WHEREAS, the Board of County Commissioners of Weld County, r- Colorado, pursuant to Colorado statute and the Weld County Home 1-4 Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and ° WHEREAS, the Board of County Commissioners of Weld County, co rn Colorado, has reviewed the request of Donald and Janet Walker a for an exemption from the definitions of "subdivision" and c "subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended, a and Section 2-1 of the Weld County Subdivision Regulations , and N tD WHEREAS, the Board of County Commissioners finds that Donald and Janet Walker are the owners of a certain parcel of land located in Part of the Northwest Quarter of Section 30 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado. Donald and Janet Walker wish to sell a portion of said parcel to an adjacent property owner. The legal description of the resultant tract of land of the adjacent property owner is as follows: That portion of the Northwest Quarter of Section 30, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado more particularly described as follows : Considering the West line of the Northwest Quarter of said Section 30 as bearing North 00°00 '00" East and with all bearings con- tained herein relative thereto. Commencing at the West Quarter corner of said Section 30; thence along said West line of the Northwest Quarter of Section 30 , North 00°00 ' 00" East, 310 .00 feet to the true point of beginning; thence continuing along said West line, North 00°00 ' 00" East, 180. 00 feet; thence North 89°18 ' 00" East, 1046. 98 feet to the approximate centerline of a small creek; thence along said approxi- mate centerline, the following three (3) courses and distances : South 13°37 ' East 57 . 00 feet; South 70°51 ' West, 168 . 70 feet; South 7°45 ' East, 71. 58 feet; thence leaving said creek, South 89°18 ' 00" West, 910 .68 feet to the true point of beginning. The abovedescribed tract contains 4 .02 acres more or less. NOW, THEREFORE, BE IT RESOLVED by the Board of County 790868 OA 896 1797617 Commissioners of Weld County, Colorado that the abovede- scribed parcel be, and hereby is, declared to be exempt from the definitions of "subdivision" and "subdivided land" as set forth in Section 30-28-101 (10) , CRS 1973 , as amended, and Section 2-1 of the Weld County Subdivision Regulations. BE IT FURTHER RESOLVED by the Board that the above- described tract of land be, and hereby is , considered to be a single lot. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 18th day of July, A.D. , 1979 .
