copy of the Decree is enclosed. Rule 6.4.8 -Exhibit H-Wildlife Information—Wildlife information was included in Exhibit H of the original permit application and subsequent amendment applications. Extraction activities at the site were completed prior to this amendment application. No new disturbances are proposed with this amendment application and the areas of remaining reclamation will be reclaimed as set forth in the approved reclamation plan,which prov ides for wildlife habitat and recreation. Rule 6.4.9 -Exhibit I-Soils Information—Soils information was included in Exhibit I of the original permit application and subsequent amendment applications. Rule 6.4.10 -Exhibit J-Vegetation Information—Vegetation information was included in Exhibit J of the original permit application and subsequent amendment applications.Rule it K has been updated with the most logy data 6. -Exhibit ibi Station 55116 ae— s compiled by the Colorado Climate Center tatlColoorado State available for Longmont University. Rule 6.4.12 -Exhibit L -Reclamation Costs—The Division currently holds a financial warranty for reclamation in the amount of$1,483,800. As there are no proposed changes to reclamation of the post- mining areas to be reclaimed by Aggregate,the current bond amount is expected to be sufficient to cover Aggregate's remaining reclamation obligation Rule 6.4.13 -Exhibit M-Other Permits and Licenses—See Exhibit M of AM-003. Rule 6.4.14 -Exhibit N-Source of Legal Right to Enter—Sources of Legal Right to Enter the properties within the permit boundary have been previously provided in Exhibit N of the original application and subsequent amendment applications. Rule 6.4.15 -Exhibit O -Owner(s) of Record of Affected Land(Surface Area)and Owners of Substance to be Mined—See attached Exhibit O. Mining has been completed and no additional disturbances are proposed in this amendment application. Rule 6.5 -Geotechnical Stability Exhibit—not applicable. Mining has been completed and no additional disturbances are proposed in this amendment application. A copy of this letter,together with documents referenced herein,has been filed with the Clerk to the Board of Weld County Commissioners. In Weld County,the Clerk to the Board is the designated recipient for DRMS application documents rather than the Clerk and Recorder. Enclosed is a copy of Proof of Filing. Arrangements will be made to begin publication of the required Public Notice within ten(10)days of notification by the Division that this amendment application is considered to have been submitted,with said notification to be published once weekly for four(4)consecutive weeks. Longmont adjudicates herein a post-mining augmentation plan for several parcels collectively known as the Saint Vrain Integrated Reclamation Plan Project(the "Project"or"Project Property"). Portions of the Project Property have been mined and, at the time of entry of this Ruling and Decree,portions are still being mined for construction aggregates by Aggregate Industries—WCR, Inc. ("AI"),pursuant to Permit#M-1989-029 issued by the Colorado Division of Reclamation, Mining& Safety(a/k/a the "Distel Permit"). A vicinity map attached as Exhibit A shows the boundary area for the Distel Permit("Mine Permit Area"). The Project Property previously consisted of several individual parcels that are now owned(with the exception of two small homestead parcels)by Longmont,jointly owned by Longmont and Boulder County, and/or under option to Longmont. Longmont and AI entered into a Second Amended and Restated Mineral Lease(the "Mineral Lease Agreement")on December 22, 2009, confirming and clarifying certain responsibilities of the parties with respect to the Project. In accordance with the Mineral Lease Agreement, the Mine Permit Area is being reclaimed by AI as an open space greenway for the City, consisting of ponds, streams,wetlands and natural vegetation. Certain of these features will result in new depletions to the St. Vrain Creek and South Platte River. Longmont is responsible under the Mineral Lease Agreement for adjudicating and operating the permanent water supplies associated with the post-mining reclamation of the Mine Permit Area. This Ruling and Decree adjudicates a plan for augmentation to replace out-of-priority depletions associated with the Mine Permit Area upon completion of mining. Such out-of- 2 Ruling and Decree Case No.2009CW271 City of Longmont priority depletions will be replaced using the historical net stream depletions attributable to Longmont's interests in the Coffin Davis Ditch, and, as necessary, other sources of water owned by Longmont that have been decreed for augmentation purposes. The Coffin Davis Ditch diverts water from Dry Creek, a tributary of the St. Vrain, and has historically been used for irrigation within the Mine Permit Area, as well as on approximately 36 acres located outside the Mine Permit Area. A change of water right for the Coffin Davis Ditch is approved herein, in addition to appropriative rights of exchange to facilitate storage of the changed Coffin Davis Ditch water in Union Reservoir. This Ruling and Decree also confirms a new surface water right, to be diverted and used, when available in-priority at any time of the year, to support the open space purposes of the Project. II. Change of water right. 6. Description of decreed water right changed herein. A. Name of structure. Coffin Davis Ditch. B. Date of original and all relevant subsequent decrees. i. Original. The original decree for the Coffin Davis Ditch was entered on June 2, 1882, in Civil Action No. 1327, District Court, Boulder County, Colorado. ii. Prior change. A decree was entered on August 28, 1981 in Case No. 81CW06, District Court, Water Division No. 1 (the "1981 Decree"), changing 17.3 c.f.s. of Priority 31 to the alternate point of diversion described below. C. Decreed legal description of structure. i. Original point of diversion. On the south bank of St. Vrain Creek, approximately 40 rods north of the Southeast corner of the E'/2 SE'/4 of Section 12, Township 2 North, Range 69 West, 6th P.M.,Boulder County, Colorado. ii. Alternate point. In the SW'/4 of Section 7, Township 2 North, Range 68 West, 6th P.M., Weld County, Colorado, at a point commencing at the SW corner of Section 7,whence the West one-quarter corner of said Section 7 bears North 00°00'00"East, thence North 88°03'49"East 999.07 feet to the point of diversion, as depicted on the attached Exhibit B. D. Decreed source of water. St. Vrain Creek; 17.3 c.f.s. changed by the 1981 Decree to Dry Creek, a tributary of St. Vrain Creek, as an alternate point of diversion. E. Appropriation date. June 1, 1866(Priority 31); June 1, 1871 (Priority 45). 3 Ruling and Decree Case No.2009CW271 City of Longmont F. Total amount decreed. The Coffin Davis Ditch was adjudicated in the amount of 1200 customary inches, for Priorities 31 &45, combined, which amount has been interpreted by the State Engineer of the State of Colorado as being the equivalent of 27.05 c.f.s. Of this, the 1981 Decree changed Priority 31, in the amount of 17.3 c.f.s., to the alternate point of diversion. G. Decreed uses. Irrigation and stock water. H. Amount of water changed herein. Longmont owns and/or has a lease- purchase option for the entire 17.3 c.f.s. interest changed by the 1981 Decree, and is further changing such 17.3 c.f.s. (the "Longmont Coffin Davis Right") for the purposes described below. I. Historical use. The historical use of the Longmont Coffin Davis Right is described in an engineering report dated February 2010,prepared by Deere&Ault Consultants, Inc. ("Report"). Both the conclusions in the Report and the findings in this Ruling and Decree relating to historical diversions, consumptive use, and return flows are based on a study period utilizing the years from 1950 through 1990. The period from 1950 to 1990 was properly used as the representative study period for the Longmont Coffin Davis Right because mining of the historically irrigated property began in 1991,at which time the Longmont Coffin Davis Right was used as a replacement water source for mining operations in accordance with temporary substitute supply plans approved by the State Engineer pursuant to § 37-90-137(11), C.R.S. The Report utilizes the same methodologies for quantifying historical use and developing terms and conditions in the present case as have been approved in numerous prior change decrees in the St. Vrain Creek basin. The court finds that the study period and methodologies utilized in the Report provide a consistent, accurate and representative record of the historical beneficial use of the Longmont Coffin Davis Right. Based on the Report,the court finds that: i. Irrigated acreage. The Longmont Coffin Davis Right has historically been used to irrigate an average of 315.5 acres of land generally located in portions of Sections 7, 8, 17 and 18, Township 2 North, Range 68 West, 6th P.M., Weld County, Colorado, shown on Exhibit B. Approximately 36 acres of the total 315.5 acres of land historically irrigated are located outside the Mine Permit Area; these 36 acres are owned by Longmont. ii. Average annual diversion. The average annual irrigation diversions for the Longmont Coffin Davis Right during the study period are 951.2 acre-feet. iii. Historical consumptive use. The average annual consumptive use attributable to the Longmont Coffin Davis Right during the study period is 523.1 acre-feet. 7. Description of changes adjudicated. In addition to the original decreed uses for irrigation and stock water, Longmont herein adjudicates alternate uses for the Longmont Coffin 4 Ruling and Decree Case No.2009CW27 1 City of Longmont Davis Right to allow for direct use and storage for municipal,reclamation, replacement, augmentation and exchange purposes, both within and without Longmont's city limits as they now exist or may exist in the future. "Municipal use"includes all municipal uses, such as,but not by way of limitation, domestic, commercial,manufacturing, industrial, agricultural,watering of parks and lawns and gardens, fire protection,generation of electric power and power generally,recreation, fish and wildlife propagation,wastewater treatment, street sprinlding, and maintenance of adequate storage reserves. Such purposes shall include the right to use,reuse, successively use and dispose of the water to extinction. When using the Longmont Coffin Davis Right for the foregoing alternate uses, Longmont may store water from the Longmont Coffin Davis Right in Union Reservoir and any enlargement thereof, located in Sections 29, 30, 31 and 32, Township 3 North, Range 68 West of the 6th P.M., and upon parts of Sections 5 and 6, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado. Such storage will occur pursuant to the exchanges described in Paragraph 13, below, and/or by re-diversion at Longmont's Pump Station No. 2, a proposed pump and pipeline to carry water from St. Vrain Creek to Union Reservoir, with an inlet to be located at a point on the west bank of St. Vrain Creek approximately 190 feet North and 2700 feet East of the Southwest corner of Section 4, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and depicted on Exhibit A. 8. Terms and conditions of change. So long as the terms and protective conditions specified hereinafter are followed, the court finds that the Longmont Coffin Davis Right may be changed, as described above,without material injury to the vested water rights and decreed conditional water rights of others, and without enlargement of the Longmont Coffin Davis Right: A. Diversions. Diversions of the Longmont Coffin Davis Right for the alternate uses described above shall continue to be made at the Coffin Davis headgate on Dry Creek, when in priority, at a maximum rate of 17.3 c.f.s. A portion of the Longmont Coffin Davis Right may continue to be used for the original decreed irrigation purpose on the 36 historically irrigated acres located outside of the Mine Permit Area, with proportionate reductions in the amount available to Longmont for the alternate uses, as described in Paragraph 8.J., below. Prior to April 15th of each year, Longmont shall specify to the Division Engineer and Water Commissioner, in writing,the percentage of the Longmont Coffin Davis Right to be used that year for the original decreed irrigation use, if any, and the percentage to be used for the alternate uses. Following such annual designation, the percentage designated for irrigation use may not be changed to the alternate uses for that year, nor shall the percentage designated for the alternate uses be changed to irrigation use for that year. Diversions of the Longmont Coffin Davis Right for the alternate uses shall then be limited, for that year, to a rate equal to 17.3 c.f.s. times the percentage of the Longmont Coffin Davis Right being used for the alternate uses. For example, if 11.5 percent of the Right is being used for irrigation of the 36 historically irrigated acres located outside of the Mine Permit Area, then the flow rate limit for the alternate uses would be 5 Ruling and Decree Case No.2009CW271 City of Longmont 15.3 c.f.s. Combined diversions of the Longmont Coffin Davis Right for both the original decreed uses and the alternate uses shall not exceed 17.3 c.f.s. B. Since at least entry of the 1981 Decree, the 17.3 c.f.s. of Priority 31 has been used to irrigate all of the land historically irrigated under the Coffin Davis Ditch. C. Measurement. Longmont(or AI pursuant to the Mineral Lease Agreement) shall install a measuring and recording device in the Coffin Davis Ditch to measure the daily diversions of the Longmont Coffin Davis Right. The measuring device shall be subject to the approval and conform to the current standards of the Division Engineer and will include a continuous recorder to generate a record of daily diversions of the Longmont Coffin Davis Right. Longmont shall measure and account for all water diverted and used under the Coffin Davis Right on a daily basis and shall submit monthly accounting to the Division Engineer and Water Commissioner on forms acceptable to them. An augmentation station will also be constructed(at a location to be determined by Longmont)to deliver water diverted pursuant to the Longmont Coffin Davis Right to the Mine Permit Area and/or back to Dry Creek and St. Vrain Creek. A measuring device and continuous recorder will be installed as part of the augmentation station to measure all such deliveries. The measuring device for diversions and the augmentation structure may be constructed as a single structure,provided such structure is approved by the Division Engineer. D. Timing of diversions. Diversions of the Longmont Coffin Davis Right for the alternate uses described above shall be limited to the season of April 15t through October 31st of each year. Should any use for the original irrigation purposes be made prior to Longmont's designation on April 15th, it will be based on the prior year's percentage designation. E. Net stream depletion credits. Longmont will generate fully-consumable net stream depletion credits on a daily basis when diverting water pursuant to the Longmont Coffin Davis Right for the alternate uses described above. When the downstream call is junior to December 30, 2009, and no return flow replacements are required as set forth in Paragraph 8.H., below, then net stream depletion credits shall be equal to measured diversions. When the downstream call is senior to December 30, 2009,net stream depletion credits will be calculated by multiplying measured diversions by the appropriate monthly depletion factor in Table 1, below. The calculated net stream depletion credits may be delivered, via the augmentation station and at Longmont's sole discretion, either directly to the Mine Permit Area or to Dry Creek and St. Vrain Creek(or a combination thereof). All net stream depletion credits delivered directly to the Mine Permit Area will be deemed fully used for replacement of out-of-priority depletions pursuant to the plan for augmentation approved herein, and Longmont shall not claim any credit for any Longmont Coffin Davis Right net stream depletion credits so delivered to the Mine Permit Area in excess of the augmentation replacement requirements. Net stream depletion credits delivered to Dry Creek and St. Vrain Creek, and not otherwise directly used by Longmont 6 Ruling and Decree Case No.2009CW271 City of Longmont as a replacement source in the augmentation plan approved herein, may be stored in Union Reservoir pursuant to the exchanges described in Paragraph 13,below, may be re-diverted at the St. Vrain Pump Station No. 2, or may be used for other decreed purposes. Such fully- consumable net stream depletion credits may be reused, successively used, and disposed of to extinction. In order to assure that future diversions of the Longmont Coffin Davis Right do not exceed historical maximum amounts, total diversions (for both the alternate uses and any continued irrigation use) shall be limited to the maximum monthly and annual volumes set forth in Table 2. Volumetric limits—rolling average. To further prevent an expansion of use, total diversions(for both the alternate uses and any continued irrigation use) of the Longmont Coffin Davis Right shall be limited to a 40-year rolling average volumetric limit of 37,768 acre-feet. To calculate the amount available for diversion under this limitation, the total amount of diversions pursuant to the Longmont Coffin Davis Right from the immediately preceding 39-years shall be subtracted from the 40-year rolling average volumetric limit(37,768 acre-feet). For purposes of operating the rolling 40-year volumetric limit during the first 39 years 7 Ruling and Decree Case No.2009CW271 City of Longmont following the entry of a decree in this case,the preceding 39 years shall be the last 39 years covered by the study period(1952-1990)as set forth in the attached Exhibit C. In each subsequent year, one less year's diversions (starting with 1952 and proceeding chronologically) will be utilized from Exhibit C for inclusion in the rolling 40-year limit and one more year of actual diversions under the change decree(the immediately preceding year) shall be added. Following 39 years of Longmont's operation of the changed water right, and every year thereafter, Longmont's actual diversions for the preceding 39 years shall be used to determine the diversion limit in each year based on the 40-year rolling average volumetric limit. H. Return flow replacements. When diverting the Longmont Coffin Davis Right for the alternate uses, Longmont shall maintain historical irrigation return flows associated with the Longmont Coffin Davis Right. Longmont shall make its required historical irrigation return flow replacements to Dry Creek and/or St. Vrain Creek at or above a point on the St. Vrain Creek where the St. Vrain Creek crosses under Colorado State Highway 119, which crossing is depicted on Exhibit F attached hereto. Longmont shall deliver water to satisfy its return flow obligations under this decree when there is a valid downstream call, including decreed exchanges, senior to December 30,2009. Longmont shall replace its return flow obligations upstream of the senior downstream calling right including decreed exchanges. I. Calculation of return flow replacements. i. Irrigation season. During April through October, Longmont's return flow replacement obligations shall be calculated daily by multiplying the measured diversions of the Longmont Coffin Davis Right for the alternate uses by the appropriate monthly return flow factor in Table 3, below. Longmont Coffin Davis Right diversions calculated as return flow water shall then be returned to Dry Creek and delivered to St. Vrain Creek at their confluence,to satisfy return flow replacement obligations. ii. Non-irrigation season. During November through March, Longmont's monthly return flow replacement obligations shall be calculated by multiplying the total measured diversions of the Longmont Coffin Davis Right for the alternate uses during the preceding April through October by the appropriate monthly return flow factor shown in Table 3, below. Sources of return flow replacements. The return flow replacements required herein shall be made using the Longmont Coffin Davis Right water made available to Longmont pursuant to the changes adjudicated in this Ruling and Decree(via deliveries to Dry Creek or the Mine Permit Area through the augmentation station)and/or using any other water available to Longmont that is fully-consumable or is otherwise decreed for such purposes, including without limitation the following: i. Longmont's right to transmountain water derived from the United States Department of the Interior, Bureau of Reclamation, Colorado-Big Thompson Project,via the St. Vrain Supply Canal and the Southern Pipeline. The point of delivery to St. Vrain Creek of said Supply Canal is located in the NWt/4 NWt/4 of Section 20, Township 3 North,Range 70 West of the 6th P.M., Boulder County, Colorado. Said Supply Canal has a capacity of 575 c.f.s. These rights will include Longmont's share of water rights resulting from the Windy Gap Project (a/k/a Six Cities Transmountain Diversion). The Windy Gap Project is a transmountain water diversion project that delivers water from the Colorado River Basin to the South Platte River Basin. Decrees for the Windy Gap Project include, without limitation, the decrees entered on October 27, 1980 in Civil Action No. 1768, District Court, Grand County, State of Colorado and Case Nos. W-4001 and 80CW 108, District Court, Water Division No. 5;the decree entered on February 6, 1989 in Case No. 88CW 169, District Court, Water Division No. 5, State of Colorado; and the decree entered on July 19, 1990 in Case No. 89CW298,District Court,Water Division No. 5, State of Colorado. Notwithstanding the foregoing provisions,this Ruling and Decree is subject to the terms of the Stipulation between Longmont and the Northern Colorado Water Conservancy District, dated February 25, 2010,more fully described in Paragraph 22, below. ii. Button Rock Reservoir(Amended Lyons Storage Reservoir), Reservoir Priority No. 33, appropriation date February 8, 1910, for 1,765 acre-feet; Button Rock Reservoir(Enlarged and Amended Longmont Reservoir No. 3), Reservoir Priority No. 35, appropriation date July 3, 1926, for 2,866.5 acre-feet; Button Rock Reservoir(Enlarged and Amended Longmont Reservoir No. 3)First Enlargement,Reservoir Priority No. 53A, appropriation date May 27, 1964, for 13,330.7 acre-feet; Button Rock Reservoir(Enlarged and Amended Longmont Reservoir No. 3) Second Enlargement,Reservoir Priority No. 53B, appropriation date May 27, 1964, for 32,551.1 acre-feet, conditional. The foregoing rights and priorities were adjudicated by decree dated February 25, 1971, in Civil Action No. 20716 in the District Court in and for Boulder County. This instream reservoir is located on the North St. 9 Ruling and Decree Case No.2009CW27 1 City of Longmont Vrain Creek in Sections 17, 18, 19 and 20, Township 3 North,Range 71 West of the 6th P.M., and Sections 13 and 24, Township 3 North, Range 72 West of the 6th P.M., Boulder County, Colorado. iii. Longmont's right to Union Reservoir water derived from its ownership in the Union Reservoir Company under the following water rights and priorities: Priority No. 51,New Series, adjudicated March 13, 1907 by the District Court, Boulder County, for 13,219 acre-feet of storage with an appropriation date of October 6, 1902;refill decree entered March of 1977 in Case No. W-7486, District Court, Water Division No. 1, for 5,879 acre-feet of storage with an appropriation date of May 1, 1973; conditional storage right for Union Reservoir enlargement entered in Case No. 86CW394, District Court, Water Division No. 1, on February 19, 1991 for 19,802 acre-feet of storage with an appropriation date of October 28, 1986; and any other of Longmont's water rights decreed for storage in Union Reservoir and for augmentation,replacement, and exchange. Releases from Union Reservoir are delivered,via Spring Gulch,to the Saint Vrain Creek in the SE1/4 of Section 7, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado. iv. Replacement, augmentation and exchange water available from Longmont's interests in the following ditches diverting from St. Vrain Creek pursuant to decrees entered by the District Court in and for Water Division No. 1 on May 20, 1983, in the following cases: Case No. 81CW355,Longmont Supply Ditch; Case No. 81CW356, Rough&Ready Ditch; Case No. 81CW357, Smead Ditch; Case No. 81CW360, Palmerton Ditch; Case No. 81CW361, Oligarchy Ditch; and Case No. 81CW362, Swede Ditch. v. Replacement, augmentation and exchange water available from Longmont's interests in the following ditches diverting from St. Vrain Creek pursuant to decrees entered by the District Court in and for Water Division No. 1 on October 29, 1991, in the following cases: Case No. 87CW212,Longmont Supply Ditch; Case No. 87CW213, Rough& Ready Ditch; and Case No. 87CW214, Oligarchy Ditch. vi. Replacement, augmentation and exchange water available from Longmont's interests in the following ditches diverting from St. Vrain Creek pursuant to decrees entered by the District Court in and for Water Division No. 1 on August 10, 1995 in the following cases: Case No. 87CW215, Beckwith Ditch; Case No. 87CW219, Pella Ditch; Case No. 87CW220, South Flat Ditch; Case No. 87CW221,Zweck&Turner Ditch; Case No. 87CW218,Niwot Ditch; and Case No. 87CW216, Clover Basin Ditch(a/k/a Pella Ditch—Second Enlargement). vii. Replacement, augmentation and exchange water available from Longmont's interests in the Clough Private Ditch,the Clough and True Ditch, the Montgomery Private Ditch, and the Smead Ditch, all diverting from St. Vrain Creek,pursuant to the decree entered by the District Court in and for Water Division No. 1 on April 17, 2006 in Case No. 10 Ruling and Decree Case No.2009CW27 1 City of Longmont 01CW188. viii. Replacement, augmentation and exchange water available from Longmont's interests in the Rough&Ready Ditch and the Oligarchy Ditch pursuant to decrees entered by the District Court in and for Water Division No. 1 on or about November 20, 2008 in Case Nos. 00CW240 and 241. ix. Replacement, augmentation and exchange water made available to Longmont by decrees to be entered by the District Court in and for Water Division No. 1 pursuant to change applications previously filed by Longmont involving Longmont's interests in the following ditches: James Ditch(Case No. 00CW239) and Peck Lateral Ditch (Case No. 07CW330),both diverting from St. Vrain Creek. x. Replacement, augmentation and exchange water to be made available from Longmont's interests in the following reservoirs diverting from St. Vrain Creek pursuant to decrees entered by the District Court in and for Water Division No. 1 in the following cases: Case No. 87CW235, Oligarchy Reservoir No. 1; Case No. 87CW231, Pleasant Valley Reservoir; Case No. 87CW222, Union Reservoir; Case No. 87CW253, McIntosh Reservoir; Case No. 87CW232,McCall Reservoir; and Case No. 87CW233, Clover Basin Reservoir. Replacement, augmentation and exchange water made available to Longmont pursuant to the decrees and from the sources described in this Paragraph 8.J. shall include reusable municipal return flows resulting from such sources and uses. The point of discharge of Longmont's wastewater treatment plant effluent is presently located in the SWt/4 NEt/4 of Section 11, Township 2 North, Range 69 West of the 6th P.M.,Boulder County, Colorado. K. Dry-up. Longmont shall remove land from irrigation by the Longmont Coffin Davis Right in order to use the water right for the alternate uses. The percentage of the Longmont Coffin Davis Right available for the alternate uses shall be determined using the following equation: Alternate Use Percentage=(315.5 acres- Irrigated Acres) 1315.5 acres x 100 For example, if Longmont continues to irrigate the two historically irrigated fields located outside the Mine Permit Area, as shown on Exhibit B, with an area totaling approximately 36 acres, then Longmont may use approximately 88.5 percent of the Longmont Coffin Davis Right for the alternate uses. Should Longmont elect to utilize a portion of the Longmont Coffin Davis Right for irrigation within Mine Permit Area the acreage to be irrigated would be included in the foregoing calculation, thereby reducing the amount that could be used for the alternate uses. L. Revegetation. The lands historically irrigated by the Longmont Coffin Davis Right that have been mined and are not covered by ponds and wetlands upon completion 11 Ruling and Decree Case No.2009CW271 City of Longmont of reclamation of the Mine Permit Area will be planted with natural vegetation. The Project Property will be managed, in perpetuity,by Longmont's Public Works and Natural Resources Department as a public open space/greenway, thereby ensuring that such natural vegetation is established and maintained. Longmont's incorporation of these lands into its parks and open space system is therefore adequate to satisfy the revegetation and noxious weed management provisions of§ 37-92-305(4.5)(a), C.R.S. M. Accounting. Longmont shall keep accurate daily records of Coffin Davis Ditch headgate diversions, augmentation station deliveries,return flow obligations,return flow payments, and available net stream depletion credits in order to assist in the administration of the changes approved herein for the Longmont Coffin Davis Right. Draft accounting forms are attached hereto as Exhibit D; these forms may be integrated with Longmont's other accounting forms already developed and used by Longmont. The accounting forms are not decreed herein and may be modified from time to time upon approval of the Division Engineer. Copies of the accounting shall be submitted to the Water Commissioner on a monthly basis, and an annual report shall be submitted to the Division Engineer by November 15th, or such other date specified by the Water Commissioner. III. Approval of plan for augmentation. 9. Structures and water right to be augmented. The following described structures (the"Project Reclamation Features") are included in the plan for augmentation described herein, and a new water right is also hereby adjudicated for said structures: A. Structures. The Project Reclamation Features include all new ponds, streams and other reclamation features within the"Augmentation Area" of the Mine Permit Area depicted on the attached Exhibit E, that, following the completion of mining, cause new evaporative depletions and new consumptive use from wetlands established as the result of reclamation. The foregoing excludes the "Peschel Pond"that was created due to mining operations occurring prior to December 31, 1980,with a surface area of approximately 7.2 acres, located in the SEl of Section 7, Township 2 North, Range 68 West, 6th P.M., Weld County, Colorado, as depicted on Exhibit E. B. Location. The Mine Permit Area consists of approximately 712 acres located in Sections 7, 8, 9, 17, & 18, Township 2 North, Range 68 West, 6th P.M.,Weld County, Colorado, and is depicted on Exhibits A&E. C. Source. Water tributary to St. Vrain Creek and Dry Creek, a tributary of St. Vrain Creek. D. Date of appropriation. October 26, 2004, on which date there was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, 12 Ruling and Decree Case No.2009CW271 City of Longmont without limitation,the Longmont City Council's ordinance(O-2004-79) approving the First Amended and Restated Mineral Lease Agreement with AI. E. Amount. 2 c.f.s., conditional. F. Use. Reclamation, recreation, fish and wildlife propagation, and wetland propagation. G. Well Permit. The Project Reclamation Features are currently permitted, in the name of Al and in accordance with temporary substitute supply plans pursuant to §37-90- 137(11), C.R.S., as No. 67433-F. Longmont shall apply for a new well permit in accordance with this Ruling and Decree, and the State Engineer shall issue the requested permit pursuant to the terms and conditions of this Ruling and Decree. 10. Water rights to be used for augmentation. A. Longmont Coffin Davis Right. The Longmont Coffin Davis Right, as changed by this Ruling and Decree, and more fully described in Paragraphs 6 through 8 above. B. Other Longmont water rights. All additional sources of water available to Longmont that are fully-consumable or are otherwise decreed for such purposes, including, without limitation, those sources described in Paragraph B.J., above. 11. Operation of plan for augmentation. At all times when the Project Reclamation Features are out-of-priority Longmont shall replace the net depletions associated with the Project Reclamation Features using the net stream depletion credits available from the Longmont Coffin Davis Right, as changed in this Ruling and Decree, and/or the additional sources of augmentation water available to Longmont identified in Paragraph 10.B., above. A. Depletions. The total annual depletions from the Project Reclamation Features are estimated to be 318.25 acre-feet, based on a projected 64.0 acres of free water surface area(ponds and streams) and 63.7 acres of new wetlands area to be established upon full implementation of the post-mining reclamation plan for the Mine Permit Area. The foregoing is only an estimate, and Longmont shall replace the actual out-of-priority depletions from the Project Reclamation Features, to be calculated as follows: i. Depletion rate per acre -Water surface evaporation. The net surface evaporation rate per acre of ponds and streams established by the Project is 2.523 acre- feet annually, distributed on a monthly basis as shown in Column 2, "Water Surface Evap."of Table 4, below. These monthly rates may be reduced proportionately during months, or portions of months, in which ice cover occurs. The foregoing rate is calculated using a methodology consistent with both the Colorado Division of Water Resources' General Guidelines for 13 Ruling and Decree Case No.2009CW27 1 City of Longmont Substitute Water Supply Plans for Sand and Gravel Pits and § 37-92-305(12)(a), C.R.S. ii. Depletion rate per acre- Wetlands. The net per acre rate of increased depletions attributable to new wetlands area established by the Project shall be determined based on the location of the wetlands within one of four zones located within the Mine Permit Area as shown on the attached Exhibit E, and ranges from 2.302 to 2.615 acre-feet per acre annually. Table 4 shows the monthly per acre augmentation replacement requirements for increased depletions of water by new wetlands within the reclaimed Mine Permit Area. Determination of area. Longmont shall survey the(post December 31, 1980) free water surface area established by reclamation of the Mine Permit Area and shall bi-annually survey the total post-mining area of new wetlands. For purposes of this Ruling and Decree, "wetlands" shall be defined in accordance with the criteria contained in the U.S. Army Corps of Engineers Wetlands Delineation Manual (USACE 1987), as it may be amended or updated at the time of such survey. The surveyed acreage shall be recorded on Longmont's accounting forms. Bi-annual wetlands area surveys of the Mine Permit Area shall continue after mining ceases until the percentage change from the prior survey is less than 5%. iv. Calculation of total depletions. Longmont's total depletions for the Project Reclamation Features shall be calculated by multiplying the surveyed water surface and wetlands area acreages by the per-acre unit depletion rates in Table 4, which shall be converted 14 Ruling and Decree Case No.2009CW271 City of Longmont to daily depletion rates on Longmont's accounting forms. Depletions associated with the Project Reclamation Features are instantaneous to St. Vrain Creek in the NW'/4 of Section 9, Township 2 North,Range 68 West of the 6th P.M., Weld County, Colorado. B. Replacements. i. Irrigation season. During April through October,when the Project Reclamation Features are out-of-priority, Longmont shall replace the depletions by: (1) delivering the Longmont Coffin Davis Right's net stream depletion credits (calculated pursuant to Paragraph 8.E., above) directly to the Mine Permit Area, (2)by delivering the Longmont Coffin Davis Right's net stream depletion credits to Dry Creek and St. Vrain Creek via the augmentation station described above, or(3)by providing augmentation water from Longmont's other available fully-consumable sources, delivered to St. Vrain Creek downstream of the Dry Creek confluence and above the next downstream calling water right. When Longmont replaces the depletions by delivering the Longmont Coffin Davis Right's net stream depletion credits to the Mine Permit Area, the evaporative and wetlands consumptive use depletions will be replaced instantaneously with all or a portion of those credits, as with deliveries to the stream. ii. Non-irrigation season. During November through March,when the Project Reclamation Features are out-of-priority,Longmont shall replace the depletions by delivering water to St. Vrain Creek, at or above the downstream calling water right, from the sources described in Paragraph 10, above,which may include, at Longmont's discretion, Longmont Coffin Davis Right water stored in Union Reservoir pursuant to this Ruling and Decree. C. Measurement and accounting. Longmont shall install measuring devices acceptable to the Division Engineer as necessary to administer the plan for augmentation approved herein. Longmont shall keep accurate daily records of all calls, calculations of depletions, and amounts and sources of replacements made under this plan for augmentation. Draft accounting forms are attached hereto as Exhibit D; these forms may be integrated with Longmont's other accounting forms already developed and used by Longmont. The accounting forms are not decreed herein and may be modified from time to time upon approval of the Division Engineer. Copies of the accounting shall be submitted to the Water Commissioner on a monthly basis, and an annual report shall be submitted to the Division Engineer by November 15th, or such other date specified by the Water Commissioner, summarizing the diversions, depletions and replacements made pursuant to this Ruling and Decree. D. Adequate replacement water. The court finds that the replacement sources described in Paragraph 10, above, including,without limitation, the historical net stream depletions from the Longmont Coffin Davis Right,provides Longmont with a firm supply of augmentation water sufficient to make the replacements required under the plan for augmentation approved herein. The water to be provided for augmentation is of a quality and quantity so as to 15 Ruling and Decree Case No.2009CW271 City of Longmont meet the requirements for which the water has been used by senior downstream appropriators, and therefore meet the requirements of§ 37-92-305(5),C.R.S. E. Curtailment by State Engineer. Pursuant to §37-92-305(8), C.R.S.,the State Engineer shall curtail all out-of-priority diversions,the depletions from which are not so replaced as to prevent injury to vested water rights. 12. No injury. The changes of water right and plan for augmentation adjudicated herein will not result in injury to any vested water rights or decreed conditional water rights, provided that the use of the water right changed herein and the operation of the subject plan for augmentation are made in compliance with the terms and conditions described herein. See § 37- 92-305(3), C.R.S. IV. Adjudication of appropriative rights of exchange. 13. Description of exchanges. Longmont adjudicates the following appropriative rights of exchange: A. Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange. i. Upstream terminus. The upstream terminus of the Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange is the St. Vrain Creek Pump Station No. 1,with an inlet located at a point on the North bank of St. Vrain Creek approximately 1,680 feet south and 1,010 feet west of the NE corner of Section 10, Township 2 North, Range 69 West, 6th P.M., Boulder County, Colorado. ii. Downstream terminus. The downstream terminus of the Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange is at the confluence of Dry Creek and St. Vrain Creek, in the NW 'A SE 'A of Section 7,Township 2 North, Range 68 West, 6th P.M.,Weld County, Colorado, approximately 2,490 feet west and 1,710 feet north of the southeast corner of Section 7. The exchange reach is depicted on the attached Exhibit A. iii. Rate. 12 c.f.s., conditional. iv. Source of replacement water. The Longmont Coffin Davis Right, as changed in this Ruling and Decree, and more fully described in Paragraphs 6 through 8 above. v. Date of appropriation. December 22, 2009, on which date there was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, without limitation, the Longmont City Council's approval of a resolution of intent to appropriate. vi. Use. The water diverted by exchange shall assume the decreed 16 Ruling and Decree Case No.2009CW271 City of Longmont uses of the Longmont Coffin Davis Right, as changed in this Ruling and Decree. B. Coffin Davis-Union Reservoir Exchange. i. Upstream terminus. The upstream terminus of the Coffin Davis- Union Reservoir Exchange is Union Reservoir, the outlet of which is located at a point on Spring Gulch in the NW'/4 NEt/4 of Section 6, Township 2 North, Range 68 West, 6th P.M.,Weld County, Colorado, approximately 660 ft south and 2230 ft west of the northeast corner of Section 6. ii. Downstream terminus. The downstream terminus of the Coffin Davis-Union Reservoir Exchange is at the confluence of Spring Gulch and St. Vrain Creek, in the NE'/4 SE'/4 of Section 7, Township 2 North,Range 68 West, 6th P.M., Weld County, Colorado, approximately 840 ft west and 1960 ft north of the southeast corner of Section 7. The exchange reach is depicted on the attached Exhibit A. iii. Rate. 17.3 c.f.s., conditional. iv. Source of replacement water. The Longmont Coffin Davis Right, as changed in this Ruling and Decree, and more fully described in Paragraphs 6 through 8 above. v. Date of appropriation. December 30, 2009, on which date there was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, without limitation, the filing of the Application. vi. Use. The water diverted by exchange shall assume the decreed uses of the Longmont Coffin Davis Right, as changed in this Ruling and Decree. C. Notice to Water Commissioner. Prior to operating the exchange(s) decreed in this case, Longmont shall notify the Water Commissioner of the amount of the exchange(s), the source(s)of substitute supply, the location(s) of the delivery of the substitute supply and the duration of the proposed exchange(s). Longmont shall not operate the proposed exchanges without the prior approval of the Water Commissioner. D. Live stream. The exchanges decreed herein shall only occur during periods of a continuous live stream, as determined by the Division Engineer,between the upstream and downstream termini of the applicable exchange, and is limited to no more than the minimum amount of stream flow existing between the point of delivery of the substitute supply to the surface stream and the point where water is withdrawn from the surface stream. E. Transit loss. The exchanges described above may be subject to transit loss charges if determined necessary by the Division Engineer or Water Commissioner to prevent injury 17 Ruling and Decree Case No.2009CW271 City of Longmont to other water rights. F. Quality of Substitute Water Supply. The substitute supply shall be of a quality and continuity to meet the requirements of use to which the downstream senior appropriator has normally been put. G. Priority. The exchanges decreed in this case shall be exercised within the priority system. V. Adjudication of surface water right. Longmont adjudicates the following new water right: 14. Name of structure. Coffin Davis Ditch, Sherwood Enlargement. 15. Legal description of point of diversion. At the existing decreed alternate point of diversion for the Coffin Davis Ditch, located in the SWt/4 of Section 7, Township 2 North, Range 68 West, 6t''P.M.,Weld County, Colorado, at a point commencing at the SW corner of Section 7,whence the West one-quarter corner of said Section 7 bears North 00°00'00"East, thence North 88°03'49"East 999.07 feet to the point of diversion, as depicted on the attached Exhibit B. 16. Source. Dry Creek, tributary to St. Vrain Creek. 17. Date of appropriation. December 22, 2009, on which date there was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, without limitation, the Longmont City Council's approval of a resolution of intent to appropriate. 18. Amount claimed. 17.3 c.f.s., conditional. 19. Use. Recreation, fish and wildlife propagation, wetland propagation, and irrigation within the Project Property located in Sections 7, 8, 9, 17, & 18, Township 2 North, Range 68 West, Weld County, Colorado. 20. Other. Longmont may divert the Coffin Davis Ditch, Sherwood Enlargement at any time of the year,when available in priority. VI. Additional Terms and Conditions. Longmont's use of the water rights changed, adjudicated and augmented pursuant to this Ruling and Decree shall be subject to the following additional terms and conditions: 21. Pump Station No. 2 stipulations. 18 Ruling and Decree Case No.2009CW27 1 City of Longmont A. CDOT. Pursuant to an agreement between Longmont and the Colorado Department of Transportation("CDOT"), the Pump Station No. 2 (described in Paragraph 7, above), or any other structure proposed to be used by Longmont,will be located on lands owned by CDOT only after all necessary approvals are obtained from CDOT. In the event Longmont needs to access CDOT's right of way for any purpose, Longmont shall obtain a utility permit(or any other required instrument)from CDOT. B. Oliver/JCK Gravel &CPW Stipulations. The inlet of Longmont's proposed Pump Station No. 2 is described as being located at a point on the west bank of St. Vrain Creek approximately 190 feet North and 2700 feet East of the Southwest corner of Section 4, Township 2 North, Range 68 West of the 6th P.M.,Weld County, Colorado. This point is depicted on Exhibit F,on land presently owned by JCK Gravel, Inc. Longmont shall not construct the inlet of the proposed Pump Station No. 2 on land owned by JCK Gravel, Inc. (the "JCK Parcel"), or its successors and assigns, unless and until Longmont has obtained a lawful right to enter the JCK Parcel for that purpose. Longmont recognizes that the CPW has a remainder interest in the JCK Parcel pursuant to an August 6,2002 Donation Agreement. The SH 119 right of way, also shown on Exhibit F within the 200 foot radius of the above-described point, is a potential alternate site for the inlet of the proposed Pump Station No. 2. Because the JCK Parcel is meant to be a bird sanctuary, it is the preference of Longmont, CPW and JCK that the Pump Station No. 2 be constructed on SH 119 right of way. Longmont agrees to make a good faith effort to construct the inlet of the proposed Pump Station No. 2 on the SH 119 right of way prior to seeking a lawful right to construct the inlet of the proposed Pump Station No. 2 on the JCK Parcel. If Longmont is unable to locate Pump Station No. 2 within the SH 119 right of way and is able to gain a lawful right to construct the inlet of Pump Station No. 2 on the JCK Parcel,then Longmont shall locate Pump Station No. 2 as close as possible to SH 119 and shall construct Pump Station No. 2 between August 15 and November 15 so as to minimize impacts to eagle roosting and nesting. Longmont shall also provide for native revegetation in the area that was disturbed by construction and installation of Pump Station No. 2. The native vegetation shall be determined after consultation with staff at St Vrain State Park. 22. Northern stipulation. Pursuant to the Stipulation between Longmont and the Northern Colorado Water Conservancy District("Northern Water"), dated February 25, 2010, and approved by the court by order dated March 1, 2010,this Ruling and Decree is subject to and shall not affect in any way the right of Northern Water to regulate any use of Colorado-Big Thompson("C-BT")Project water or C-BT Project facilities by Longmont pursuant to and in accordance with applicable law, the provisions of the July 5, 1938 contract between the United States and Northern Water for construction of the C-BT Project, the allotment contracts between Northern Water and Longmont, and the rules regulations and policies of Northern Water, as may be amended from time to time. The rules, regulations and policies of Northern Water presently prohibit use of C-BT Project water to replace historical return flows or depletions under an adjudicated change of water right or augmentation plan decree. Longmont shall not use C-BT Project water as a source to replace historical return flows or depletions pursuant to the change of 19 Ruling and Decree Case No.2009CW27 1 City of Longmont water rights or plan for augmentation decreed in this matter,unless, prior to such use, Longmont notifies and obtains written approval from Northern Water specifically allowing such use. CONCLUSIONS OF LAW 23. Incorporation of Findings. The above Findings of Fact are incorporated herein as if fully set forth, to the extent they contain conclusions of law. 24. Application contemplated by law. The Application is one contemplated by law. See §§37-82-101, 37-82-103, 37-87-101, 37-92-302, C.R.S. 25. Jurisdiction. The Water Court has jurisdiction over the subject matter of this proceeding. See § 37-92-203, C.R.S. 26. Can and will. The conditional water rights described herein can and will be diverted, stored, or otherwise captured,possessed, and controlled and will be beneficially used and the project can and will be completed with diligence and within a reasonable time. See § 37- 92-305(9)(b), C.R.S. 27. Statutory authorization. The water rights, changes of water rights, and plan for augmentation, including exchange, described herein are, as a matter of law,permissible and authorized by statute. See e.g., §§ 37-92-103, -302, and-305, C.R.S. 28. Terms and conditions adequate. The terms and conditions as set forth in this Ruling and Decree are adequate to prevent injury to the vested rights of others, including the owners of, or persons entitled to use, water under a vested water right or decreed conditional water right. See §§ 37-92-305(3), (4) and(8), C.R.S. 29. Administration. The change of water rights,plan for augmentation, exchanges, and the new direct flow water right described above are all capable of administration by the State water officials. RULING AND DECREE The foregoing Findings of Fact and Conclusions of Law are incorporated into this Ruling and Decree by this reference, and the Application is hereby granted, subject to the terms and conditions set forth herein. 30. Conditional water rights adjudicated. The court hereby confirms and decrees the following conditional water rights: A. The Project Reclamation Features, described in Paragraph 9, above; and 20 Ruling and Decree Case No.2009CW271 City of Longmont B. The Coffin Davis Ditch, Sherwood Enlargement, described in Paragraphs 14 through 20, above. 31. Conditional rights of exchange adjudicated. The court hereby confirms and decrees the following conditional appropriative rights of exchange: A. The Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange, described in Paragraph 13.A, above; and B. The Coffm Davis-Union Reservoir Exchange, described in Paragraph 13.B, above. 32. Change of water right. The court hereby approves and decrees the change of water right, described in Paragraphs 6 through 8, above, for the Longmont Coffin Davis Ditch. 33. Plan for augmentation. The court hereby approves and decrees the plan for augmentation described in Paragraphs 9 through 12, above. 34. Priority of administration. The Application in this case was filed in the Water Court in the year 2009, and the conditional water rights adjudicated herein for the Project Reclamation Features, Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange, Coffin Davis-Union Reservoir Exchange and Coffin Davis Ditch, Sherwood Enlargement shall be administered as having been filed in that year and shall be junior to all priorities, including decreed exchanges,having been filed in previous years. As between all rights filed in the same calendar year,priority shall be determined by historical dates of appropriation and not affected by the entry of this Ruling and Decree. 35. State and Division Engineers. The State and Division Engineers shall administer the water rights as set forth herein and not curtail diversions by any of the water diversion facilities described herein so long as such diversions occur in accordance with this Ruling and Decree and priority administration under Colorado law. 36. Retained jurisdiction. Pursuant to § 37-92-304(6), C.R.S.,the court shall retain continuing jurisdiction of this case on the question of injury to vested water rights or decreed conditional water rights of others until ten(10) years following the date on which Longmont files a notice with the court and the parties in this case that reclamation of the Mine Permit Area has been completed. In the event that Longmont or any party petitions the court for reconsideration, the court shall order appropriate notice to be given to all the parties hereto. Such petition shall be verified,made in good faith, and shall set forth with particularity the factual basis upon which the requested reconsideration is premised. The party lodging the petition shall have the burden of going forward to establish the prima facie facts alleged in the petition. If a prima facie case of 21 Ruling and Decree Case No.2009CW271 City of Longmont injury to vested water rights is established, Longmont shall thereupon bear the burden of proof to show (a)that any modification sought by any other party is not required to avoid injury to other appropriators, or(b) that any term or condition proposed by Longmont in response to the petition does avoid injury to other appropriators. The retention of jurisdiction period shall be limited to claims of injury based upon failure to implement the protective terms and conditions described herein or failure of such protective terms and conditions to sufficiently protect against injury. 37. Diligence. The conditional water rights decreed herein are continued in full force and effect until February 28, 2019. If the Applicant desires to maintain the conditional water rights thereafter, it shall file an application for finding of reasonable diligence on or before that date, or make a showing on or before then that the conditional water rights have become absolute water rights by reason of the completion of the appropriations. 38. Integrated project. The conditional water rights decreed herein for the Project Reclamation Features, Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange, Coffin Davis-Union Reservoir Exchange and Coffin Davis Ditch, Sherwood Enlargement are part of the integrated water supply for Longmont's Saint Vrain Integrated Reclamation Plan Project; therefore, work on any one feature of the Project shall be considered in fording that reasonable diligence has been shown in the development of all water rights for all features of the entire Project. 39. Filing of Decree. This Ruling and Decree shall be filed with the Water Clerk and a copy filed with the State Engineer and Division Engineer.
