COUNTY PLANNING COMMISSION. WHEREAS , the Board of County Commissioners of Weld County, "' Colorado, pursuant to Colorado statute and the Weld County Home ti Rule Charter, is vested with the authority of administering the e' affairs of Weld County, Colorado, and WHEREAS , a public hearing was held on the 20th day of o April, 1977 in the Chambers of the Board of County Commissioners , Weld County, Colorado, for the purpose of hearing the petition of r- �� the Weld County Planning Commission, requesting a change of zone 0.0 from B-UD - Business Unit Development to A - Agricultural, for a tract of land located in the South Half of the Southwest Quarter of Section 35, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, described as follows : Beginning at the Northwest corner of Section 2, Township 1 North, Range 68 West of the 6th P.M. ; thence North 20°23'36" West, a distance of 43.00 feet to the TRUE POINT OF BEGINNING: thence North 61°18'52" West, a distance of 180.00 feet; thence North 18°45'23" West, a distance of 984.00 feet; thence North 3°25'31" East, a distance of 266.25 feet; thence North 90°00'00" East, a distance of 930.57 feet; thence South 1°29'50" West, a distance of 796.38 feet; thence North 88°47'35" West, a distance of 126.56 feet; thence South 59°38"00" West, a distance of 130.00 feet; thence South 14°11'45" West, a distance of 341.00 feet; thence South 53°40'54" West, a dis- tance of 159.00 feet to the TRUE POINT OF BEGINNING. WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of the petitioner for a change of zone upon the aforementioned tract of land, and WHEREAS, Section 8. 2 and 8. 3 of the Weld County Zoning Res- olution authorized the Board of County Commissioners to grant a change of zone upon the showing by the petitioner of certain facts , as stated below: The previous applicant, Harvey Secor never complied with Section 8. 4 of the Weld County Zoning Resolution. Said section requires submission of a final site plan and final construction schedule to the County Planning Commission for their review and recommendations for zone change requests. Said section also requires that construction of the proposed buildings begin within twelve months after the area has been rezoned. No construction has taken place and the 12 month time period has expired. Therefore, as set forth in said section, the Planning Commission recommends that the Board of County Commissioners instigate action to rezone the property. 770035 BOOK 809. 1'7`� °14 g WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the same , and having been fully informed and satisfied that the request for rezoning complies with the Weld County Comprehensive Plan and the con- ditions set out in Sections 8 . 2 and 8. 3 of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the petition of The Weld County Planning Commission for a change of zone from B-UD - Business Unit Development to A - Agricultural on the above described tract of land, be, and hereby is granted. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 20th day of April , A.D. , 1977. The above and foregoing Resolution was read into the record and signed on the 27th day of April, A.D. , 1977. Harvey Secor, the applicant in Z-212:73:2, has never complied with Section 8.4 of the Weld County Zoning Resolution. Said section requires submission of a final site plan and final construction schedule to the -County Planning Commission for their review and recommendations for zone change requests to B, C, I, MH, or T. This has never been done. Said section also requires that construction of the proposed buildings to begin within twelve months after the area has been rezoned. No construction has taken place and the 12 month time period has expired. There- fore, as set forth in said section, the Planning Commission recommends that the Board of County Commissioners instigate action to rezone the property.
